KRICK, JR. 2. The undersigned was prepared to work with the Executor, HARRY O. KRICK, JR. to prepare an appropriate Inheritance Tax Return, arrange for appropriate tax to be paid to the Pennsylvania Department of Revenue and to complete administration of the Estate. 3. The Executor, HARRY O. KRICK, JR., has been unresponsive to SAIDIS;, FLOWER Sz LINDSAY.' ~~.~.~W 26 West High Street Carlisle, PA the undersigned in attempts to administer the Estate. Attempts were made to reach the Executor by telephone and several messages were left on his answering machine without response. The enclosed letter of April 20, 2000, marked as Exhibit "A", reminds the Executor that he had been unresponsive and requested additional information concerning the Estate. The Executor did not contact the undersigned to pursue the administration of the Estate and the filing of an Inheritance Tax Return. 4. The Department of Welfare has a substantial lien against the Estate in an amount in excess of $75,000.00. 5. The undersigned wrote to the Executor HARRY O. KRICK, JR., on September 13, 2002, reminding him that he had asked for more information concerning his grandmother's assets, reminding him of the lien with the Department of Welfare and asking for him to promptly respond. A copy of that letter is attached hereto as Exhibit "B". The Executor, HARRY O. KRICK, JR. did not respond to the letter of September 13, 2002. 6. The Executor, HARRY O. KRICK, JR. has not been cooperative in completion of the administration of his grandmother's Estate and payment of any Inheritance Tax and/or the liens of the Department of Welfare. 7. Without the cooperation of the Executor, the undersigned is without the power to move the administration of the Estate forward to completion, or to file an Inheritance Tax Return. WHEREFORE, the undersigned requests that this Court enter a Rule upon HARRY O. KRICK, JR., Executor of the Estate of MIRIAM BURDGE KRICK, to show cause why the undersigned should not be permitted to withdraw as counsel of record for the Estate of MIRIAM BURDGE KRICK. At this point, the Department of Welfare, which of course has a lien against your Grandmother's estate for nursing home care, is insisting that we provide information to establish that the estate was insolvent and unable to pay back these funds.
