THIS AGREEMENT made this 2 nd day of December ,2003, by
and between GARY DEIMLER & SONS CONSTRUCTIONS, 1NC., hereinafter called the
Contractor, and Ma~,~l,~a~. Robert Schmelz , hereinafter called the Owner.
WITNESSETH
The Contractor by instrument dated October 16, 2003 entered into an
Agreement with the Owner for the erection and construction of a 400 S.F. addition and
renovation of family room and kitchen

AND WHEREAS, the Contractor has covenanted and agreed therein to enter into an
additional agreement with the Owner stipulating that no lien or liens of any kind shall be filed
against the above building or the appurtenances thereto.
NOW, THIS AGREEMENT WITNESSETH, that the Contractor, for and in
consideration of the awarding to him of the said contract and for the sum of ONE DOLLAR
($1.00) to him in hand paid by the Owner, the receipt of which is hereby acknowledge, promises
and agrees that no Mechanic Lien or liens shall be filed against the aforesaid building or the
appurtenances thereto by any subcontractor, subcontractors, material men, mechanics, laborers or
anyone for materials furnished, work done or services rendered of any kind whatsoever, for or
about, or on account of the aforesaid building or on the credit thereof.
