McCALEB v c2i-07- &20 FAMILY SETTLEMENT AGREEMENT, RECEIPT AND RELEASE WHEREAS, JOSEPH MEGLIO, late of the Borough of New Cumberland, Cumberland County, Pennsylvania, died on June 14, 2007, having first made his Last Will and Testament in writing dated April 12, 2007, which since his decease was duly probated before the Register of Wills of said Cumberland County and Letters Testamentary issued to LINDA S. GLASSER, the Executrix named in said Last will and Testament of the decedent; and WHEREAS, MARTIN LINWOOD, DANIELLE LINWOOD, CARA MEGLIO, JODIE MEGLIO, JEFFREY B. MEGLIO, BARBARA MEGLIO, BRUCE MEGLIO and ZACKARY A. MEGLIO, BARBARA MEGLIO, BRUCE MEGLIO and ZACKARY A. GLASSER, being the specific legatees sharing in the aforesaid partial distribution of the Estate of said decedent, do hereby declare and acknowledge that we, this day, have, had and received of and from LINDA S. GLASSER, the Executrix under the Last Will and Testament of JOSEPH MEGLIO, the cash set opposite our names in the above-stated partial distribution of our specific legacies under Item SECOND of said Will. NOW, THEREFORE, we, the same MARTIN LINWOOD, DANIELLE LINWOOD, CARA MEGLIO, JODIE MEGLIO, JEFFREY B. MEGLIO, BARBARA MEGLIO, BRUCE MEGLIO and ZACKARY A. GLASSER, specific legatees as aforesaid, do by these presents remise, release, quit-claim and forever discharge each other and the said LINDA S. GLASSER, Executrix, her heirs, executors and administrators, of and from that portion of our distributive shares of the Estate as represented by the aforesaid partial distribution and of and from all actions, suits, payments, accounts, reckonings, claims and demands whatsoever, for or by reason thereof, or by contract, or under the intestate law of the Commonwealth of Pennsylvania, or by reason of any other act, matter, cause or thing whatsoever, from the beginning of the world to the day and date of these presents, except for any obligations arising under this Family Settlement Agreement, Receipt and Release, or -2- LAW OFFICES MARLIN R. McCALEB any remaining distributions to which we are entitled under the aforesaid Will. AND desiring to avoid the delay and expense of the settlement of said Estate by filing an Account of its administration in the Office of the Register of Wills of said County and by having the balance in the hands of the Executrix, as shown by said Account, distributed by the Court of Common pleas of Cumberland County - Orphans' Court Division, we do hereby agree that the within Family Settlement Agreement, Receipt and Release concerning the matter of this partial distribution may be recorded with the same effect upon us as if the same had been reported upon by said Court, and a decree of distribution made on such report by the said Court of Common Pleas - Orphans' Court Division. AND in consideration of the aforesaid settlement being made without the aid of such Court of Common Pleas - Orphans' Court Division, that we, MARTIN LINWOOD, DANIELLE LINWOOD, CARA MEGLIO, JODIE MEGLIO, JEFFREY B. MEGLIO, BARBARA MEGLIO, BRUCE MEGLIO and ZACKARY A. GLASSER, specific legatees as aforesaid, do hereby agree that if any debts or demands shall hereafter be recovered against the Estate of Joseph Meglio and be legally payable out of the same, for which the Estate lacks sufficient assets to pay, that each of us will return to the said Executrix an amount equal to our pro-rata shares of said debts, said amount not to exceed the amount of our pro-rata shares of -3- LAW OFFICES MARLIN R.
