JUDGMENT NOTE
Upon Demand, JOSEPH MCMANUS does hereby promise to pay to WILLIAM G.
YOTHERS and EILEEN YOTHERS, husband and wife, or their assigns, Five Thousand Five
Hundred and 00/100 ($5,500.00) Dollars, without defalcation, value received due and payable as
follows: Monthly payments in the amount of One Hundred Sixty-nine and 83/100 ($169.83) Dollars
to be applied first to interest at thc rate of seven (7%) percent per annum and thereafter to reduction
of principal with first payment due December 1, 2003 and payments thereafter due on the 1 st day of
each succeeding month until paid in full. Nothing herein shall prevent the debtor to prepay any
amount of principal at any time. Further, the said Joseph McManus does hereby authorize and
empower the Prothonotary or any Attorney of any Court of Record of the Commonwealth of
Pennsylvania or elsewhere to appear for and enter judgment against him for the above sum, with or
without declaration, with costs of suit, release of errors, without stay of execution, and with Ten
(10%) percent added for collection fees; and the said Joseph McManus hereby agrees not to make
any motion or any application whatsoever to any Court for an inquisition on any real estate that may
be levied upon to collect the aforesaid sum, and voluntarily condemns same, and authorizes the
Prothonotary or other appropriate public official to enter said voluntary condemnation upon the Writ
of Execution. The said Joseph McManus further agrees that any property, real, personal or mixed
may be sold through a Writ of Execution and further hereby waives and releases all relief from any
and all appraisements, stay or exemption being of any State now in force or which are passed
hereafter. Further a charge of twenty-five ($25.00) dollars shall be due and payable for any checks
issued by McManus in payment of his obligations hereunder which shall be dishonored by the bank
upon which said check is drawn.
WAIVER
IN EXECUTING THIS NOTE, I UNDERSTAND THE TRANSACTION, AND
KNOWINGLY AND VOLUNTARILY WAIVE MY RIGHT TO CONTEST THE ENTRY OF
THIS JUDGMENT AGAINST ME IN COURT AND DO HEREBY CONSENT TO THE ENTRY
OF THE JUDGMENT BY CONFESSION. I HEREBY CERTIFY THAT I HAVE EARNINGS OF
$10,000.00 OR MORE PER YEAR.
