COMPLAINT FOR CHILD CUSTODY
AND NOW comes the Plaintiff, Maureen E. Elliott, by and through her
attorney, Mark T. Silliker, Esquire, and respectfully requests this Honorable Court award
her custody of the subject minor child, and in support thereto, avers the following:
1. Plaintiff is Maureen E. Elliott, an adult individual residing at 356
Stonehedge Lane, Mechanicsburg, Cumberland County, Pennsylvania. 17055.
2. Defendant is Glen W. Elliott, an adult individual residing at 455
Stonehedge Lane, Mechanicsburg, Cumberland County, Pennsylvania. 17055.
3. The subject child is Graciahna L. Elliott, born August 29, 2006, in
Cumberland County, Pennsylvania
4. The relationship of the Plaintiff to the subject minor child is that of
natural mother.
5. The relationship of the Defendant to the subject minor child is that of
natural father.
6. The minor child has resided at the following addresses, in the custody
of the following individuals:
a. From birth, August 29, 2006 to December 17, 2007 - the
subject minor child resided at 455 Stonehedge Lane, Mechanicsburg,
Cumberland County, Pennsylvania, in the care and custody of Plaintiff and
Defendant, as well as her half-siblings, Stephanie Waller, age eight, and
Isabella Elliott, age two.
b. From December 17, 2007 to present - the subject minor child
resides at 356 Stonehedge Lane, Mechanicsburg, Cumberland County,
Pennsylvania, in the care and custody of the Plaintiff, her matemal
grandmother, and her half-sister, Stephanie Waller.
7. There have been no prior actions for custody of the subject minor child
in this or any other jurisdiction.
8. The Plaintiff is not aware of the existence of any other individuals who
have any type of claim whatsoever regarding the custody of the subject minor child.
9. Plaintiff and Defendant have separated and Plaintiff would respectfully
request this Honorable Court schedule a Conciliation Conference in order to assist the
parties in arriving at an appropriate custodial schedule.
10. Plaintiff has always been the primary caregiver of the subject minor
child. Furthermore, she feels she can provide a more wholesome environment and a
better upbringing than can the Defendant. However, Plaintiff also feels that the child
would benefit from reasonable and indeed liberal periods of time with her Father.
11. The Plaintiff believes and therefore avers that she is much better able
to meet the needs of the subject minor child than the Defendant.
12. The Plaintiff believes and therefore avers that it is in the best interest
of the subject minor child that she be placed in her legal and physical custody.
WHEREFORE, Plaintiff requests this Honorable Court award her custody
of the subject minor child.

ORDER OF COURT
AND NOW, Thursday, January 10, 2008 , upon consideration of the attached Complaint,
it is hereby directed that parties and their respective counsel appear before Hubert X. Gilroy, Esq. , the conciliator,
at 4th Floor, Cumberland County Courthouse, Carlisle on Thursday, January 31, 2008 at 10:30 AM
for a Pre-Hearing Custody Conference. At such conference, an effort will be made to resolve the issues in dispute; or
if this cannot be accomplished, to define and narrow the issues to be heard by the court, and to enter into a temporary
order. Failure to appear at the conference may provide grounds for entry of a temporary or permanent order.
The court hereby directs the parties to furnish any and all existing Protection from Abuse orders,
Special Relief orders, and Custody orders to the conciliator 48 hours prior to scheduled hearing.
