consideration of Petitioner's Petition for Rule To Show Cause Why
Agent Should Not Be Directed To File an Inventory and Account for
Personal Property of His Principal Taken and Retained by Agent
under Claim of Gift, and of the Answer to Petition for Rule To
Show Cause Why Agent Should Not Be Directed To File an Inventory
and Account for Personal Property of His Principal Taken and
Retained by Agent under Claim of Gift, and following an initial
period of hearing, which has not yet been completed, the record
shall remain open, and counsel are directed to contact the
Court's secretary for the purpose of scheduling a further period
of hearing.
Pursuant to an agreement of counsel announced at
the hearing on today's date, it is further ordered and directed
as follows:
1. At such time as a Certificate of Deposit in
the name of H. Glenn Steager at PNC Bank having the last four
numbers of the account as 5946, being of a recent value of
$3,767.72, and having a maturity date of August 3, 2008, matures,
the proceeds of that Certificate of Deposit shall be placed in
the name of the Petitioner, Howard P. Steager;
2. A certain wristwatch which has been
identified In Petitioner's petition has been acknowledged by

Petitioner to have been returned by Respondent;
3. The firearms presently in storage with
Classic Firearms under the name of H. Glenn Steager shall, as
between the parties to this action, be deemed to be held in
constructive trust for the Petitioner, Howard P. Steager;
4. Respondent, H. Glenn Steager, shall promptly
deliver to Petitioner's counsel a check in the amount of $435
payable to Petitioner, Howard P. Steager, representing the face
value of certain coins which are in the Respondent's possession,
in which value he is willing to return to the Petitioner; in
addition, the proof coins received by Respondent and belonging to
Petitioner shall be returned to him.
It is noted that for disposition as to possession
and ownership by the Court remain certain firearms which were
received by Respondent, H. Glenn Steager, and which belonged to
Petitioner, and certain coins allegedly having a value in excess
of their face value (to a large extent said to be silver
dollars), which Petitioner claims were taken by Respondent, and
which Respondent denies having taken from Petitioner. Similarly
for disposition are certain silver certificates in the same
category as the aforementioned coins.
At the time of adjournment on today's date
Respondent was presenting his case-in-chief, and Respondent was
being subjected to direct examination by his counsel. No
exhibits had been identified or admitted.
It is noted that neither counsel has requested
that a copy of the transcript of today's proceeding be filed.
