F, Falter Co., inc. is a corporation with offices and/or a place of business situate at 205R State Road, Camp Hill, Cumberland County, Pennsylvania, and is authorized to do business in the Commonwealth of Pennsylvania, 2, Defendant, Donald Eberly, is an adult individual with a last known address of 1278 Boiling Springs Road, Boiling Springs, Cumberland County, Pennsylvania 17007. 3. During all relevant times hereto, Defendant conducted business under the fictitious name Donald Eberly Plumbing and tIeating. 4, Plaintiff is, and at all relevant times was, a wholesale distributor of building supplies, S. Defendant, is, and at all relevant times was, a contractor, ,,. - . . ~. On or about November 5, 1997, Defendant applied to Plaintiff for credit. 7. Between Novomber S, 1997 and December 31, 1998, various products, goods, supplies, and materials (hereinafter collectively referred to as "products") were ordered by Defendant from Plaintiff Plaintiff sold and provided the products ordered by Defendant. The invoices are too numerous to be attached hereto, howover, invoices shall, upon roquest, be supplied to Defendant. 8. The prices charged far the products sold to Defendant as set forth in the invoices wore the fair, reasonable, and market prices of the products., and the prices that Defendant agreed to pay. 9. Plaintiff has maintained a statement of account keeping an accurate and running amount of debits and credits for the sale of products sold to Defendant by Plaintiff, 10. Plaintiff has submitted to Defendant statements of account accurately showing all debits and credits for transactions with Defendant, said statements of account showing an amount owing to Plaintiffof $ 1,112.58 through December 31, 1998. A statement dated Decemb. 31, 1998, is attached hereto, incorporated herein and marked Exhibit "A". 11. Pursuant to the terms and conditions of sale, which terms and conditions were agreed to by Plaintiff and Defendant, Plaintiff is entitled to receive a finance chargepf LS% per month on past due amounts. 2 12. Despite demand, Defendant has refLsed to pay the past due balanan on the open acoount of all sums due and owing to Plaintiff 13. Any and all conditions precedent to the bringing of this action has been performed by Plaintiff. 14, The amount in controversy is within the jurisdictional amount requiring compulsory arbitration is within the jurisdictional amount requiring compulsory arbitration, WHEREFnRE, Plaintiff R, F.
