At a pretrial conference held on April 11, 2001, before the Honorable Edgar B,
Bayley, J„ present for the plaintiff was Karl J. Januzzi, Esquire, and present for
defendant was Richard 1-l. Wix, Esquire.
This suit arose out of an automobile accident that occurred on March 21, 1997, at
the Intersection of Zimmerman Drive and Gettysburg Road in Lower Arlen Township.
Negligence, while not admitted by defendant, is not seriously contested. Defendant,
however, claims that plaintiff was contributurily negligent.
Plaintiff maintains that he suffered a neck injury and injury to his temporal
mandibular joint (TMJ). He seeks work loss in excess of first party benefits and non-
economic dAmages,
Estimated time of trial, one and a half to two days.

PRE-TRIAL MEMORANDUM
1, Facts as to Liability.
This action arises out of a motor vehicle collision which occurred at the
intersection of Zimmerman Drive and Gettysburg Road in Lower Allen Township,
Cumberland County, on March ?_1, 1997 at approximately 6;55 p.m. At that time,
Defendant, Christina Hooper, was operating her vehicle in the northerly direction on
Zimmerman Drive, approaching the intersection of Gettysburg Road. Defendant
attempted to make a left turn from Zimmerman Drive onto Gettysburg Road and turned
directly Into the path of the Plaintiff, who was operating his vohicle in a southerly
direction on Zimmerman Drive.
2. Facts as to Damages.
As a result of the collision, Plaintiff suffered neck injuries and Injury to his
Temporal Mandibular Joint (TMJ), Claimant missed a substantial amount of work
resulting in a past wage loss of $36,144.00. This was set forth in a vocational report
authored by Harold V. Kulman. Mr. Kulman has also determined that Mr. Carnes has
an earning capacity loss of $163,020.00.

AND NOW comes the Plaintiff, RONALD A, CARNES, by and through his
attorney, SHOLI_ENBERGER & JANULZI, I_LP, and does respectfully represent the
following:
1. The Plaintiff, RONALD A. CARNES , is an adult individual who currently
resides at 877 t)unkle Street, Steelton, Dauphin County, Pennsylvania.
2, The Defendants, ROGER HOOFER and CHRISTINA HOOFER, are adult
individuals whose last known address is 201 Fairway Drivo, Mechanicsburg,
Cumberland County, Pennsylvania.
3. l he facts and circumstances hereinafter set forth took place on March 21,
1997, at or about 6:55 p .m. at the intersection of Zimmerman Drive and State Road
2027 (Gettysburg Road) in Lower Allen Township, Cumberland County, Pennsylvania,
4. At all times relative hereto, the Defendant, ROGER HOOFER, was the owner
and operator of a 1989 Oldsmobile Cutlass, bearing registration plate AWN6156.
5. At the aforesaid time and place, Plaintiff, RONALD CARNES, was operating a
1989 Acura Integra in a Southbound direction on Zimmerman Drive, approaching that
road's intersection with State Road 2027.
6. At the aforesaid time and place, Defendant, CHRISTINA HOOFER, was

aperating fhe aforementioned 1989 Oldsmobile Cutlass, registration Plato number
AWN6158, in a Northbound direction on Zimmerman Drive, approaching that road's
intersection with State Road 2027.
7. At the aforesaid time and place, Defendant, CHRISTINA HOOPER,
attempted to make a left hand turn on to State Road ?.027 and turned directly into the
path of the vehlole being operated by Plaintiff, RONALD A• CARNES, resulting in a
collision between the two vehicles.
8. As a result of the aforesaid collision, Plaintiff, RONALD A• CARNES, has
suffered serious and permanent injuries, including but not limited to the following:
(a) Internal derangement of the right tempomandibularJnint;
(b) Myofascial pain syndrome;
(c) Post concussion syndrore;
(d) Major depression;
(e) Disk hemlationl'disk bulge C5-8;
(f) Disk herniation/disk bulge C8-7;
(g) Severn strain to the muscles, tendons, Ngaments and other soft tissues at
or about the cervical spine;
(h) Shock to the nerves and nervous system; and
(i) Mentai and physical anguish.
g• As a direct and proximate result of the aforesaid injuries, Plaintiff,
RONALD A. CARNES, has undergone and in the future will undergo great pain and
suffering for which damages are claimed•
10. As a further result of the aforesaid Injuries, Plaintiff, RONALD A•
CARNES, has suffered and may continue to suffer a loss of earnings for which
damages are claimed.
11. As a further result of the aforesaid Injuries, Plaintiff, RONALD A.
CARNES, had and/or may in the future incur oxpenses for medical treatment and

13. As a further result of the aforesaid Injuries, Plaintiff, RONALD A.
CARNES, has sustained a permanent diminution In his ability to enjoy life and Ilfe's
pleasures for which damages are claimed.
14. As a further result of the aforesaid injuries, Plaintiff, RONALD A.
CARNES, has Incurred or may horelnafter Incur financial expenses and losses which
exceed sums recoverable under the limitations and exclusions of the Pennsylvania
Motor Vehicle Financial Responslbitlty Law for which damages are claimed.
15. As a further result of this collision, Plaintiff, RONALD A. CARNES, has
and/or may in the future incur reasonable and necessary medical and rehabilitative
costs and expenses in excess of the amounts paid or payable pursuant to
Subchapter B of the Pennsylvania Motor Vehicle Financial Responsibility Law, Workers'
Compensation or any program, group contract, or other arrangement for payment of
benefits as defined in 75 Pa. C.S,A• Section 1719.
16. Plaintiff is covered by the full tort option under his motor vehicle insurance
policy with State Farm Insurance Company. A copy of the declaration page is attached
hereto as Exhibit "A"•

18• The aforesaid collision was a direct and proximate result of the negligence of
Defendant, CHRISTINA HOOPER, in operating her vehicle in a careless, reckless and
negligent manner as follows;
(a) In operating her vehicle at an excessive rate of speed under the

(b) In falling to have har vehicle under propar and adequate control;
(c) In falling to apply her brakes in time to avoid a collision;
(d) In failing to observe Plaintiffs vehicle travelling on Zimmerman Drive;
(e) In failing to exercise the high degree of care required of a motorist
entering an intersection;
(f) In attempting to enter an intersection when such movement could nct be
safely accomplished;
(g) In turning in such a manner as to ondanger other vehicles on the highway;
(h) In failing to prudently proceed through the Intersection so as to avoid
creating a dangerous situation for other vehicles on the highway;
{i) In falling to observe oncoming traffic;
Q) Irr proceeding through an intersection when such movement could not be
made in safety;
(k) In failing to keep a propar look-out for approaching vehicles;
(I) In failing to yield the right-of-way to on-coming traffic;
(m) In otherwise operating said vehicle in a careless, reckless, and negligent
manner and In a manner vialating the Motor Vehicle Cade of the
Commonwealth of Pennsylvania.
WHEREFORE, Plaintiff, RONALD A. CARNES, demands judgment against the
Defendant, CHRISTINA HOOFER, for compensatory damages in an amount in excess
of the amount requiring compulsory arbitration.

operating the 1989 Oldsmobile Cutlass with the expressed and/or Implied permission of
the Defendant, ROGER HOOFER.
2. Defendant, ROGER HOOFER was negligent In that;
a, Ha entrusted the use of the 1989 Oldsmobile Cutlass to Defendant
Christina Hooper, who he knew, or should have known, had a
reputation for reckless andlor negligent driving; and,
b. Ha entrusted said vehicle to Defendant, Christina Hooper, when it
was likely that she would operate Defendant's vehicle in such a
manner as to create an unreasonable risk of harm to others,
WHEREFORE, Pialnt(ff, RONALD A. CARNES, demands Judgment against the
Defendant, ROGER HOOFER, for compensatory damages in an amount In excess of
the amount requiring compulsory arbitration.
