N0. 1384 CIVIL, 1979 IN EMINENT DOMAIN PRELIMINARY OBJECTIONS TO PETITION FOR APPOINTMENT OF BOARD OF VIEW AND NOW comes Defendant, Township of Hampden, by its Attorneys, SNELBAKER, McCALEB & FLICKER, and preliminarily objects to Plaintiffss Petition for Apointment of Board of View in the following particulars: 1. Denied in part. It is admitted that the Defendant, Township of Hampden (hereinafter. referred to as "Townships') has never filed a Declaration of Taking concerning the property described in Exhibit ,sA,s of t17e Petition. It is averred that the Township never installed any sewer lines under, through or over the property described in the said Exhibit s'Ass. Rather, Hampden Township Sewer Authority (hereinafter referred to as ssAuthorityss), a municipal corporation organized under the Municipality Authorities Act of 19~F5, Act of May Z, 1915, P.L. 382, 61 et seq., 53 P.S. 6301 et seq., which is a separate entity, independ- ens of and not the agent, servant or employee of Township, installed certain sewer lines on the property described on the said Exhibit ssAss. It is denied that any de facto taking ever occur-r~ed through the LAW OFFICES SNELBAKER, McCALE6 & EtICKER acts of Townslii_p or i.ts servants, agents or employees. The April 3, 1973 date referred to in Paragraph 1 is the date on which the Authority filed its Declaration of Taking with tl-ii_s Court to No. 494 May Term 1973, to acquire rights-of-way for the installation of sewer lines to service all of th.e areas colored yel_1ow on Exhibit ,sass of the Petition. 2. Denied in part. It is admitted that the Township is named . 1. w .. . Defendant i.n the Petition. It is further averred that no de facto taking by the Township ever occurred concerning the property described in the said Exhibit 11A" . 3. a. Denied in part. It :is admitted that on April 3, 1973 William B. Tenny and Shirley A. Tenny owned, as tenants by the entire- ties, the property which is colored yellow on the said Exhibit t'B'~. It is further averred that the areas colored green on the said Exhibit "B" were not owned by William B. Tenny and Shirley A. Tenny, or either of -them, on April 3, 1973 or any time thereafter. It is also averred that neither William B. Tenny nor Shirley A. Tenny has any interest at the present time in any of the property described in the said Exhibit 1' AiT 3. b. Denied. After reasonable investigation, the Township is without knowledge or information sufficient to form a belief as to whether a legal entity by the name of "Wm. B. Tenny, Builder and Develop er" exists and proof of its existence and interest in any of the prop- erty described in the said Exhibit flAr, is hereby demanded. 3. b. (l.) (a) through and including 3. b_ (1) (d) . Denied. The Township, after reasonable investigation, is without knowledge or information sufficient to form a belief as to the truth of the avermen and proof thereof is hereby demanded. ~i. Denied. Neither the Township nor any of its agents, employees or servants ever took, injured or destroyed any of the property described on the said Exhibit "A". 5. Denied. Neither the Township nor any of its agents, employee s or servants ever performed any acts wh:i_ch resulted i.rz a de facto con- demnation of any of the property described in the said Exhibit 14A" 5. a. through and including 5. c. The Township never altered any of the said property except in the following instance. The Township dial construct and install a portion. of the street known as -z- Willcliffe Drive, which portion is colored orange in the lower right or southeast corner of the said Exhibit r'B". That said street construction was proper and that the Township was entitled to reimbursement for the construction costs from William B. Tenny and Shirley A. Tenny were conclusively determined in this Court at No. 685 December. Term, 197[, which decision was affirmed by the Commonwealth Court of Pennsylvania at 32 Pa. Commonwealth Ct. 301, 379 A.Zd 635 (1977). 5. d_ (1). Denied. The Township never assessed benefits for any LAW OFFICES SNELBAKER. MCCALEB & ELICKER property described in the said Exhibit 'TA'r accruing from the construc- tion or extension of a sewer system. It is further_ averred that the Authority constructed sewer lines on portions of the property described in the said Exhibit "A". Pursuant to the aforesaid Declaration of Taking and a Petition for Appointment of a Board of View filed with this Court by the Authority to No. 494- May Term, 1973, a Board of View was appointed which assessed William B. Tenny and Shirley A. Tenny net benefits of X48,300.00 accruing, due to the installation of sewer lines to all of the property colored yellow on the said Exhibit "BT' except the two lots at the upper left or northwest corner of the said Exhibit "B". The said Board of View did not assess William B. Tenny or Shirley A. Tenny, or either of them, for benefits accruing to the lot which is '~ north on the said Exhibit "B'r, of Lot No. 104. Instead, the said Board', of View assessed net benefits of X1,480.00 for said lot against Nicholas and Delores Riccardi, who had purchased the lot subsequent to the filing of the said Delcaration of Taking and recorded their deed at Deed Book 26-}[, Page 117. Pursuant to the request of the Authority, Lot No. 104 on the said Exhibit r'Bf' was deleted from the proceedings at No. 494 May Term 1973, and the said Board of View did n.ot award damages or assess benefits for Lot No. 104. The said Board of View filed its report on October 24, 1978 at which time a decree nisi was entered confirming said report. Neither exceptions nor an appeal was filed to those proceedings. William A. Tenny and Shirley B. Tenny were assessed benefits of -3- _il X1,200.00 by the Authority, which used the front foot method, for I~en fits accruing to Lot No. 104 on the said Exhibit "B" Said assessmen assessment number 1947, was assessed on November 1.6, 1.973 and a munic~ claim therefor was filed in this Court to No. 16430 M.L.D. 1974. Sai municipal claim was marked satisfied on October 28, 1975. 5. d. (2). Denied in part. It is admitted that the Township pay an ordinance approving the extension of the sanitary sewer aver the property described in the said Exhibit "A'~. It is further averred tr neither the Township nor any of its agents, employE,s or servants evE assessed the Plaintiff, William B. Tenny or Shirle~B. Tenny for bene accruing to any of the property described in Exhikt "AT' by the const~ tion or extension of a sanitary sewer. It is further averred that the Township never concealed its interest in the said sewer system which is that of a lessee; the said sewer system is owned by the Authority. The Authority filed the aforesaid Declaration of Taking to No. ~I94 May Term, 1973 and :is the only party that assessed benefits for the said sewer system. The Township never assessed any benefits for the said sewer system. 10. Denied in part. This Petition was filed in contravention of_ Section 502 (e) of the Act of June 22, 1964, P.L. 84, 26 P.S. ~1-502 (e) which allows -the filing of a petition by a condemnee only where "there has been a compensable injury suffered and no declaration of taking therefor has been filed...." The t4injury" P lainti.ff claims to have suffered concerns the apporpriation of land by the Authority for the installation of sewer lines and a Declaration of Taking therefor was filed by the Authority as aforesaid to No. ~I-94 December Term 1.973. 11. The averments above in the response to Par. agraph 5. d. (1) of the Petition are incorporated herein by ref erence thereto. William B. Tenny and Shirley A. Tenny received the proper notices of the proceed- ings in the said No, 494 May Term, 1973. William B. Tenny and Shirley A. Tenny filed a so called i'Notice of Intention to File Preliminary Objections" to No. 494 May Term, 1.973 on November 26, 1975. To the extent that Plaintiff is proceeding here against the Township on the theory that the Authority acted as the Townsllipis agent, Plaintiff s present action is barred by res judicata since the issues raised here were already decided in the proceedings at No. 494 May T;~rm, 1973 for all but the lot in yellow in the northwest corner of the said Exhibit r'B~T The .res judicata defense applies to that lot also in that the aforesaid municipal claim filed for that assessment was paid and satisfied without contest. 12. The allegations in the Petition contest the validity of LAW OFFICES SNELBAKER, cCALEB & ELICKER various assessments for. benefits accruing as the result of sewer construction. Various procedural remedies are or were available to -5- contest those assessments. The filing of a petition for appointment of aboard of view is not a proper procedure under Section 502 of the Act of June 22, 1964, P.L. 84, 26 P.S. ~1-502 or by any other statute or law of this Commonwealth for contesting the validity of a benefit assessment. 13. Neither Plaintiff, if Plaintiff has any 1ega1 existence, nor William B. Tenny nor Shirley A. Tenny had any interest in the areas colored green on the said Exhibit 'T Bt` on or after April 3, 1973. Therefore, any portion of the Petition asserting a claim for the green areas should be dismissed. William A. Tenny and Shirley B. Tenny were assessed benefits of $1,200.00 by the Authority, which used the front foot method, for benefits accruing to Lot No. 104 on the said Exhibit "B". Said assess- ment, assessment number 1947, was assessed on November 16, 1973 and a municipal claim therefor was filed in this Court to No. 16430 M.L.D. 1974. Said municipal claim was marked satisfied on October 28, 1975. 5. d. (2). Denied in part. It is admitted that the Township passed an ordinance approving the extension of the sanitary sewer over the property described in the said Exhibit f'A"_ In further answer, neither the Township nor any of its agents, employees or servants ever assessed the Plaintiff, William B. Tenny or Shirley B. Tenny for bene- fits accruing to any of the property described in Exhibit "A'r by the construction or extension of a sanitary sewer. The "injury" Plaintiff claims to have suffered concerns the appropriation of land by the Authority for the installation of sewer Lines and a Declaration of Taking therefor was filed by the Authority as aforesaid to No. 491 December Term, 1973. Tenny received the proper notices of the proceedings docketed to No. ~+9~+ May Term, 1973. William B. Tenny and Shirley A. Tenny filed a so called `Notice of Intention to File Preliminary Objections`1 to No. 4-94 May Term, 1973 on November 26, 1975. To the extent that Plaintiff is proceeding here against the Township on the theory that the Authority acted as the Township's agent , Plaintiff`s present action is barred by res judicata since the issues raised here were already decided in the proceedings at No. 49~}- May Term, 1973, for all but the lot Ln yellow in the northwest corner of the said Exhibit "B'T. The res judicata defense applies to that lot also in that the aforesaid municipal claim filed for that assessment was pa.i.d and -5- satisfied without contest. 12. The allegations in the Petition contest the validity of various assessments for benefits accruing as the result of sewer construction. Various procedural remedies are or were available to contest those assessments. The filing of a petition for appointment of aboard of view is not a proper procedure under Section 502 of the Act of June 22, 1964, P.L. 84, 26 P.S. ~1-502 or by any other statute or law of this Commonwealth for contesting the validity of a benefit assessment. 13. Neither Plaintiff, if Plaintiff has any 1_egal existence, nor William B. Tenny nor Shirley A. Tenny had any .interest in the areas colored green on the said Exhibit TT BT, on or after April 3, 1973. There- fore any portion of the Petition asserting a claim for the green areas should be dismissed. TOWNSHIP OF HAMPDEN, No. 1384 Civil 1979, Action In Eminent Domain Dear Judge Sheely: On October 30, 1984, in Courtroom No. 1 good cause was shown why the above-referenced matter should not be dismissed pursuant to Pa. R.J.A. 1901 and C.C. Rule No. 1 of Judicial Administration. The matter involves a special statutory action in eminent domain providing procedure not generally regulated by the Pa. R.C.P.. The action was commenced upon petition for the appointment of a board of view. Instead of the court appointing a board of view as statutorilly provided, a rule to show cause was issued upon respondent Township of Hampden which then filed both preliminary objections against the petition and an answer to it. The respondent never listed its preliminary objections for argument, and the court never appointed a board of view. Construing the departure from the statutorily prescribed manner of procedure as changing the form of the action to one in - 1 - ~ ,. trespass, the petitioner filed a demand for a jury trial and preliminary objections to respondent's answer. Accordingly, the court should dismiss respondent Township of Hampden's preliminary objections as having been withdrawn upon the filing of its answer; treat the case as a trespass action; and list the petitioner's preliminary objections for agrument on the next available list instead of dismissing the Eminent Domain action against the petitioner who is in no way responsible for the delay that is harmless to begin with.
