SETTLEMENT AGREEMENT
THIS AGREEMENT, made this day of , 1986, by
and between CHARLES L. HOWE, hereinafter called Husband, and
JOHANNA HOWE, hereinafter called Wife;
WITNESSETH:
WHEREAS, Husband and Wife were lawfully married on
March 19, 1965; and
WHEREAS, differences have arisen between Husband and
Wife in consequence of which they have determined to live separate
and apart from each other and have consented to a mutual consent
divorce; and
WHEREAS, Husband and Wife desire to settle and determine
their rights and obligations.
NOW, THEREFORE, the parties, intending to be legally
bound hereby, agree as follows:
1. Separation. It shall be lawful for each party at
all times hereafter to live separate and apart from the other at
such place as he or she may from time to time choose or deem fit.
The foregoing provision shall not be taken as admission on the
part of either party of the lawfulness or unlawfulness of the
causes leading to them living apart.
2. Division of Personal Property. The parties have
divided between them to their mutual satisfaction the personal
effects, household furniture and furnishings, and all other
articles of personal property which have heretofore been used by
them in common, and neither will make any claim to any such items
which are now in possession or control of the other, except as
otherwise set forth herein. Parties agree to see that the autos
in their respective possessions are titled in their individual
names now or at such future time as requested.
3. Debts. Except for the debts and obligations created
hereunder, each party agrees to pay and hereby agrees to hold the
other harmless from any and all personal debts and obligations
incurred by him or her subsequent to the date of separation. If
any claim, action or proceeding is hereafter brought seeking to
hold the other party liable on account of such debts or
obligations, each party will at his or, her sole expense defend the
other party against any such claim, action or proceedings, whether
or not well-founded, and indemnify the other party against any
loss or liability resulting therefrom. Husband agrees to pay the
sum of $390 to Conrad M. Siegel, Inc., pursuant to the agreement
of the parties and Order of Court of July 21, 1986.
4. Waiver of Alimony. Each party hereby waives any
claim for alimony, support or counsel fees for themselves under
the Divorce Code of 1980 (Act 26 of 1980) and acknowledges
ownership of sufficient property to meet their reasonable needs.
5. Pension Plan. The husband has a pension through his
Pennsylvania government employment which is vested. The present
value of his pension averages $45,146.00 according to an
evaluation by Conrad M. Seigel, Inc., and the Husband had contri-
buted to that pension the sum of $18,934.70 when the parties
separated. The parties agree that in the event the Husband ceases
his employment and withdraws, pursuant to option 4, his SERS
contributions plus interest, that wife will receive her
proportionate share of that amount withdrawn in relation to one-
half the present SERS contributions plus interest or, as otherwise
stated, $9,411.62 plus interest as paid by the plan from February
1, 1986 to the date of withdrawal. In addition, Husband agrees to
assign to wife a percentage of his retirement benefits based upon
the length of the marriage in relation to the total time employed
by the Commonwealth multiplied by one-half of the benefit
payments. This is commonly referred to as the coverture fraction
and is calculated as follows:

6. Custody and Support. The parties agree that custody and
visitation of their minor child, David, shall provide for primary
physical custody in the Wife, with liberal partial custody in
Husband as the parties shall agree. Both parents acknowledge that
it is in the best interest of their child that he remain close, in
the familial sense, to both parents, and the parties shall confer
with each other on all important matters pertaining to the child's
health, welfare, education and maintenance, with a view toward
obtaining and following a harmonious policy. The parties agree
that the support for David shall be as determined through
proceedings in the Cumberland County Domestic Relations Office
and/or as ordered by a court of competent jurisdiction.
7. Equitable Property. This Agreement constitutes an
equitable division of the parties' marital property. The parties
have determined that the division of this property conforms to a
just and right standard, with due regard to the rights of each
party. The division of existing marital property is not intended
by the parties to constitute in any way a sale or exchange of
assets, and the division is being effectuated without the
introduction of outside funds or other property not constituting
the matrimcniul estate.
8. Release of All Claims. Each party, except as
otherwise provided for in this Agreement, releases the other from
all claims, liabilities, debts, obligations, actions and causes of
action of every kind that have been incurred, or may be incurred,
relating to or arising from the marriage between the parties.
However, neither party is relieved or discharged from any
obligations under this Agreement or under any instrument or
document executed pursuant to this Agreement.
9. Breach.
If either party breaches any provision
of this Agreement, the other party shall have the right, at his or
her election, to sue for damages for such breach, and seek any
other remedy allowed in law or equity. The party breaching this
contract shall be responsible for the payment of legal fees and
costs incurred by the other in enforcing his or her rights under
this Agreement, or seeking such other remedy or relief as may be
available to him or her. Waiver by one party of any breach of
this Agreement by the other party shall not be deemed a waiver of
any subsequent, similar breach or other breaches.
10. Full Disclosure. Husband and Wife each represent
and warrant to the other that he or she has made a full and
complete disclosure to the other of all assets of any nature
whatsoever in which such party has an interest, of the source and
amount of the income of such party of every type whatsoever and
all other facts relating to the subject matter of this Agreement.
11. Divorce. This Agreement shall not be construed to
affect or bar the right of either Husband or Wife to a true and
absolute divorce on legal and truthful grounds as they now exist
or may hereafter arise. It is understood, however, that Husband
as of the signing of this Agreement, has filed an action in
divorce in the Court of Common Pleas of Cumberland County, in
which he alleges that the marriage is irretrievably broken. Both
parties understand and agree that Husband shall continue to pursue
said divorce on the grounds that the marriage is irretrievably
broken, and that both parties will execute, deliver and file the
necessary affidavits and all other petitions or documents
necessary to effectuate the divorce pursuant to Section 201 (c) of
the Divorce Code. Wife agrees that the marriage is irretrievably
broken.
12. Representation of Parties by Counsel. Each party
has had the opportunity to have legal counsel to represent each of
them in the negotiation and preparation of this Agreement and has
either been so represented or has voluntarily chosen not to be
represented. Each party has carefully read this Agreement and is
completely aware, not only of its contents, but also of its legal
effect.
13. Additional Instruments. Each of the parties shall
on demand or within a reasonable period thereafter, execute and
deliver any and all other documents and do or cause to be done any
other act or thing that may be necessary or desirable to
effectuate the provisions and purposes of this Agreement. If
either party fails on demand to comply with the provision, that
party shall pay to the other all attorneys' fees, costs and other
expenses reasonably incurred as a result of such failure.
14. Modification and Waiver. Modification or waiver of
any provision of this Agreement shall be effective only if made in
writing and executed with the same formality as this Agreement.
The failure of either party to insist upon strict performance of
any of the provisions of this Agreement shall not be construed as
a waiver of any subsequent default of the same or similar nature.
15. Descriptive Headings. The descriptive headings
used herein are for convenience only. They shall have no effect
whatsoever in determining the rights or obligations of the
parties.
16. Successors and Assigns. This Agreement, except as
,otherwise expressly provided herein, shall be binding upon and
shall inure to the benefit of the respective legatees, devisees,
heirs, executors, administrators, assignees and successors in
interest to the parties.
17. Governing Law. This Agreement shall be governed by
and shall be construed in accordance with the laws of the
Commonwealth of Pennsylvania.
18. Order of Court. Agreement to be entered as an
Order when divorce is granted.

ADDENDUM TO PARAGRAPH 5
In the event the pension becomes assignable, Husband will assign said percent
of his retirement benefits to Wife.
If Husband dies prior to retirement, or if the pension vests and Husband dies,
Wife will receive a percentage of any death benefit payable to Husband's beneficiary
represented by the coverture fraction stated above.
In event Wife dies, any benefit payable to her under the terms of this agree-
ment shall become payable to Barbara Howe, Thomas Howe, Deiter Howe and David Howe,
in equal shares, as Wife's beneficiaries.

This letter is in response to your request for information relative to obtaining an approved
Domestic Relations Order ("DRO"). For your information, I am attaching a sample DRO.
The Commonwealth of Pennsylvania, State Employes' Retirement System ("SERB") is a
governmental plan administered by a Commonwealth agency for governmental
employees. Federal pension statutes and requirements contained in the Employee
Retirement Income Security Act ("FRIBA"), the Retirement Equity Act of 1984 and the
Internal Revenue Code regarding qualified domestic relations orders ("QDROs") and
spousal consent do not apply to SERB as a governmental plan. Unlike ERISA plans,
this means that in the absence of an appropriate court order, a member may take
any action with regard to his retirement benefits without any notice or consent
required from anyone, including his spouse.
Rather, any attachment of a member's SERB retirement benefits for purposes of
equitable distribution must be accomplished through the terms of an Approved Domestic
Relations Order ("ADRO"). Given the nature of your inquiry, I feel it necessary to inform
you of the prerequisites for approval by SERB of any Domestic Relations Order ("DRO").'
First, in no case can the DRO alter the SERB' benefit structure. The retirement options
available to members under the State Employes' Retirement Code, 71 Pa.C.S. § 5101 et
seq. ("Retirement Code") are exhaustive. All DROs must utilize the benefit structure as
established by the General Assembly. 71 Pa.C.S. §§ 5701-5710. Any substantive
changes to the benefit structure are outside the jurisdiction of the Courts of Common
Pleas as actions which directly affect the rights of SERB. Millick v. Millick, 140 Pa.
Commonwealth Ct. 252, 592 A.2d 788 (1991).
'The requirements for SERB' approval of a DRO are set forth in the following sections
of the State Employes' Retirement Code, 71 Pa.C.S. Section 5101 et sew.: Section 5102
(definitions of alternate payee, approved domestic relations order, domestic relations
order, irrevocable beneficiary and irrevocable survivor annuitant), Section 5705, Section
5953, Section 5953.1, Section 5953.2, Section 5953.3 and Section 5953.4.

Second, actions required of SERS must be clear and unambiguous within the four
corners of the DRO submitted. Information which generally should appear in the
document includes:
A. The coverture fraction, if any. That is, the portion of the retirement benefits
attributable to the marriage. This statement must include the actual dates
(month, day, year) of the measuring period.
B. The marital share of the retirement monies. This figure may be expressed
in either a percentage or dollar amount.
C. The benefit to be split. In the DRO, the actual retirement benefit option plan
to be attached should be identified as it is described under the Retirement
Code (e.g. Maximum Single Life Annuity, Option 1, etc.). If the benefit to be
split is not identified in the DRO then the member spouse is free to select
any retirement option available at retirement, which could have the effect of
reducing the payout to the non-member spouse. Further, absence of
specificity may render the DRO vague and unenforceable and may subject
the parties to further litigation.as to how distribution should occur.
Third, the address of the non-member spouse must appear in the DRO and that spouse
must maintain a current address on file with SERS. The duty of the non-member spouse
to so maintain an address must appear in the document. Payments under an acceptable
DRO will be made separately to the non-member spouse or his/her estate, if applicable.
Fourth, any and all tax liability attaches to monies as disbursed. IRS Form 1099's will
follow the money. The parties are free to .allocate tax liability as they wish outside the
parameters of the retirement benefits in question. Consistent with the fiduciary duty of
SERS to its members, any non-taxable benefits shall be paid solely to the member
spouse to the extent possible in the absence of language in the DRO to the contrary.
Fifth, the rights of non-member spouses are entirely derivative of the member spouse's
rights. To that end, non-member spouses may not elect beneficiaries, choose benefits,
etc. Full satisfaction of the non-member spouse's claim to retirement benefits must occur
via judicial compulsion of the member spouse by the terms of an acceptable DRO. It is
possible, however, to draft a paragraph which directs the member spouse to select a
particular retirement option. The option selected is a choice to be made by the parties.
Sixth, the DRO should contain statements that the member spouse will execute an
authorization in order to enable the non-member spouse to monitor compliance as well as
to obtain information concerning retirement benefit valuation.

Seventh, the "present value" indicated on some SERS benefits statements is a statutorily
defined term which may be at variance with other commonly accepted definitions of
present value. The term as used in the benefits statements and the Retirement Code
does accurately show the available Option 1 death benefit but may not reflect current
market indications of the value of the future stream of income from a member's retirement
benefits. For example, SERS must use the statutorily mandated interest rate of 4% when
calculating present value. 71 Pa. C.S. § 5102 (definition of statutory interest).
Please be advised that--where the DRO provides that the non-member spouse is
entitled to a marital portion of any death benefit payable-the DRO must nominate
the non-member spouse as an irrevocable beneficiary accordingly.2
Finally, the parties to the divorce should be aware that failure by those parties. to perform
actions required by the terms of a DRO may lead to initiation of a contempt action by
either party against the nonconforming party. A sample DRO is enclosed for your
consideration in drafting an appropriate order. We are willing to review a draft order

8. Member's retirement benefit is defined as all monies paid to or on behalf of
Member by SERS, including any lump sum withdrawals or scheduled or ad hoc
increases, but excluding the disability portion of any disability annuities paid to Member
by SERS or any deferred compensation benefits paid to Member by SERS. The
equitable distribution portion of the marital property component of Member's retirement
benefit, as set forth in Paragraph Seven (7), shall be payable to Alternate Payee and shall
commence as soon as administratively feasible on or about the date the Member actually
enters pay status and SERS approves a Domestic Relations Order incorporating this
Stipulation and Agreement, whichever is later.
9. Member hereby nominates Alternate Payee as an irrevocable beneficiary to
the extent of Alternate Payee's equitable distribution portion of Member's retirement
benefit for any death benefits payable by SERS. This nomination shall become effective
upon approval by the Secretary of the Retirement Board, or his authorized representative,
of any Domestic Relations Order incorporating this Stipulation and Agreement. The
balance of any death benefit remaining after the allocation of Alternate Payee's equitable
distribution portion ("Balance") shall be paid to the beneficiaries named by Member on the
last Nomination of Beneficiaries Form filed with the Retirement Board prior to Member's
death.

a. If the last Nomination of Beneficiaries Form filed by Member prior to
Member's death (a) predates any approved Domestic Relations Order incorporating this
Stipulation and Agreement, and (b) names Alternate Payee as a beneficiary, then: (1) the
terms of the Domestic Relations Order shall alone govern Alternate Payee's share of any
death benefit, and (2) for purposes of paying the Balance via the last Nomination of
Beneficiaries Form filed with the Retirement Board prior to Member's death, Altemate
Payee shall be treated as if Alternate Payee predeceased Member. No portion of the
Balance shall be payable to Alternate Payee's estate.
b. In addition, Member shall execute and deliver to Alternate Payee an
authorization, in a form acceptable to SERS, which will authorize SERS to release to
Alternate Payee all relevant information concerning Member's retirement account.
Alternate Payee shall deliver the authorization to SERS which will allow the Alternate
Payee to check that she has been and continues to be properly nominated under this
paragraph.
10. The term and amounts of Member's retirement benefits payable to the
Alternate Payee after SERS approves a Domestic Relations Order
incorporating this Stipulation and Agreement is dependent upon which
option(s) is (are) selected by Member upon retirement. Member and Alternate
Payee expressly agree that: [pick one]

(a) Member may select any retirement option offered by SERS under
the Retirement Code at the time Member files an Application for Retirement Allowance
with SERS.

(b) Member shall select the following retirement option(s) upon filing an
Application for Retirement Allowance with SERS4:

joint and equitable distribution annuity, e.g.:
Special Option 4.--A joint and equitable distribution percent [or
portion] (as defined in paragraph 7) annuity payable during the
lifetime of the Member with an equitable distribution percent [or
portion] (as defined in paragraph 7} of such annuity payable
thereafter to his survivor annuitant, if living at his death, as set forth
in 71 Pa.C.S. Section 5705(a)(4), or any succeeding statute.
The Member shall designate the Alternate Payee as his irrevocable survivor annuitant.
The intent of this Special Option 4 selection is to maintain levelized payments to the
Alternate Payee for her life in the event of Member's death after retirement. The Altemate
Payee shall receive her equitable distribution percentage [or portion] of the annuity which
is payable to the Member during his lifetime, so that she shall receive a percentage [or
portion] of the Member's check during his lifetime and the same amount, all other things
being equal, if he predeceases her after retirement. The Alternate Payee acknowledges
that if the Alternate Payee predeceases the Member after retirement then under this
Special Option 4 selection no benefits are payable to the Alternate Payee's estate. The
Alternate Payee may not exercise any right, privilege or option offered by SERS. SERS
shall issue individual tax forms to the Member and the Alternate Payee for amounts paid
to each person.
11. Alternate Payee may not exercise any right, privilege or option offered by
SERS. SERS shall issue individual tax forms to Member and Altemate Payee for
amounts paid to each.
12. In the event of the death of Alternate Payee prior to receipt of all of her
payments payable to her from SERS under this Order, any death benefit or retirement
benefit payable to Altemate Payee by SERS shall: [pick one]
(a) Be paid to Alternate Payee's Estate to the extent of Alternate
Payee's equitable distribution portion of Member's retirement benefit as set forth in
Paragraphs Seven through Nine.
OR
(b) Revert to Member.
13. In no event shall Alternate Payee have greater benefits or rights other than
those which are available to Member. Altemate Payee is not entitled to any benefit not
otherwise provided by SERS. The Alternate Payee is only entitled to the specific benefits
offered by SERS as provided in this Order. All other rights, privileges and options offered
by SERS not granted to Alternate Payee by this Order are preserved for Member.
14. It is specifically intended and agreed by the parties hereto that this Order:
(a) Does not require SERS to provide any type of benefit, or any option, not
otherwise provided under the Retirement Code;
(b) Does not require SERS to provide increased benefits (determined on the
basis of actuarial value) unless increased benefits are paid to Member based upon cost
of living or increases based on other than actuarial values.
15. The parties intend and agree that the terms of this Stipulation and Agreement
shall be approved, adopted and entered as a Domestic Relations Order.
16. The Court of Common Pleas of County,
Pennsylvania, shall retain jurisdiction to amend any Domestic Relations Order
incorporating this Stipulation and Agreement, but only for the purpose of establishing it or
maintaining it as a Domestic Relations Order; provided, however, that no such
amendment shall require SERS to provide any type or form of benefit, or any option not
otherwise provided by SERS, and further provided that no such amendment or right of the
Court to so amend will invalidate this existing Order.
17. Upon entry as a Domestic Relations Order, a certified copy of the Domestic
Relations Order and this Stipulation and Agreement and any attendant documents shall
be served upon SERS immediately. The Domestic Relations Order shall take effect
immediately upon SERS approval and SERS approval of any attendant documents and
then shall remain in effect until further Order of Court.
