CUSTODY STIPULATION AND AGREEMENT
THIS STIPULATION AND AGREEMENT entered into the day and year
hereinafter set forth, by and between the above-named parties, TAMMY' K. HOY-
McCLURE, Plaintiff; (hereinafter referred to as "Mother") and GARY E. BUCHER,
Defendant, (hereinafter referred to as "Father"}.
WHEREAS, the parties are the natural parents of JENNIFER LYNN BUCHER,
born Apri120, 1983 (hereinafter referred to as the "Child"), and
WHEREAS, the parties are divorced and living separate and apart; and.
WHEREAS, the child has resided for at least the past 11 years in Cumberland
County, Pennsylvania; thus, vesting jurisdiction over the issue of custody in the Court of
Common Pleas of Cumberland County; and
WHEREAS, the parties wish to enter into a comprehensive Custody Stipulation
and Agreement modifying their prior agreements in this matter and prior Agreements and
Orders in this matter relative to physical and legal custody of the child; and
WHEREAS, the parties wish to have the within Stipulation and Agreement entered
as an Order of Court in this matter.
NOW, THEREFORE, in consideration of the mutual covenants, promises and
agreements as hereinafter set forth, the parties agree as follows:
1. The parties shall have shared or joint legal custody of the child.
2. Mother shall have primary physical custody of the child.
3. Father shall have periods of temporary or partial physical custody of the child
every other weekend from Friday evening between 4:00 and 6:00 p.m. when he
shall pick the child up at Mother's residence until Sunday everting at 6:00 p.m.
when he shall deliver the child to Mother's residence. These every other
weekend periods of temporary physical custody began on January 30, 1998
and shall continue for alternating weeks thereafter.
4. During the Christmas holiday season, the child shall always be in Mother's
physical custody from the last day of school before Christmas break until 1:30
p.m. on Christmas Day and shall always be with Father from 1:30 p.m. on
Christmas Day until 6:00 p.m. on the last day of the Christmas break before
school begins the next day.
5. During the Thanksgiving holiday season, the child shall always be with Mother
from the beginning of the Thanksgiving school break until 3:00 p.m. on
Thanksgiving Day and shall always be with Father from 3:00 p.m. on
Thanksgiving Day until 6:00 p.m. on last day of Thanksgiving break before
school begins the next day.
6. The parties will attempt to mutually agree upon other periods of time when the
child shall be in Father's physical custody with the desires of the child being
taken into consideration for these additional periods of time.
7. The parties acknowledge that the child has been engaged in family counseling
with Father and the Father's wife at the Stevens Mental Health Center. Mother
will see that the child is transported to the bi-weekly family counseling sessions
at Stevens Mental Health Center and will continue to do so as long as the
child's involvement is deemed necessary by the counselor at Stevens Mental
Health Center, with the counselor's determination that the child. no longer
needs to be involved in the counseling being communicated, in writing, to both
parties' counsel. In the event Mother is not able to transport the child for the
family counseling sessions, Mother must notify Father by no later than one
hour before the session is to begin so that Father can make arrangements to
transport the child to the session and return the child to Mother following the
session.
8. The parties wish to have this Stipulation and Agreement entered as an Order of
Court vacating all prior Orders in this matter.
9. The parties will keep each other advised immediately in the event of serious
illness or medical emergency concerning the child and shall further take any
necessary steps to ensure that the health and well being of the child is
protected. During such illness or medical emergency, both parties shall have
the right to visit the child as often as he or she desires consistent with the
proper medical care of the children.
10. Neither parent nor any family member shall do anything which may estrange
the child from the other party, or injure the opinion of the child as to the other
party, or which may hamper the free and natural development of the child's
love or affection for the other party.
11. Any modification or waiver of any of the provisions of this Agreement shall be
effective only if made in writing and only if executed with the same formality as
this Stipulation and Agreement.
12. The parties agree that in making this Agreement, there has been no fraud,
concealment, overreaching, coercion, or other unfair dealing on the part of the
other.
13. The parties acknowledge that they have read and understand the provisions of
this Agreement. Each party acknowledges that the Agreement is fair and
equitable and that it is not the result of any duress or undue influence.

CUSTODY CONCILIATION CONFERENCE SUMMARY REPORT
IN ACCORDANCE WITH CUMBERLAND COUNTY RULE OF CIVIL
PROCEDURE 1915.3-8(b), the undersigned Custody Conciliator submits the following report:
1. The pertinent information concerning the child(ren) who is(are) the subject of this
litigation is as follows:

2. A Conciliation Conference was held on August 27, 1997, and the following
individuals were present: the Plaintiff and her attorney, Bradley L. Griffie, Esquire; the
Defendant appeared with his attorney, Teresa R. McCormack, Esquire.
3. Items resolved by agreement: None.
4. Issues yet to be resolved: An ultimate custody schedule.
5. The Plaintiff s position on custody is as follows: Plaintiff indicated that the parties'
youngest child, Jennifer, who is 14 years old, who is the only subject of this custody hearing,
wants to move with her mother. Plaintiff says that she has expressed a strong desire to live with
her because she does not get along with Father's paramour which is compounded by the fact that
Father travels regularly and that she is alone with the paramour herself. In addition, her oldest
sister is apparently going to go into the military next year and therefore she will be there in the
house by herself.
6. The Defendant's position on custody is as follows: Defendant says that the custody
order has been working fine and that the child has not expressed any strong desire to him to
move to the Mother's house. He believes that if the child does want to leave, it is because that
Mother has less restrictive rules than he does. Furthermore, he does not believe that the child
should be removed from the current school district which she has been in all of her life to the
Middletown School District.
7. Need for separate counsel to represent child(ren): Neither party requested.
8. Need for independent psychological evaluation or counseling: None requested and the
Conciliator does not believe any is necessary.
9. A hearing in this matter will take two hours.
10. Other matters or comments: This is a case involving a 14 year old child who has
been in the primary custody of her Father for her entire life. It is incumbent upon the Mother to
show why that custodial situation should be changed. If the daughter truly expresses a strong
desire to move in with her Mother, the court will have to ascertain if she has legitimate reasons
for wanting to make the move and if those reasons are legitimate if they are truly in her best
interest. The move will involve a significant change for her, not only in the fact that she has
resided with her Father primarily all of her life, but also it will entail a completely different
school district and subsequent change of friends and social surroundings. The court should note
that there is a previous Order in this case which it had entered in 1990 affirming the custodial
situation with Father.

The record in the above-captioned action will reflect that we continued this case
from a hearing that was scheduled for December 3, 1997 based upon the parties and
counsels' understanding that we had reached an agreement. To date we have not been
able to formalize this agreement and my client and I are concerned that this matter will
continue to linger without resolution. Therefore I respectfully ask that the court
reschedule this matter for cone-half day hearing as the court calendar allows.

We in fact have reached a final agreement in the above-captioned action and,
therefore, the hearing scheduled for December 3, 1997 will not be necessary.. While we
have not yet been able to process the final written agreement which will be signed by both
parties, we anticipate that that will be able to be concluded in the immediate future.

Bucher shall be joint legal custody shared between the mother and the father.
Physical custody of the girls shall be with their father and temporary custody sh

AND NOW, this 15th day of March, 1990, following a hearing on mother's petition seeking
a change in this court's order of August 30, 1984, it is ordered that:
1. This court's order of August 30, 1984, is vacated,
2. Except as provided in paragraphs 5 and 6 hereinafter, physica'. custody of Jessica
Bucher, born August 28, 1979, and Jennifer Bucher, born May 20, 1983, shall be with their fath

3. During this period the Mother, Tammy Kaye Hoy, shall have temporary physical custody
of Jessica and Jennifer every other weekend from Friday evening at 5:00 p.m. through Sunday
evening at 8:00 p.m. If a Monday holiday falls on any of these weekends, the period shall be
extended until 8:00 p.m. on that Monday.
4. The parties shall split Thanksgiving Day each year and they shall alternate each
year on Christmas Eve and Christmas Day on the schedule they have been following.
5. Each year from the first Saturday after the end of the school year until the second
Saturday before the start of the next school year, physical custody of Jessica and Jennifer
shall be with their mother.
6. During this period, the father shall have temporary physical custody of Jessica and
Jennifer for up to two weeks, either together or separate, during any period of time that he
is on vacation. The father shall provide the mother with notice of theses periods not later
than the date in which the children begin to live with their mother on the first Saturday
after the end of the school year.
