FREY, Respondent PETITIONER'S MOTION IN LIMINE AND NOW comes the Petitioner, ALICE R. PHILLIPS, by and through her attorneys, JAMES, SMITH, DIETTERICK AND CONNELLY, LLP, and moves this court in limine for an Order prohibiting the Respondents from invoking the Dead Man's Statute as codified in Statute as codified in 42 Pa. C.S.A. 5930 and thereby precluding the Petitioner from introducing or offering any testimony as to the fraud in the inducement, failure to disclose, and duress as more fully set forth in the Petition to Set Aside. 1. On or about August 21, 2006, Petitioner, surviving spouse of Linwood B. Phillips, Jr., deceased, filed a Petition to Set Aside Prenuptial Agreement (the "Petition to Set Aside"). 2. On or about August 28,2006, the Honorable C. Joseph Rehkamp entered a Rule to Show Cause on the Respondent directing him to plead and show cause, if any he has, why the J (") 1 co -0 -- -- ~ W N Court should not enter an Order setting aside the Prenuptial Agreement. 3. On or about September 13, 2006, the Respondent filed Preliminary Objections to the Petition to Set Aside. 4. Shortly thereafter, Petitioner filed a Motion to Strike the Respondent's Preliminary Objections whereby the Respondent invoked the Dead Man's Statute as barring any testimony of the Petitioner. 5. After various conferences with this Honorable Court, the Petitioner discerned that the Respondent hired a private investigator, namely Gerald Henneman of III Fairway Drive, Carlisle, Pennsylvania, 17013 (herein "Henneman"), to follow and discover information on the Petitioner for the periods of June 22, 2006 until August 25, 2006. 6. Petitioner observed and confronted Henneman, who, without limitation intended, followed the Petitioner into restaurants, and invaded her privacy and personal space. 7. Petitioner issued interrogatories to the Respondent to discern the breadth of Henneman's actions. 8. After a conference with the court, the Respondent agreed to answer the interrogatories as further reflected in the attached Exhibit "A" which include Henneman's notes. 9. Petitioner avers the actions of the private investigator are discovery and thereby a waiver of the Respondent's right, if any, to invoke the Dead Man's Statute. 10. Respondent avers that the Petitioner is an "Incompetent Witness" and thereby precluded from offering any testimony, including without limitation, any testimony that purports to provide evidence of the undue influence and manipulation in the execution of the Prenuptial Agreement by and between the Decedent and the Petitioner as further set forth in the Petition to Set Aside. 11. The Dead Man's Statute provides in relevant part: Except as otherwise provided in this subchapter, in any civil action or proceeding, where any party to a thing or contract in action is dead, or has been adjudged a lunatic and his right thereto or therein has passed, either by his own act or by the act of the law, to a party on the record who represents his interest in the subject in controversy, neither any surviving or remaining party to such thing or contract, nor any other person whose interest shall be adverse to the said right of such deceased or lunatic party, shall be a competent witness to any matter occurring before the death. . .. 12. In order for a witness to be competent, the witness's interest must be adverse to the decedent as set forth in In re Gelb's Estate, whereby the Supreme Court stated, "In order to be adverse the interest must be one from which the witness will gain or lose as the direct legal application and effect of the judgment." In re Gelb's Estate, 425 Pa 117, 121,228 A.2d 367, 369 (1967). See also Gibbs v. Herman, 714 A.2d 432 (1998). 13. Petitioner avers the actions by the Respondent in the engagement of Henneman waive the Estate's right to invoke the Dead Man's Statute as further set forth in the Brief in Support of Motion in Limine filed within ten days of the submission of this Motion. 14. Furthermore, Petitioner avers that the Dead Man's Statute is not applicable in that PEF Code 9 2209 provides a person who is the surviving spouse shall be a competent witness as to all matters pertinent to his rights under this chapter other than the creation of his status as the surviving spouse (spouse's elective share rights other than in the creation of his status as the surviving spouse). 3 15. Petitioner is a surviving spouse and is seeking to establish her rights in the execution of the Prenuptial Agreement. WHEREFORE, Petitioner respectfully requests that the Respondent be precluded from introducing or making reference to, in any way, the Dead Man's Statute, from an evidentiary standpoint, which purports to preclude the Petitioner from providing testimony as to the fraud in the inducement, failure to disclose, and duress as more fully set forth in the Petition to Set Aside. George Faller from MDW&O of Carlisle, Pa. Information is to be obtained into the background of Alice. R. Phillips (AKA: Alice R. Mountz - Alice R. Mirabito - Alice R. Peel - Alice R. Schrempf) 06-22-06 After consultation with Mr. Faller, this investigator went to the Cumberland County Court House, offices of Prothonotary, Clerk of Courts, Marriage Licenses and Recorder of Deeds to obtain the following information. Alice R. (Mountz) Phillips has the following record documented in Cumberland County Court against her Case # 1996-02575 for Sears. Plaintiff Owing $1929.50 - D/J Judgement Case # 1999-04601 for Crista Malone Plaintiff "Failure to Answer" Owing $5498.18 Judgement against her (Mountz) and A & J Toy Poodles for $1700.00 Case # 1999-295.0 1st Resolution Investment Corp. Plaintifft Arbitrators appointed and settled) 13t Resolution Investment Corp. is an Accounts Recievable Company Believed to be a collection agency. Case 1999-03842 for Wm. P. Crisp Jr. Plaintiff(Discontinued) Numerous charges have been filed against Alice R. (Mountz) Phillips's son, Harold Mirabito and grandson, Harold C. Mirabito Jr. This investigator contacted Attorney Hubert X. Gilroy who represents Alice Phillips Step-daughter Linda Stull and was given Mrs. Stull's contact information. This investigator traveled to Mrs. Stull's residence and interviewed her. Mrs. Stull advised that her father Linwood B. Phillips Jr. owned his own Realty Company for many years and she has heard that the first time Mr. Phillips met Alice was when she went to his office looking for a realtor's job and he did not hire her. Some time after that he had placed an add in the newspaper requesting someone to care for him and his home during convelesance. He met Alice Mountz when she showed up for the listing but did not recall having previously ever seen her. Mrs. Stull also advised that Alice said that she had lived in New Hampshire where she was a realtor. Alice has one Son named Harold C. Mirabito, and 2 daughters Dawn Marei Hamel (Hammel) and Paula George. When her father Linwood married Alice she lived at 899 Emily Dr. Mechanicsburg, Pa. and believes that she had previously lived in Chaple.HiIl area of Carlisle. Prior to that she was married to a Mountz who worked in a local crystal plant. Mrs. Stull produced a copy of HENNEMAN'S PRIVATE INVESTIGATION 1 I 1 FAIRWAY DRIVE CARLISLE, PENNSYLVANIA 17013-9365 (717) 258-0700 Alice R. Phillips driver's license and a copy of Linwood and Alice's Pre-nuptial agreement and Linwood's will for this investigator to look at. Mrs. Stull advised that several persons worked for her father including the following: Lois Alston, Secretary ; Joe ICkes and Ken Blosser, laborers and a Ruth Brown who lives on the Phillips property in an apartment. Although Mrs. Stull believes that Alice was previously estranged from her'one daughter the daughter and son-in-law are now living with Alice along with Alice's grandson Charles Mirabito Jr. Who just this date got out of prison. This investigator left and returned to the office where the Pre-nuptial and will were read. During the reading of the Pre-nuptial it was found that Alice claims her Date of Birth as 12-11-35 and on her Pennsylvania Operators License she lists her DOB: 11-11-39. There is an obvious difference here. 06-23-06 Mrs. Stull called and advised that Alice had lived with her husband Mountz in the area of Acre and Maple St. or Acre and Oak St. She will attempt to find out. She also supplied the Social Security Numbers of Alice and her son Harold Charles ~ This investigator contacted the new Hampshire Real Estate Commission and found that they have no listed realtor's license for Alice, however they do have a listing for a Maribito which is Alice's son's name. The listing is Paul 1. Mirabito of Newton , N.H. The license# 003308, has lapsed and he was listed under a Realtor named Robert McAvoy, 67 Smith Comers, Newton, N.H. 03858 (Phone 603-898-7001) also listed as P.G. Box 713 Salem N.H. (Phone 603-930-6769). This investigator then called Robert McAvoy at the Salem, N.H. address and he answered the phone. After efforts to recall the name Mirabito, Mr. McAvoy stated that numerous persons will, on occasion ask if they can use his name for a realty sale and he grants the request. As he recalls Paul Mirabito had done that. As he thought about it he believed that Mirabito now works for the "Butcher Boy" Meat plant in North Andover, Mass. This investigator contacted "Butcher Boy" North Andover, Mass and spoke to the owner who stated that Paul Mirabito does work there. A message was left for Mr. Mirabito to recall this investigator. Mrs. Stull called and stated that she found out that Alice was married to a John Mountz. Mrs. Stull also stated that prior to her father's death Dr. Lester 1. Himmelreich made a house visit to her father stating that a pharmacist contacted his office about one of his Perceset drug refills which was altered from the 40 that he wrote out to 140. Shortly thereafter Alice seemed scared and allowed Mrs. Stull to accompany her to check and destroy prescriptions. During that check Mrs. Stull states that she and Alice cleared out a waste basket more that full of bottles of pills and loose pills in a dresser drawer. Alice HENNEMAN'S PRIVATE INVESTIGATION 111 FAIRWAY DRIVE CARLISLE, PENNSYLVANIA] 7013-9365 (717) 258-0700 attempted to make excuses about the drugs. A check was made with the Cumberland County Recorder of Deeds and it was found that in the year 2000 Linwood Phillips bought Alice Mountz Property at 899 Emily Dr. Mechanicsburg, Pa. A check was made with the Massachusetts Association of Realtors and found that Alice R. Mountz was licensed there with License # 9475 which was issued 01-01-65 and expired 12-11-99. She carried a last known address of Mechanicsburg, Pa. It has been determined through Mrs. Stull that her father paid Alice's bills including her legal problems (previously) listed and purchasing the Emily Dr. residence to keep her out of financial problems just prior to their marriage. A check of the phone book showed a John Mountz at 401 Forge Rd. Boiling Springs, Pa. This investigator traveled to 401 Forge Rd. Boiling Springs and found no-one at home. A check with neighbors showed that Mountz had moved. A check was made with the Boiling Springs Post Office. It was found that Mountz moved very recently to 3514 Ritner Hwy. which the Post Office personnel stated was Carlisle, Pa. This investigator traveled to 3514 Ritner Hwy. which is Newville, Pa 17241 and interviewed John W. Mountz and his daughter with whom he lives along with her family and his wife. Mr. Mountz is not in the best of health and is some what forgetful as to details, however, his daughter helped fill in some of the date's details. They state that Mr. Mountz met Alice Mirabito in a bar located in New Hampshire around 1979-1980 when he worked for Western Electric Co. He divorced his wife and married Alice in 1981. Alice was previously married to Paul Mirabito and she blamed the divorce on him and all their problems. While John Mountz was married to Alice, she ran up a lot of credit card and other bills. She would open up credit cards in her name and not pay. Then he would receive bills and couldn't pay them. They lived on Lynn Dr. in Carlisle, Pa and he left her because of the bills. Alice didn't believe he would leave. Through the divorce (1990) Mr. Mountz states that Alice got the house and had to pay him $32,000.00 and all the bills she had made. She lost the house and he only knows that she remarried Linwood Phillips. He believes she married him for his money. Mr. Mountz remarried his first wife who he now is married to. 06-30-06 This investigator traveled to Carlisle, Pa and interviewed the following persons: Kenneth Blosser W-M-74 473 Wolfs Bridge Rd, Carlisle, Pa. Stated that he had known Linwood Phillips for 40-45 years and worked for him for 25-30 years. After Mr. Phillips wife Lucy died, he advertised for someone to stay at nights. Alice answered the ad and a couple weeks later Mr. Phillips told him that he was going to get married to Alice. Mr. Blosser stated that she (Alice) knew what she was doing. She wanted it all. She was too good to associate with the workers but not Linwood. Mr. Phillips spoke to Mr. Blosser one day and ask him his opinion about her (Alice). Mr. Blosser states "I told him that he'd be better off buying a good dog". Mr. Phillips left and he (Blosser) didn't see him for the rest of the day. A couple weeks later they got married. HENNEMAN'S PRIVATE INVESTIGA nON III FAIRWAY DRIVE CARLISLE, PENNSYL VANIA 17013-9365 (717) 258-0700 Joseph Ickes W -M-62, 1032 Greenspring Rd, Newville, Pa 17241. Stated that he worked for Linwood Phillips since 199] (15Yrs). At this point Linda (Mrs. Stull) is their boss. They take care of General Maintenance on the properties owned by Linwood Phillips. There are three workers, him, Blosser and Walter A (Alan) Phillips, son of Linwood. They always took their orders from Linwood and would go Lo his house every morning for their schedule. They walked in one morning and Alice was there. He didn't know why. He found out that she answered an ad to stay over nights. As far as he knows she didn't bring anything with her. He (Linwood) supplied her with everything. She had an old van and some dogs (Poodles) He believes that was 5-6 years ago. Linwood changed quite a bit when she (Alice) showed up. If she wanted something and he said "No" she would pout and she would get it. "We would go there in the mornings and he would sit there and sleep. He would raise up and say a few words and then nod off again. Other times he would be fine. Alice's son and grandson are living there with her. He heard that he daughter and son-in-law are there now too. Alan Phillips W-M-52 65 W. Big Spring Ave, Newville, Pa. Son of Mr. Phillips Stated that his dad put an ad in the newspaper for help and Alice answered the ad. She was from Mechanicsburg, Pa and drove between the two places for a short time and then moved in because his dad needed more help. Alan states "All it is to me is, she's (Alice) is trying to get everything she can get. Sue Henry was secretary and laid his dad's pills out. He was given his medications. His Doctor's changed it all the time so I don't know what he was taking. Alice took a lot of medication too. I wish everyone the best. I don't want anything. Just to be left alone. If they were to try something with me the way I hear they have done to my family, 1'd have to deal with it differently. I wouldn't take being shot at or tried to be run over". Another check was made at Cumberland County Court House and this time a check was made for A & J Toy Poodles which Alice was owner or part owner. It was found that there were four plaintiffs who filed charges against them. The following were those listed plaintiffs. Norman L. MuIIinix Jr. Anthony Ciavarella Christa Malone William P. Crisp Jr. An attempt to locate these plaintiffs at this time proved negative. 07-03-06 This investigator called the "Butcher Boy" in North Andover, Mass. And ask for Paul Mirabito. A male answered the phone stating he was Paul Mirabito. Investigator identified himself and ask a few questions. Mr. Mirabito states that He was married to Alice and they had one daughter (Paula). Alice had a son Harold prior to their marriage by a man with the last name of Pee I. Alice also had a daughter by the name of Donna. He liENNEMAN' S PRIVATE lNVESTIGA nON 111 FAIRWAY DRIVE CARLISLE, PENNSYLVANIA 17013-9365 (717) 258-0700 hasn't seen her in 25 years and couldn't continue the intervie\v because he was at work. He did furnish his phone number as 978-887-526] and stated he lived in Boxford. He did state "1 pity the poor guy who marries her". (Alice) Mr. Mirabito did not give the state he lived in so this investigator checked Boxford and found it to be located in Massachusetts. An address of 13 Stage Coach Rd. with the phone number that Mr. Mirabito gave this investigator was found. It was also learned that he lives with an A vis Mirabito, probably his wife. 07 -04-06 This investigator called Paul Mirabito. It was immediately determined that Mr. Mirabito had become defensive about the reason for the call. It is believed that he evidently has been in touch with someone from the family. His first question was "Did I tell you anything bad about Alice"? , and "How is this information going to be used"? When advised that this investigator only wanted the truth, he still was evasive in his answers saying that he didn't know or couldn't remember. He also stated that if ask he would not honor a subpoena. He did say that he was married to Alice for about 15 yrs. but couldn't recall the dates of marriage or divorce. He gave her maiden name as "Shrimp". He stated that she was married to a "Peel" before him but couldn't remember his first name and didn't know where he lived. When ask on 07-03-06 Mr. Mirabito had said that he thought Peel was from Haverhill, Mass. An attempt was made to contact "Peel" families in Mass. One contacted but did not know of an Alice R; however, she did furnish another name and number for a possible contact. A message was left at that number. The name Shrimp was looked up with no results in Mass. or New Hampshire. There are Shrimp families in Pennsylvania. The first one contacted did not know of any Alice. 07-05-06 This investigator attempted again to find the name Shrimp and make calls to New Hampshire with negative results. Investigator then traveled to the Cumberland County Courthouse and found the Marriage License for Linwood Phillips and Alice Mountz. It was discovered that their Marriage License # 867 (Record # 2000-0867) was issued 09-18-2000 with the marriage on 10-06-2000. It also showed that Alice divorced John Mountz 12-19-95 as a No-Fault # 157] Civil 1990. Her maiden name was listed as "SCHREMPF". Her father was listed as Harold Lingly Schrempf and mother as Velma Huff Schrempf (Mothers maiden name was Hawkes. Alice's date of birth was listed as 12-11-39., which does not correspond with her Pa. Opr. Lie. which gives her date of birth as 11-11-39 nor the pre-nuptial of 11-11-35. She was born in Newberryport, Mass. according to the license. With the information this investigator then checked records in Mass and found the name Schrempf listed. This investigator then called a listed Albert Schrempf who had trouble hearing but stated that Alice was his niece. He did advise that she had been hENNEMAN'S PRIVATE INVESTIGATION 111 FAIRWAY DRIVE CARLISLE, PENNSYL VANIA 17013-9365 (717) 258-0700 married to a Peel. He thought his name was Jimmy. He suggested that his sister Marion be called due her being able to hear and understand better. He furnished Marion's phone number. This investigator called Marion (Aunt) who was very nice and stated that she was Alice's Aunt. She stated that Alice had two brothers: Harold Jr. Seabrook, NH, Larry, Seabrook, NH and two sisters: Diane, Maggie (Margerie), and two step siblings, Priscilla and Scotty. She suggested Harold be called and furnished the phone number. This investigator called Alice's brother Harold Schrempf Jr. who state that he was Alice's brother and she was first married to Jimmy Peel from the Newton NH area. She divorced him and married a Paul Mirabito. She had children and now lives somewhere in Pennsylvania. He hasn't talked to her in over a year. After she married Paul Maribito he didn't know anything about her life after that. This investigator checked the records in New Hampshire for the name Peel in the Newton, NH area and found several listed including James. Two of the listed phone numbers for Peel's were disconnected. A Tina M and James M. Peel were called with a male answering. When questioned he stated that his father was married to Alice and his father lived with him. He then put James Peel on the line. Mr. Peel stated that he was married to Alice many years ago but couldn't remember the years They were married for 9 years and divorced. They had two children whose names were Harold C. Peels and Donna Marie Peels. He states that when Alice left him to live with Paul Mirabito she changed the two children's last name to Mirabito. She did this on her own and did not do it legally. He never gave permission for her to change their names. He advised that he has not seen Alice in 50 years. He stated "She changed the kids name on her own". He also stated that Harold was 8 yrs. old and Donna 6 years old when she left him. "She did me a favor by leaving". He states that she was four years younger than him but he did not recall her correct date of birth. 07-06-06 This investigator went to the Cumberland County Orphans Court Office and obtained a copy of the of the marriage license information when Linwood Phillips and Alice R. Mountz applied for the license. This information shows that she lists her date of birth as 12-11-39. With this information the following shows the different dates of birth that Alice Mountz has used: Pa. Mountz: 96-02575 98-247 98-03198 99-2950 99-3842 99-460 I 99-4652 This investigator then returned to his office and contacted the Register of Vita] Statistics in both New Hampshire and Massachusetts receiving information as to how to obtain copies of marriage licenses from their states. Information follows: Registry of Vital Record 150 Mt Vernon St. 1st Floor Dorchester, Mass. 02] 25 Bureau of Vita] Records 29 Hazen Dr. Concord, NH 03301 Investigator contacted Melissa and Mr. Faller's Office and gave her the request information. This investigator then traveled to the area of 899 Emily Dr, Mechanicsburg, Pa where Alice Phillips lived before she married Linwood Phillips and where her son Harold Mirabito is supposedly living. The home was obviously vacant and the property in very poor condition as compared to the many neighbors properties in the development. Mr. Phillips bought the property and is listed as owner in the Recorder of Deeds Office at the Cumberland County Courthouse. Investigator then went to the Darwin Knisely residence located at 900 Sheffield Dr, Mechanicsburg, Pa which is caddy-cornered from the property of 899 Emily Dr. Both HENNEMAN'S PRIVATE INVESTIGATION III FAIRWAY DRIVE CARLISLE, PENNSYLVANIA 17013-9365 (717) 258-0700 Mr. & Mrs. Knisely were interviewed together and stated that the property has been quite an eye sore in the neighborhood and no one lives there. The son is believed to have moved in with his mother at the Phillips home. They state that 3 guys showed up sometime ago and took a dumpster load of junk away. When Alice lived there she was with a guy by the name of Jack. They raised dogs and had at least 20 dogs there. The dogs were yapping all the time. They heard that the man Alice married had died and had a lot of money. Shortly after he died Alice was running around the neighborhood telling the neighbors that she was rich now because she just inherited $69 Million. While Alice lived there they did nothing but run the property down. The couple who lived there before Alice and Jack kept the place in beautiful condition. There was a pool in the back yard and they had to have it filled in. Neighbors went to the Township and complained to make them clean the property up. They don't know where Jack got to and don't know where either one of them came from. 07-08-06 This date, this investigator traveled to Dillsburg, Pa. Post Office in an attempt to check for an address of Jack A. Sunderland. The two addresses which he carried for Dillsburg, Pa during the time he was with Alice Phillips were both bogus and did not exist. A check with Mechanicsburg Pa. Post Office showed that there had been no change of address. Note: This investigator received notice from the Mechanicsburg, Pa Post Office 07-15-06 showing that Jack A. Sunderland was not known at the address of 899 Emily Dr, Mechanicsburg, Pa. 07-11-06 Another check was made through Cumberland County Court House records in different offices for information that may lead to jack A. Sunderland. Negative results. Linda Stull phoned stating that she had a name of Carrie Wagner, who used to live with Harold Mirabito and now lives in Chambersburg, Pa with a phone number of 263-1113. A check made to that phone showed it to be disconnected. 07-12-06 A reverse check of the phone number 263-1113 showed the phone number to belong to an Oscar Bechtel, 26 S. Franklin St, Chambersburg, Pa. This investigator knows Oscar Bechtel from previous police work. 07-14-06 This investigator interviewed Ruth A. Brown 95 Enks Mill Rd. Carlisle, Pa. who lives on the Phillip's property and cared for Mr. Phillips while he was ill. Mrs. Brown states that she helped care for Mr. Phillips and in fact stayed at the Phillips residence at night for quite some time. She stated that she believed Alice could have cared for her husband but opted not to. HENNEMAN'S PRIVATE INVESTIGATION 111 FAIRWAY DRIVE CARLISLE, PENNSYLVANIA 17013-9365 (717) 258-0700 On one occasion Mrs. Brown had left for a period in the afternoon to be with her son and do some chores and shopping. When she returned she found the evening and night medications for Mr. Phillips to be gone. When she questioned Alice, she said he always took the medicine at that time. Mrs. Brown went to can Mrs. Stul1 and there was no dial tone on the phone. When she looked around she found the phone was disconnected at the jack. When Alice was ask about that she stated she didn't do it. She knows Mr. Phillips couldn't get out of bed or reach the phone so Alice had to unplug it. When she checked the one pill bottle she found an Ambian sleeping pill and ask Alice about that. When she denied knowing about that and telling Mr. Phillips not to take it, he had already taken the pill and within a short time was asleep. One night when Linda Stull visited, Mrs. Brown told her that Alice was acting strange and had been in the bathroom. When Alice came out Mrs. Brown entered the bathroom and looked through the pill bottles. She found Percacet pills in an Amoxicillan bottle and Alice was spaced out. Mrs. Brown believes that Alice was switching pills because she was addicted to Percaset and saved Mr. Phillips to take for herself. On two different mornings Mrs. Brown checked Mr. Phillips oxygen and found his mask off once and the machine shut off another time. She ask Alice why and Alice said she took the mask off because it was drying Lin out and bothering him. She also found the water bottle empty a couple times. Alice was a very good manipulator and was very ill tempered according to Mrs. Brown. She manipulated his medication to speed up his death because she wanted his money. At Lin's funeral Alice had no remorse. Alice always said that LB had cut his children out of his Will and put her children in his Will instead. Alice called LB's children "No Good Bastards". Mrs. Brown stated that she told LB about this and she felt that Alice was abusing him and she couldn't stay there anymore. When she went to pack, Alice approached her and apologized and ask her not to leave. Alice said she was sorry and would do better. LB ask her to stay with him even down stairs. One week later Alice fired Mrs. Brown and told her to leave. Since Mrs. Brown lived on the property and Alice had a lot of people at the house, Mrs. Brown didn't feel safe. She used to leave the windows and doors open but now keeps a bat next to the door, has mace and bought .22 caI. Shells for a gun that her husband kept. She is afraid to be there because they (Alice and her family) harass everyone. The people who live with Alice are: Her son Harold, Grandson Harry, Daughter and her boyfriend and another guy with brown hair. There had been another guy there. Alice had a security company watching the property but she hasn't seen them lately. Mrs. Brown states that on the day Alice fired her she told Linwood the Alice was trying to harm him and this was right in front of Alice. Mrs. Brown recalls Harold and Butch (LB's son) had words with Butch using some colorful words. Alice said she was going to tell LB on Butch. Mrs. Brown begged her not to because of the stress his health and she went right in and did it anyway. She said she was going to call the police and have Butch arrested. She did that because she didn't want his children to get it. Mrs. Brown had charges brought against Harold because one night he was setting in his truck outside her home watching her. This was this past Memorial Day. He pled guilty to that charge. Alice told Mrs. Brown that Butch was out of the Will and her children were in. That LB didn't want his kids to get anything. She said this numerous times in the five years Alice lived there. This investigator traveled to Chambersburg, Pa and checked the Post Office for information of Oscar Bechtel and Carrie Wagner. It was found that Bechtel changed his address to 153 Wilkson Land, Fayetteville, Pa. and Wagner changed her address to 1600 Old Jacksboro Hwy. La Follette, Tn. 07-15-06 Investigator did a reverse search on the address for Wagner and found the phone number which was called and it was determined to be a neighbor of Wagner's mother Tonya Wagner. The neighbor stated she expected the Wagners to see each other this date and would give this investigator's phone number to Carrie Wagner. Ms. Wagner later phoned this investigator and stated that she had lived with Harold Mirabito, Alice's son. She also knew Jack Sunderland, who she called an "Ass". She stated that he likes jewelry, especially the late 50's with a Western style. She believes he was in either Cumberland or Dauphin Co. Prison at one time. She doesn't know where he is now. She came to the Carlisle area in 1996 with her mother and lived in Carlisle, Pa. She states that all of Alice's family is on drugs, mostly addicted to medications. When ask about Alice she replied that she married John for his money. When ask about John she stated John Mountz. She didn't know she had remarried. She thought that John was dead. This investigator advised her that John was alive and Alice had remarried but nothing more. Mr. Monismith advised that Blocker is "No damn good"l He was going to get additional information and call this investigator. He knows that Blocker is divorced and does not work. He saw Blocker walking West on the Pine Road just this morning toward the Phillips residence. 08-] 8-06 This investigator traveled to 29 Dannah Dr, Carlisle, Pa and interviewed both Harvey C. Drake and June T. Sandora who have lived together for ] 5 years and spent the last two years ofL. B. Phillips life with and around him, not only to visit but also to help care for Mr. PhiI1ips. Ms. Sandora stated that she even stayed over. They were interviewed together but did inteIject their own feelings from time to time. Ms. Sandora states that Alice would get mad at L.B. about clothes he had bought for his daughter Linda Stull. Alice would say "Does it always have to be about her"? "Can't it be about me". Alice's son Harry was working as a proofreader for a company and the night L.B. died he quit his job. Alice said that she was keeping a log of his medicine and she administered all of his medicine. Both their house keepers claim to have witnessed Alice giving L.B. the wrong medicine. It was like he was almost afraid to be alone with her because he would ask them to stay or stay longer. L.B. said that he thought he could change her ifhe gave her stuff because she always said how bad she had it in her life. She had her fingers broke by her father so she needed rings to cover it up. She also said that she had a bad heart and bad back, however that doesn't stop her from riding around on the golf cart. Alice gave L.B. more stress when he was at his worse. Alice had said that the last guy that lived with her mooched off of her when they had the dog kennel. All of Alice's conversation was all about money. About a week before L.B. died he ask June to go back to the house with Alice, but they were afraid stuff would end up missing and they would be blamed so she didn't go. Alice called the State Police and told them that stufT was missing even though she knew L.B. had given the items to Linda. L.B died on February 2nd and shortly thereafter Alice had Mike from Mountz Jewelers deliver a Rolex for her which she said L.B. wanted her to have for her birthday. (Note: Alice's birthday was well over at this time!,,!!!,,) Alice also said she always wanted a Mustang and shortly after L.B.'s death she got a red Mustang convertible with a tan top. L.B. used to say that her family was trailer trash. L.B told Alice that her daughters boyfriend was never allowed in the house and did not want any men or her family living there after he passed. She has everybody living with her now. Alice said Sue (secretary) was on her side and she felt sorry for Alice. L.B. was pissed that Alice went through his office and found the pre-nep. L.B also told Alice not to let the dogs upstairs. One night June stepped in dog poop when she got out of bed so she told L.B. Scott George, Alice's daughter Paula's husband was protective of Alice. 1 made food for L.B. like Terimisu and then ask ifhe liked it later. He said he didn't get any. That happened a lot so I started making two dishes, one for him and another. I believe she was giving it to Sue. We would go out to breakfast and one morning we went to pick them up. Harvey had told Alice we would do this but when we went over they weren't ready and Alice said she didn't remember and didn't ell L.B. Her excuse was that she takes sleeping pills between 8 -9 PM and must have forgot. I understand that she was from New Hampshire. I drove her to the prison to see her grandson. She was in the prison for] 5 - 20 minutes and carne out saying she couldn't see him. She said that one of her marriages was an open marriage and they went their own ways. Alice told me that Linda was not L.B.'s daughter because Lucy was pregnant before she knew L.B. Alice also said that Linda and L.B. were having a sexual thing. Nothing is pure in the way she thinks. It's always negative. When the Mortuary had L.B. ready we met Linda over there to check if everything was alright. At that time Alice didn't help with anything". Alice didn't like Linda and was biding her time till L.B. died and then stuff was going to hit the fan she said. I called L.B. and said I'm not saying it's about money but Alice said she was going to change the will and was going after as much as she could get. Alice told me she was going to get Sue to change the stocks to her name. L.B. told me the next day that she tried but couldn't. She did say that she didn't know if she wanted a new house but might rather stay at the farm. Alice saw us at Home Depot and said she was going to run away from home and go back to New Hampshire. She came to our door one other time and said she was running away from home and left L.B. alone at home. I would buy groceries for them and us and she would ask me for the receipts for both so she could show Sue and then Sue sould pay her back for both. I did this one time till I saw what she was doing and then 1 wouldn't do it any more. Sue paid for things out ofL.B.s money and that way Alice would get more money. I saw Alice give Harry $500.00 which she said was for Harry's mortgage. She said that L.B. didn't know that she was paying his mortgage. Then Harry was going to go in and pay L.B. the $500.00 which really came from L.B. Harvey Drake states: "Alice would act up and was at her worst when L.B. was the sickest. She questioned about the will while they were at the hospital. She wanted to know about the property she was to get. She walked out of the hospital and left. The alarm went off and we went upstairs and found her "out of it". I don't know ifit was drugs or alcohol. She went down stairs and got the pre-nep and wanted me to look at the "Life of Estate" what ever that was. Butch and I were with L.B. when he died and someone told her and she came over and said to L.B. "What, you left without saying goodbye". We walked out and Butch said" Did you see the act she put on when he died and she threw herself on the bed"? We went over to visit one time and he L.B. slept the whole time, about 45 minutes. He would fall asleep even on the phone. Some days he wouldn't even know we were there and then he would wake up as we were going to leave and say "Please don't go". He didn't want to be there with her alone. Alice told me one time hat she had been married 4 times before L.B. and the last one molested her daughters so she left him. At L.B.s viewing she might have stood by his casket once but she stayed sitting on the other side and didn't even have a get together. She said she didn't believe in it, so Linda had one. Lois was at the house for a couple of days after the funeral and they were going through L.B.s stuff Harry was sitting in the big chair saying ''I'm the man ofthe house, now you can rub my shoulders". I would feel compelled to tell if ask that when L.B. was in the hospital he said "Your like family, I'm going to make some changes in my will". I told him, let's not talk about it. That night Alice left the Hospital saying she was running away. L.B said he was going to contact Rob Frey. 08-21-06 A confidential informant has advised that Alice Phillips bought a Rolex watch at Mountz Jewelers approximately 1 month after L.B.'s death. It was delivered to her home and she was fitted. The watch sold for approximately $3000.00. Alice called the day after L.B.s funeral and said that L.B. had spoken to her from the grave and wanted her to have the watch. Alice had seen it and liked it so much. Mike called Sue and ask if she had the money etc. 08-24-06 William Shearer, Realtor from Carlisle, Pa. interviewed and stated that Linn Phillips helped him and his partner Mr. Frey, with their start in real estate and he was friends with him. He visited Linn and was at he and Alice's wedding. He had never met Alice until the wedding. He understood that Linn had placed an ad in the paper for help (housemaid and Alice answered the ad. He interviewed her, hired her and then married her. He believes she was from New England and worked in real estate there. He thought it could be Massachusetts. Mr. Shearer states that when he and Linn talked, Alice was quick to interject throughout the conversation. Mr. Shearer did not visit much for a few years but during the last year of Linn's life he was there a lot. Mr. Shearer and Mr. Phillip's birthdays were the same date which added to their friendship. Mr. Shearer never saw Alice change him or care for him in anyway other than give him his medicine and occasionally a drink or snack. She made sure he had his pills. Mr. Shearer would stay 3 - 4 hours, but when he would go to leave, Linn would take hold of his arm and didn't want hi to leave. He did say that he was concerned about the medicine she was giving him.tvtr. Shearer stated "I believe it was a legitimate complaint". He would say "Don't leave". This investigator contacted McCafferty Ford, Mechanicsburg, Pa. Their records show that Alice Phillips bought a 2006 Ford Mustang on 03-20-06 for $30,597.70 and paid cash. No lien on vehicle. Cumberland Valley Motors was contacted and it was found that Alice Phillips bought a 2006 Dodge Dakota on 04-17-06 for $19,000.00 for cash. No financing. 08-25-06 The following interview was conducted this date: Lois Alston, 2 Ickes Lane, Newville, Pa 17241 stated: "I worked for L.B. for about 8 months prior to his death. Alice chased everyone off She was a horrible person. L.B. Made it clear that I worked for him and not her, but if she ask I could do stuff for her. I started a couple weeks before he went into the hospital one time and he was in the hospital about two weeks. My son Paul called and ask me to help out with the house work after L.B. came home. While he was in the hospital I didn't work because Alice didn't trust me being there. I lived there when L.B. was there. I think Alice was a complete fake. She never cooked for him. She got carry outs, soup, oranges, popcorn and lots of pink milk shakes. She gave him the milk shakes 3 times a day. I cooked the meals. I would do breakfast and lunch and have dinner ready before I left around 3 PM. She was just waiting for him to die. She complained and got extra medicine. She freaked out and left the house then Linda cooked. June (Sandora) would feed him on weekends and the food he got after I left came from Linda and June. That woman did not cook. The stress she caused him put him in the hospital. When he was at home during November, December and January, Alice would put the window up next to himand we would go in and close it. He was very cold and kept shivering and blankets on. In April she turned the air conditioning on. I know she was doing it because there was no-one else there. He didn't want to be over medicatedbut she would give him more than he was to get. He would ask her not to give him any medication or only 1 percoset and she would give him 3 or 4. One night she was drunk and I took care of him for some time. When I gave him his correct medicine he got good and was even out riding on the golf cart. She would complain about being tired and he told her to go to bed and I would sit with him. She, then, accused him and I of having an affair. She said I was just the house keeper. I left and went home. When I came back at a later day things supposedly came up missing. One day L.B. called me and ask for a hutchie dog when he was in the hospital so I took him things like that. She wouldn't even wash his hair. I would wash the dishes because she wouldn't. We were to watch his medicine closely but it was always different. I gave him his insulin shots. When she did it she would stick it in and not be careful. She hurt him and gave him a\\'ful bruises . She wouldn't use clean needles. She would continue to use the same needle, even when it was dull and wouldn't go in easily. She took so many sleeping pills that she didn't know what was going on at nights. She didn't want to be bothered by him. He would sleep sitting up. I think he was afraid to go to sleep. We got rubber pads for the bed because he was urinating and messing himself. She wouldn't change him, clean him or even move him out of it. He was falling out of bed quite frequently and she said that there was nothing we could do. I went and bought side rails. I offered to make the house ready for the reception after the funeral and clean up. She said "Sure" and ask me to bring her breakfast. When I got there her son and granddaughter were there and she told me she didn't want a reception because she didn't believe in having one because the person was dead. Before the funeral her son left his dogs in the house and they went to the bathroom all over the house. She had me go through all L.B.s stuff and she threw lots away. Her and her son rummaged through everything looking for the will. She found an unsigned copy and complained. Everything that was important to him she threw out. At the viewing she never stood beside his casket. She came over to us at the funeral and ask it we would put up security gates to keep the family out. She hated Linda. The second time I went out after the funeral she had me take bags of clothes, shoes, sock and underware to the attic. She went through all his papers in his office and threw them away. It was papers that was most sacred to him. I would rub his arms and legs and she would say she couldn't do that because of her arthritis. She was just waiting, hoping to speed things along. L.B. had oxygen and she wouldn't connect the hoses. She left his urination bag run over and not empty it. He smelled so bad that at one point my son said he was going to wheel him out and hose him off as a joke but it was true. I tried to be friends with her but she wouldn't make any effort. We drove past the property and she has the property trespassed with signs every where and it's a mess with limbs and grass and weeds. I believe she was from the Boston area. She has quite a few people living there. There's some guy living there that she says is here brother, but I think it's a love interest. I found stains on her bed from activity. That was a couple months ago. I believe she's entitled to live there because L.B. wanted that but she shouldn't get more than she's supposed to. Linda and I were cleaning him up one time and he was crying in pain. Alice turned the T.v. up so she couldn't hear him. Before L.B. died she told me she had proof that Linda was not his daughter. She said he and I were having sex. He couldn't even get around or upstairs by himselflet alone have sex. When I went back he was on his pink milk shakes again. That's about all she gave him. The morning after his death she met me in the hall at the hospital and fussed and wouldn't let me see any of the family until she put on her act. Alice called Sue while L.B. \vas in the hospital and told her to change the stocks and bonds to her. L.B. found out about it and called Sue and from then on Sue kept papers in the trunk of her car. I believe she took all that stuff to Mr. Frey. Sue works for Mr. Frey now. Sue was with L.B. about] 5 years. It was the same day she accused me and L.B. of sleeping together". It was determined that the name Terry Blocker that carne up earlier has an ex-wife named Janice Blocker. This investigator has obtained her contact number and may at some point contact her about Mr. Blocker and if she knows what his connection with Alice is at this time.
