PETITION TO WITHDRAW MOTION FOR HEARING
AND NOW, this ~~ ``day of March, 2003, comes the above-named Petitioner,
Robert F. Phillips, by and through his attorney, Courtney L. Kishel, Esquire, and the law
firm of James, Smith, Dietterick & Connelly, and files this Petition to Withdraw
Petitioner's Motion for Hearing and, in support thereof, avers the following:
1. On or about October 15, 2002, Petitioner filed a Motion for Hearing
regarding enforcement of the Property Settlement Agreement.
2. A hearing on the matter is currently scheduled for March 24, 2003, at
10:30 a.m. before the Honorable Kevin A. Hess.
3. At this time, Petitioner believes it is in the best interest of his children to
withdraw the Petition, and forego enforcement of the Property Settlement
Agreement.
WHEREFORE, Petitioner respectfully request this Honorable Court to cancel the
hearing presently scheduled for March 24, 2003, at 10:30 a.m. before Judge Hess and
dismiss Petitioner's Motion for Hearing.
