• ~ IN RE: CONDEMNATION OF LANDS IN IN THE COURT OF COMMON PLEAS OF THE TOWNSHIP OF HAMPDEN, CUMBER- CUMBERLAND COUNTY, PENNSYLVANIA LAND COUNTY, PENNSYLVANIA, BY THE CIVIL DIVISION - LAW TOWNSHIP OF HAMPDEN FOR THE INSTAL- LATION OF A SANITARY SEWER SYSTEM. N0. 536 DECEMBER TERM, 1971 REPORT OF VIEWERS The undersigned Viewers respectfully represent: 1. That on April g, 1976, the undersigned, Wm. A. Kramer, 2nd, Esquire, J. Wayne Hertzler and Irvin Bretz, were appointed Viewers to view the premises in the above captioned proceedings to assess the damages, if any, sustained by the owners to said premises situate in Hampden Township, Cumberland County, Pennsylvania, by reason of the construction and installa- tion of a sanitary sewer thereon and by reason of the taking of a portion of said premises by the Township of Hampden for a right-f-~~aay for said sanitary sewer and the benefits received, if any, by the owners of the aforesaid premises as a result thereof. 2. That the Viewers were severally sworn to perform their duties according to law before discharging their duties as such, said Affidavit being filed to No. 70 Civil, 1976, in the Court of Common Pleas of Cumberland County, Pennsylvania. 3. That Notice of the View was given to the Township of Hampden and to the owners by Certified Mail, return receipt requested, as appears from the return receipt cards attached to the Process of Service filed with this Report. 4. That on Tuesday, June 22, 1976, in accordance with said Notices, all of the Viewers met on the premises and viewed same. Present also were the following persons: Paul L. Zeigler, Esquire, attorney for the Township; Donald L. Engle, owner; Jennie R. Patten Murray, owner; Roy J. Starry and Carolyn R. Starry, his wife, owners; John E. Slike, Esquire, • Attorney for the Starry's; Esther M. Kitzmiller, owner, and Barry E. Kitzmiller, her son; Richard M. Hebbard, Jr., Owner; Robert W. Hebbard, owner; Richard D. Gill, owner; Carol Ethel Brightbill, owner; J. M. Dundoff, owner; Harry B. Stroud, owner; John E. Succa, owner; Albert Z. Bogert, Esquire, attorney for the Succa's; Michael Miller, owner; Vernon Bermesderfer, owner; William J. Peters, Esquire, attorney for Luther G. Milliken; Larry S. Whitesell, owner; Clement J. That hearings were fixed for Wednesday, August 4, 1976, at g:00 o'clock a.m., and 1:30 o'clock, p.m., Prevailing Time, in the Grand Jury Room on the fourth floor mezzanine of the new Court House, Carlisle, Cumberland County, Pennsylvania. 6. That at the request of Albert Z. Bogert, Esquire, attorney for John E. Succa, et ux, owners, and Richard C. Snelbaker, Esquire, attorney for Blanche N. Reeser, owner, their hearings were continued to Wednesday, September 1, 1g76, at 9:00 o'clock a.m., Prevailing Time, in the. Grand Jury Room on the fourth floor mezzanine of the new Court House, Carlisle, Cumberland County, Pennsylvania. 7. At the request of Richard C. Snelbaker, Esquire, attorney for Blanche N. Reeser, owner, the hearing on her property was continued to Friday, October 8, 1976, at g:00 o'clock a.m., Prevailing Time, in the aforesaid Grand Jury Room. 8. That at the hearings on August 4, 1976, all of the Viewers were present together with the following persons: Paul L. Zeigler, Esquire, attorney for the Township; Roy J. Starry and Carolyn R. Starry, his wife, owners; John E. Slike, Esquire, attorney for the Starry's; Luther G. Milliken, owner; William J. Peters, Esquire, attorney for Milliken; Michael A. Miller, owner; Vernon J. Bermesderfer, owner; Larry F. Whitesell, owner; William F. Kelley, son of Clement J. Kelley, owner; Donald L. Engle, owner; Jennie R. Patten Murray, owner; Esther M. Kitzmiller, owner; and Barry E. Kitzmiller, her son; Leander D. Krist, owner; Robert W. Hebbard, owner; Richard M. Hebbard, Jr., owner; Richard D. Gill, owner; William H. Taylor, -2- • Jr., purchaser under Sales Agreement; Carol Ethel Brightbill, owner; M. J Dundoff, owner. 9. That at said hearings on August 4, 1976, the attorney for the Township, the owners and their respective attorneys stipulated that the date of the taking was November 19, 1971. 10. That at said hearings on August 4, 1976, after being duly sworn, the owners offered the following testimony: A. Roy J. Starry stated that 20% of his property has been taken by the condemnation of the right-of-way, there is a manhole located on his property, that four trees were destroyed as well as a flower bed. In addition the retaining wall along the creek was cracked and buldged in places. Since installation of the sanitary sewer, there has been a drainage problem in his yard. He stated the Township had placed drainage tiles but they were inadequate and he had to add approximately 60 feet of drainage the on his own. He stated that he had a septic tank prior to the installation of the sanitary sewer. He stated he believed the damage to the property at least equalled any benefit derived from installation of the sanitary sewer. He estimated his out of pocket costs to be $250.00 to repair the lawn and drainage, $35.00 for reseeding, $50.00 for stones for the road and $100.00 in labor. On cross examination, Mr. Starry stated he had no drainage tiles before the sewer was installed and did not have a drainage problem. He stated he put in one drain and the Township put in two or three other drains. B. Luther G. Milliken stated that he used his place purely for recreation, and since the installation of the sanitary sewer, there is a man- hole that is six inches above grade and creates a hazard. He stated that they removed ten to fifteen feet of fence and a flag pole. He stated he can not build in the area where the sewer is now located and estimated the value of his property was reduced by $1,200.00. On cross examination, he stated he had no idea of the fair market value of his property and was estimating the reduction in value. He stated that the area where the sewer line is located is subject to flooding. He fur- ther stated that there is no plumbing in the cottage, and he uses an outhouse. -3- • • C. Michael A. Miller stated that he bought the former property of Louis J. and Marilyn Fe Zaydon in November of 1972. He was informed that trees had been taken down and approximately fifteen feet of hedge removed on the boundary of the Whitesell property. He further stated that the driveway had been ruined by the construction equipment and that he spent $70.00 for stones in addition to his labor to repair the driveway. He also indicated that there is a manhole in his yard which is above grade. On cross examination, Mr. Miller stated that there is no agreement with the prior owner concerning the condemnation. D. Vernon J. Bermesderfer stated that he bought the property in 1973 from Jessee P. Murlatt. He expressed concern that the drainage around the house may be affected by damage to the drainage tiles at the time the sewer was installed, However, no problem has occurred yet. He stated that a culvert in the corner of the yard had been damaged, and he estimated his total damages to be $500.00. On cross examination, he stated that there was no agreement with the prior owner concerning the condemnation. E. Larry F. Whitesell stated that he bought the property in the spring of 1972 from Janet M. Lohr. There is settling in one corner of the lot and approximately 51 feet of hedge was removed on either side. On cross examination, he stated that there was no agreement with the previous owner concerning the condemnation. F. William F. Kelley, appearing on behalf of Clement J. Kelley, his father, stated that the lateral for the sewerage hook-up was placed in a location requiring an additional 30 feet of lateral in order to make the connection. He stated that a fire place had been damaged which was repaired at expense to his father, and in addition, his father incurred the costs of regrading once the sewer had been installed. He stated that receipts were available for the work performed and that they would be forwarded to the Board of View as soon as possible. -4- • • G. Donald L. Engle stated that he was purchasing the property from Lawrence C. Rider under a Sales Agreement entered into in January of 1972. He stated that the contractor did not replace the top soil and left rock behind. In addition, two manhole covers located on his property were 6-g inches above grade until he filled the area around them. On cross examination he stated he was using the sanitary sewer. H. Jennie R. Patten Murray stated that she never received notice of the condemnation proceedings. She stated that since the installation of the sanitary sewer she has had difficulty with drainage. Where there was a drainage gutter before, a pipe had to be added to accomodate the run-off from a well. In addition, there is a manhole directly in front of the patio of her cottage. On cross examination Mr. Zeigler showed Jennie R. Patten Murray a return receipt card for the initial notice of the condemnation signed "Rebecca Patten". She stated that she did not know who Rebecca Patten is. I. Guy E. Kitzmiller, testifing for his mother, Esther M. Kitzmiller, stated that there is a manhole in the yard that is 6 inches above grade, the contractor left stones and never replaced the top soil, one barbecue pit was cracked and required patching, one barbecue pit made out of stone was removed completely, a light pole was bent, the wires to the light pole were turned down, and there was some sinking after the installation. He stated the damages were $1,579.00 as outlined in a letter of June 24, 1975, from Esther M. Kitzmiller to Mr. Zeigler. On cross examination, he stated that he would obtain more accurate estimates which would be forwarded to the Board of Viewers. J. Leander D. Krist stated that they bought the property in the fall of 1974 from Richard M. Hebbard, Jr. He stated that the drain fields for the septic. tank were ruined and that they needed the septic system until they could hookup to the sewer in 1974. He further stated that the contractor left stones in the yard and did not replace the top soil and damaged a barbecue pit. -5- • • K. Robert W. Hebbard stated that the front steps and foundation to his home were cracked, trees are dying on one side, the trench was back filled with shale and grass will not grow, approximately 30 feet of privet hedge was removed. He stated that he did not have any estimates of the cost but would obtain them and forward them to the Board of Viewers. L. Richard M. Hebbard, Jr, stated that the retaining wall along the creek was bowed and a stone race way for a stream which flows into the creek was patched with cement although it was made of stone, In addition, the piers to the retaining wail along the creek were damaged. He stated that estimates would be obtained and forwarded to the Board of View. M. Richard B. Gill stated that he bought the property in 1972 from Philip R. Jones. The drain pipes for the yard and spouts had to be replaced after the sewer was installed, the grass is dead in places, the retaining wall along the creep is cracked, the steps to the creek are damaged, and a cinder block barbecue p'lt was very poorly patched. In addition, there is a manhole cover that is 6-~i inches above grade in the front yard. N. William H. Taylpr, Jr., stated that he is buying the property from Helen M. Drugonllunder a Sales Agreement entered into in late 1973. He stated that there i$ a manhole 6-8 inches above grade, the retaining walls were damaged,!a planter was destroyed at the front door, and 4 to 5 loads of top soil were required to regrade and reseed the yard. He stated he had receipts for thy: top soil which would be forwarded to the Board of Viewers. 0. Carol Ethel Brightbill stated that the grade in front of her home had been raised as a resy~lt of the sewer installation, and there is no longer proper drainage. II P. M. J. Dundoff sated that the barbecue pit made of brick was damaged and not repaired. Thy contractor left stones in the yard and it was necessary to regrade and reseed the yard. 11. That prior to the adjournment of the hearings on August 4, 1976, the Chairman of the Board of Viewers requested that anyone having estimates that were not submitted during the hearings may submit them directly to -6- • • the Board of Viewers by delivering them in person, or by mailing them to the office of the Chairman of the Board of Viewers, on or before September 1, 1976.' 12. That on September 1, 1976, Mr. Zeigler informed the Board of View that the Township had settled with John E. Succa and Kay E. Succa, his wife, and there was no need for further action by the Board of View. 13. That at the hearing on October 8, 1976, all the Viewers were present together with the following persons: Paul L. Zeigler, Esquire, attorney for the Township; Joseph McGraw, Realtor and Appraiser; Blanche N. Reeser, owner; Richard C. Snelbaker, Esquire, attorney for Blanche N. Reeser; and Norman Dellinger, Realtor with the Jack Gaughn agency. 14. That at the hearing on October 8, 1976, the attorney for the Township and the attorney for the Owner stipulated that the date of the taking was November 19, 1971. 15. That Joseph McGraw, Realtor and Appraiser, with offices located at Third and Market Streets, Lemoyne, Pennsylvania, after being duly sworn, duly testified on behalf of the Township and stated that the property contained 20,350 square feet of which 3,759 square feet were taken by the easement. There are no recent sales on Creek View Road that can be used as comparables. However, using comparables on Prowell Drive, he stated the fair market value of the premises before the taking was X21,500.00. The damage to the property as a result of the installation of the sanitary sewer is X890.00, making the value after the taking $20,610.00. He further stated that the benefits to the property was $2,244.00, making a net benefit of $1,354.00. On cross examination, he stated that he knew the property had been sold as part of the George W. Quigley Estate and agreed that the sale price could have been $8,250.00 in 1972. He stated that he had examined the properties for the Executors of Mr. Quigley's Estate and at that tiro they were in very poor condition. He stated it is possible that the improvements were made after the date of taking of the easement and that -7- • • the benefit comes from the availability of sewer even though the houses did not have indoor plumbing at that time. On redirect he stated that even if the value of the property is only one-half as suggested, the damages would remain the same. 16. That Norman Dellinger, agent for Jack Gaughn Realtor, after being duly sworn, testified on behalf of the owner. He stated that he was a licensed real estate salesman with ten years of experience, knows the area in general quite well, and had made appraisals of dwellings in the immediate area in question. He stated that the fair market value prior to the condemnation was X16,000.00, and that the fair market value after the taking was $14,000.00, making damages of $2,000.00. He stated that prior to the installation of the sanitary sewer the yard slopped gently to the creek, but the grade is more abrupt now. He stated that the extra expense of the sewer fee and hook on charges plus the benefit assessment detract from the value of the property as a vacation home. On cross examination he stated that he was not a licensed appraiser and had never done sewer appraisals before. He stated he generally inspected the area from time to time looking for prospects both before and after the time of the taking. He stated that he had given no consideration to the fact that the area is subject to flooding, but agreed it would be a problem. He stated -that he was the agent that sold the premises to Blanche N. Reeser in 1973 for $14,000.00. 17. That immediately after the taking of testimony the hearing of October 8, 1976, was adjourned, and the Viewers met to discuss the testi- mony of all the hearings and arrive at their Schedule of Damages and Benefits. -8- • SCHEDULE OF DAMAGES AND BENEFITS • 1. That the Chairman informed the other members of the Board of View that William F. Kelley, on behalf of his father Clement J. Ke11ey, had submitted estimates as requested which estimates are filed as part of this Report. No other estimates were received. 2. That the Viewers arrived at their Schedule of Damages and Benefits as more particularly set forth in said Schedule attached to this Report. (Exhibit "A") 3. That 9:00 a.m., Prevailing Time, on Tuesday, November 23, 1976, in the Grand Jury Room of the Cumberland County Court House, Carlisle, Pennsylvania, was set as the time and place for exhibiting the Schedule of Damages and Benefits. (Exhibit "A") 4. That at the exhibition of the schedule on November 23, 1976, all the Viewers were present together with the following persons: Paul L. Zeigler, Esquire, attorney for the Township; Jennie R. Patten Murray, owner; Richard D. Gill, owner; Carol Ethel Brightbill, owner; Anna M. Dundoff, owner; and Karen M. Donner, owner. 5. That the Chairman of the Board of Viewers explained the basic formula applied to all properties as follows: the Viewers accepted the Township resolution establishing the cost/benefit at $12.00 per lineal foot of installed sewer main. The damages from the taking were initially determined on the basis of $1.00 per lineal foot of installed sewer main with further damages added based upon actual costs incurred by an owner or acceptable estimates of the costs to be incurred. In the case of an irregularly shaped property, the benefit was adjusted to reflect same. 6. That Carol Ethel Brightbill stated her property was 50 feet in width but the benefit was based on 54.77 feet. 7. That Karen M. Donner stated her property was 50 feet in width but the benefit was based on 5~F.7g feet. -9- • • g. That Anna M. Dundoff stated she had just received an estimate for her fireplace of $351.00, which was submitted. 9. That Jennie R. Patten Murray questioned the validity of the proceedings and the method of determining damages. 10. That Richard D. Gill questioned the amount of the damages awarded him but offered no further proof thereof. 11. That upon exhibiting the said Schedule, the hearing was adjourned and the Viewers met to arrive at their final awards. FINDINGS OF FACT 1. That at the time of the taking on November 19, 1971, the properties in question were owned by the respective owners as is more particularly set forth in the Schedule of Damages and Benefits attached hereto. (Exhibit "B") 2. That certain of said owners granted and conveyed their properties to subsequent owners as is more particularly set forth in the Schedule of Damages and Benefits attached hereto. (Exhibit "B") 3. That the net benefits to the owners and subsequent owners where applicable, as set forth in the Schedule of Damages and Benefits attached hereto are due the Township of Hampden. (Exhibit "B") CONCLUSIONS OF LAW 1. That the new benefits set forth in the Schedule of Damages and Benefits attached hereto should be paid by the respective owners and subsequent owners, where applicable, to the Township of Hampden. (Exhibit "B") 2. That the cost of these proceedings should be paid by the Township of Hampden. 3. That the following is an assessment of the costs of the Viewers: -10- • • Wm. A.
