Dear Judge Bayley:
My client, now former client Mr. Fred Gerber (Col. US Army Ret.)
Informed me last year as I was fighting for him on a spurious post-
settlement claim raised by his litigious sister Marilyn, that he desired to be
finished of fighting with Marilyn and he was turning matters over to his other
sister Jane Gerber who was replacing me with her selection of counsel.
Apparently Mr. Hubert Gilroy won against Marilyn upon my
preliminary obiections before the Honorable Judge Oler.
However, no attorney entered appearance for Mildred's Estate, only
to the Trust matter. Not only is the Status Report due but also the Inheritance
Tax Return is due (overdue).
Mr. Fred Gerber, who is still the Executor of his mother's Estate, has not
communicated with me despite my attempts to communicate with him. My
oHice as recently as Thursday emailed a letter, faxed the same letter and
federal expressed the same letter to Mr. Fred Gerber apprising him of the
hearing on Monday March 12, 2007.
Please find enclosed my latest attempt to communicate with Mr. Fred
Gerber as referenced immediately above.
Also, please find enclosed my prior correspondence sent to Mr. Gerber
and copies of correspondence received from Mr. Gerber.

In addition, I spoke to your legal secretary, Sharon, on Friday to let her
know that I could not be at this Contempt Hearing, as I am scheduled for a
client who I am representing at Dauphin County on Monday the 12th at 10:00
a.m. for enforcement of child support.
As such, I have a"ached an Affidavit to explain this ma"er and will be
happy to make myself available to speak to you further about this ma"er as
you wish.
I therefore respectfully request, your Honor, to be excused from the
Gerber Contempt hearing on Monday.
If I cannot be excused, may I ask that your legal secretary Sharon call
my office on Monday morning to advise as I wish to comply with what you
want.
