COMPLAINT
1. Plaintiff Debra Johnson is an adult individual residing at 1436 Karen Drive,
Harrisburg, Dauphin County, Pennsylvania 17109.
2. Plaintiff Eric Johnson is an adult individual residing at 1436 Karen Drive, Harrisburg,
Dauphin County, Pennsylvania 17109.
3. Defendant Ramon Elias a/k/a Ramon Elias-Rodriguez is an adult individual residing
at 680 Saint Joseph Street, Lancaster, Lancaster County, Pennsylvania 17603.
4. On or about July 1, 2007, at approximately 7:45 o'clock a.m., Plaintiff Eric Johnson
was operating a 2003 Honda Civic EX owned by Plaintiff Debra Johnson in a westbound direction
on Route 581 in Camp Hill, Cumberland County, Pennsylvania.
5. On or about July 1, 2007, at approximately 7:45 o'clock a.m., Defendant was
traveling behind Plaintiff Eric Johnson in a westbound direction in the left lane on Route 581 in
Camp Hill, Cumberland County, Pennsylvania.
6. As Plaintiff Eric Johnson was passing an on-ramp and vehicles were merging onto
Route 581 westbound, a car traveling in the right lane pulled in front of Plaintiff without signaling.
7. Plaintiff Eric Johnson had to apply his breaks abruptly in order to avoid striking this
phantom vehicle.
8. Defendant was traveling too closely behind Plaintiff Eric Johnson and struck his
vehicle in the rear causing damage.
9. The damage to the 2003 Honda Civic EX owned by Plaintiff Debra Johnson and
operated by Plaintiff Eric Johnson occurred solely as a result of the negligence, recklessness, and
carelessness of the Defendant in that he:
a. operated his vehicle in a careless, reckless, and negligent manner;
b. failed to properly operate and control his vehicle;
C. failed to use due care under the circumstances;
d. operated his vehicle in disregard of the rules of the road, the ordinances of the
local municipality and the laws of the Commonwealth of Pennsylvania.
10. Defendant otherwise failed to use due care and caution under the circumstances.
11. At all times material hereto, Plaintiffs acted with due care and were not contributorily
negligent.
12. Defendant was the direct and proximate cause of damage to Plaintiffs' vehicle.
13. As a direct an proximate result of the Defendant's negligence, Plaintiffs sustained
property damage in the amount of $4,317.28. A copy of the documentation showing Plaintiffs'
damages is attached hereto as Exhibit "A."
WHEREFORE, Plaintiffs demand judgment against the Defendant in the amount of
$4,317.28.
