Dear Judge Bailey,
At approx~ 3:00 PM on 20 Marck 2001 I received the subpoena of Mari!yn
Gerber, which requires my appearance on 22 March, 2001 ~ 11:30 AM. Due to the late notice of
this civil action i am amble to request the Solicitor for the City.of Harrisburg, to apply for a
motion to squash this subpoena. I am however notifying their office of this case.
Since any testimony I provide is from performance of my duties with the
Hamsburg Bureau ofPoEce, I am not represented by private counsel. 1 fully intend to honor the
subpoena however, in all probability, I will be a hostile witness for Ms. Gerber.
.Due to rescheduling of mandatory MP.O.E.T.C legal u~dates, I may'not be able
to arrive by the 11:30 hours specified. [ will conta~ your office with a t~'ne of arrival prior to
response to your court room.
