COMPLAINT
1. The Plaintiff is Charlene R. Wagner, an adult individual with a current address of
6222 Locust Street, Harrisburg, Dauphin County, Pennsylvania 17112.
2. The Defendant is Robert F. Wagner, III, an adult individual with an address of 1855
Walnut Bottom Road, Newville, Cumberland County, Pennsylvania 17241.
3. Plaintiff and Defendants are the owners of certain real estate in Cumberland County as
described below, and all interest of the parties in the property are held as tenants in common and
are undivided.
4. The parties acquired title to the property known as 1855 Walnut Bottom Road,
Newville, Pennsylvania 17241, by Deed from Harriet E. Miller dated January 30, 1995, recorded
in the Office of Recorder of Deed of Cumberland County, in Deed Book 118, Page 36, wherein
said Grantors conveyed all that certain lot of property known as 1855 Walnut Bottom Road, into
Charlene R. Wagner and Robert F. Wagner, III, husband and wife. A copy of the Deed
containing the legal description is attached hereto and made a part hereof as Exhibit "A".
5. The parties were divorced on the 22nd day of January, 2003, at which time title in the
property became vested in both individuals as tenants in common.
6. No person other than the parties to this suit has any interest in the property, which is
presently in the possession of the Defendant.
7. No partition or division of the property has ever been made, although Plaintiff has
requested the Defendant to join with her in making one.
WHEREFORE, the Plaintiff requests this Honorable Court to:
A. Decree partition of the real estate; and
B. Decree that the share or shares in which the respective parties are entitled be set out to
them in severalty and that all property and necessary conveyances and assurances be executed for
carrying such partition into effect; and
C. That if the real estate cannot be divided without prejudice to or spoiling the whole,
such property and necessary sale or sales of the same may be made by such persons and in such
manner as the Court may direct; and
D. Order such further relief as the Court deems equitable and just.
