ORPHANS' COURT DIVISION NO. 2000-101 JUVENILE PETITION FOR APPOINTMENT OF A GUARDIAN FOR THE ESTATE AND NOW, comes the Petitioner, Cumberland County Children & Youth Services, by and through its solicitor, Ruby D. Weeks, Esquire and represents the following in support of its Petition For Appointment of a Guardian for the Estate of a Dependent Child: 1. The Petitioner is Cumberland County Children and Youth Services, mailing address 16 West High Street, Carlisle, Cumberland County, Pennsylvania, 17013. 2. Kenneth Charles Bouder, date of birth January 2, 1983, was first adjudicated dependent on May 8, 2000. On that date his care and custody was placed with your Petitioner, Cumberland County Children & Youth Services for placement in Abraxas. By Order of Court dated May 26, 2000, Kenneth Bouder was placed in foster care through Mountain Valley Foster Care Plus Program. He presently resides at 6920 Gehr Road, St. Thomas, PAl 7252. 3. Kenneth Charles Bouder turned eighteen on January 2, 2001, but requested to remain in care and custody until he graduates from High School in June, 2002. An Order of Court reflecting this was signed as part of the Permanency Plan review on December 26,2000. 4. It is necessary that a guardian be appointed for Kenneth Bouder because he is the recipient of $20,079.00 in Social Security benefits based on his Father's disability. 5. The proposed guardian is Jacqueline M. Verney, Esquire, Kenneth Bouder's court appointed counsel in the Dependency Action. Ms. Verney is a licensed attorney in the Commonwealth of Pennsylvania, whose business address is 44 South Hanover Street, Carlisle, Cumberland County, Pennsylvania, 17013. 6. Kenneth requests that the court authorize the immediate removal of a total of $1,500.00 for the following expenses: clothes, shoes, school ring, baseball equipment, football equipment, wrestling equipment, yearbook, summer and winter camps. 7. Petitioner requests this Honorable Court authorize the remainder of the monies be invested in a Certificate of Deposit with automatic rollover of interest in a nationally insured Cumberland County Bank. 8. Petitioner requests this Honorable Court authorize the Guardian to pay whatever tax liability that may arise from the income accrued from the investment 9. Petitioner requests this Honorable Court authorize the payment from principal or income by the Guardian at her discretion the following expenses that may arise: costs in connection with taking standardized tests for college admission; costs for High School Junior and Senior Class activities such as attending the school prom and other school sponsored activities; costs in connection with applying to a college; extraordinary medical and dental expenses not otherwise covered by insurance and by Cumberland County in providing his foster care. All such payments shall be documented with receipts for services or purchases made. Cumberland County is reimbursed the monthly Social Security benefit in the amount of $445.00 received by Kenneth and this amount defers part of his costs of care. 10. Petitioner requests this Honorable Court authorize the payment of the remaining proceeds of the investment to Kenneth Charles Bouder when his Dependency is terminated. 11. Petitioner requests this Honorable Court waive the requirement of a bond pursuant to 20 Pa C.S.A. Section 5122(c) since the monies will be invested in a secure Certificate of Deposit and any payments made for education, medical or dental expenses for the dependent child will be made only upon documented receipts. Further, the Guardian is covered by malpractice insurance. 12. The proposed Guardian consents to her appointment, a copy of which is attached as Exhibit "A". 13. Notice of hearing in this matter is being given to Kenneth, Kenneth's attorney and Kenneth's parents. WHEREFORE, Petitioner requests that this Honorable Court appoint Jacqueline M.
