AND NOW, this ~ day of January 2005, upon consideration of the 1nterim ;:;;
Report of Auditor submitted by William A. Duncan, Esquire in regards to the above-captioned
matters, the Court rules as follows:
1. The Accountant shall file with the Register of Wills, Second and Partial Accounts
covering the time period of January 1,2002, and ending December 31, 2004, as to Docket Nos.
21-1998-0195 and 21-2002-0540.
2. The Accountant shall further file an Informal Statement to all interested parties
disclosing projected activity in both accounts from January I, 2005, until July 1,2005.
3. Discovery as to the accounting period ending December 31, 2004, shall proceed
upon filing of the Second and Partial Accounts..
4. The Petition of Jacqueline M. Verney, Esquire is hereby dismissed with no award
of Counsel fees.
5. The Petition of Marilyn Gerber as to Compelling Answers to Interrogatories is
hereby dismissed and Marilyn Gerber is given leave of Court to re-fiIe said Interrogatories in

accord with Pennsylvania Rules of Civil Procedure.
6. Marilyn Gerber's request for an award of Counsel fees against Frederick E.
Gerber, II is denied
7. The Petition of Marilyn Gerber as to relief from proceedings due to vacation is
deemed to be moot and therefore dismissed.
The Auditor is given leave of Court to submit a Petition for Extension until November
15, 2005 for the purpose of filing appropriate reports consistent with prior appointments and any
future appointments related to further filings by the Accountant.
