The tax rate imposed on the net value of transfers to or for the use of the decedent's siblings is twelve (12) percent [72 P.S. 99116 (a) (1.3)]. A
sibling is defined under Section 9102, as an individual who has at least one parent in common with the decedent, whether by blood or adoption.

We are very sorry to learn that your father passed away in April and, on behalf of Navy Federal's
staff and membership, we wish to extend our heartfelt sympathy to you and your family. We
have completed settlement of his accounts and I hope that the following information is of
assistance to you.
On 14 April 2007, your father's share savings account reflected a balance of$7,599.93. Due to
his age, the shares earned no Life Savings Insurance. Our explanatory flier is enclosed. Divi-
dends credited to the account since that date increased the balance to $7,617.73. His checking
account had a balance of $13,837.48 on the date he passed away. A direct deposit of $3,392.88
was received from the Defense Finance and Accounting Service (DF AS) and credited to the
account on 30 April. These funds have since been deducted for return to the paying agency. In
view of these and other transactions, the checking balance was $13,440.35. For the purpose of
disbursement, the funds in the checking account were transferred to the share savings account,
for a combined balance of$21,066.13. Since no joint owner has been designated, the enclosed
check for the combined account balances has been made payable to your father's estate, of which
you and Margaret Tonls are Administrators.
The Visa account in your father's name did not reflect a balance when he passed away.
Your father's savings, checking and Visa accounts are now closed and the final statement(s) will
be forwarded at a later date. We have forwarded information regarding the settlement of these
accounts to Mrs. Toms under separate cover.
On 14 April, your father's Individual Retirement Accounts (IRAs) reflected balances in the
amounts of$5,135.72 (0007), $11,910.35 (0008), $4,809.87 (0009), $3,365.42 (0011) and
$5,532.13 (0012). As beneficiaries of the IRAs, you and Cameron C. Toms are entitled to these
balances, as well as dividends earned on the accounts since the date of death. We have trans-
ferred the funds to which you are entitled to beneficiary lRAs established in your name under
account number 0333939908, control numbers 0018, 0019, 0020, 0021 and 0022. These are
temporary accounts designed to hold the funds on deposit until they are disbursed in accordance
with your written instructions. A new beneficiary may not be named on a temporary account.

Weare prevented from accepting contributions for crediting to the beneficiary accounts. In
addition, since your father was over 70Y2, the required minimum distributions had begun from
his IRAs, and these distributions must be continued or accelerated from your beneficiary IRAs.
Your beneficiary IRAs will remain open until you have had an opportunity to make a decision
regarding disbursement of the funds. Please provide us with your instructions as soon as possi-
ble, but no later than 30 September 2008, the last day allowed by IRS regulations. We have
provided an information sheet regarding all distribution options available to you. Please indicate
your preferences regarding disbursement and tax withholding on the enclosed IRA Beneficiary
Options form and return it to us in the envelope provided. If we have not received your response
by 30 September 2008, we will distribute the entire balance, less 10% in federal taxes, by
31 December 2008. In accordance with IRS regulations, this payout is irrevocable and \vill not
be reversed.
To satisfy Internal Revenue Service requirements, your father's 2007 required minimum distri-
bution (RMD) of$1,327.37 must be withdrawn from your beneficiary IRAs by 31 December of
this year. When responding, please include your instructions for this distribution, being sure to
indicate if taxes should be withheld.

I, JAMES EDWIN TOMS, Captain, U.S. Navy (Retired) am a resident ofCumberIand
County, Commonweaith of Pennsylvania, which I hereby declare to be my place of legal domicile.
I further declare that I was married to Margaret Pasquarella Porr Toms in a ceremony on June
i 9, 1998. ThIs wedding was preceded by a prenuptlai agreement executed on June i 0, i 998. I
being of sound and disposing mind and memory, hereby make, publish, and declare this to be my
Last will. and. Testament, hereby revoking all wills and codIcils previously made by me. I have
two sons, Cameron Carmichael Toms and Barton Porter Knight Toms, born of my first marriage.
Margaret has two J~nghters and a son, Lmda Porr Sweeney, Carolyn. Porr and Robert Porr, born
of her first marriage.
ARTICLE I
All of my just debts, which are legally enforceable, shall be paid out of my estate as soon
as practicable.
ARTICLE II
In accordance with the terms of our prenuptlai agreement Margaret and I are owners as
Tenants in Common of our home at 923. WillcliffDrive, Mechanicsburg, Pennsylvania. Also in
accordance with that agreement I hereby establish a Trust to accept my share of the said marital
home for the benefit of my wife, Margaret, so long as she survives me and chooses to occupy the
residence that trust to he 8cimini~ered. in accordance with our pre-nuptial agreement. So iong as
she survives and chooses to occupy the residence she shall be responsible for all expenses related
to the malntenance and. upkeep of the residence including, without llmItat1on: utilities; repairs; real
estate taxes; and insurance premiums. At such time as Margaretno longer occupies our home at
923 wliiciIff'Drlve, the house shall he piaced on the market and sold at the price that the trustees
deem appropriate. Half the proceeds shall be distributed to my wife, Margaret or in accordance
with my wife, Margaret's wiii.. The other bait shall be distn~uted as follows: Fifty percent to my
son, Cameron Carmichael Toms, and fifty percent to my son, Barton Porter Knight Toms. In the
event that either son does not survive at the time this trust property is distributed it shall be
. ibuted as set forth below.

ARTICLE ill
Margaret and I own our furniture and household e1fucts as tenants by the entirety.
ARTICLE IV
My equity shares in dividend reinvestment programs and my accounts in Mellon Bank and
the Navy Federai credIt union, willch I hoid at the time of my death, shall be managed by my
Trustee and used as necessary in admini!'tering the Trust of923 WillcliffDrive.. When that Trust
is dissolved the remainder of these assets shall be distributed in accordance with Article V, below..
ARTICLE V
If my sons, Cameron Cart11lchaei Toms and Barton Porter KnIght Toms, are living at the
time of my death, I give, devise, and bequeath the rest, residue and remainder of my estate equally
to those two SODS. If either of them shouid predecease me, then I give the share of any such
deceased child to his issue, him surviving, per stirpes, and if either of my sons should so die
without ieavlng lssue survlvlng hIm, then his share shall go to my child surviving him, or to his
surviving issue, the issue of a deceased taking the share of the deceased parent, per stirpes. In the
event none oftbese survive me, then to my wife, Margaret. In the event no such mdlvlduais are
then living, then to the children of Linda Porr Sweeney, Margaret, Joseph, and John, or the

survivors among them.
At the time of distribution of the proceeds of sale of the property at 923 WtllcliffDrive
the same provisions apply in the event that one or both of my SODS no longer survives.
Article VI

hereunder if such person shall survive me, such person shall be deemed not to have survived me if
he or she shall die within thirty (30) days after my death..

Aii estate, inher1tance, transfer, iegacy, succession or other similar taxes and duties, and any
interest and penalties thereon, payable on any property which is devised or bequeathed under the

provisions oftlrls, my wID, or on any other property which shail constitute a taxabie part ofmy
estate, whether or not passing under this will, shall be paid out of the principal of my
reSiduary estate as an expense of admin1strat1on and without apportionment, deduction of
reim ursements therefor, and without adjustments among the residuary beneficiaries.

Article VllI
I authorize and empower my Executors of the Will and the successors in office, and the
Trustee or successors appointed hereunder, wIthout posting bond or surety, and without order of
or report to, or authorization of any court, to sell, convey, mortgage, lease, reinvest, exchange,
manage, contro~ or otherwlse deai with any and aU property comprising my estate. Further, my
Executors and successors in office, and Trustee and successor in office, shall be empowered to
empioy and reasonahiy compensate any persons reasonabiy necessary to render asslstance in
carrying out the duties of Trustee and of Executor, including the requirements, if any, of ancillary
admimstratlon. My Executors and Trustee and successors in office shall have the power to
compromise, adjust, and settle any claims by or against my estate upon such terms as are deemed
advisable, and to make dlstrlbution under thls will in klnd or money, or partly in kind and partly in
money. My Trustee for the property at 923 WillcliffDrive shall be governed by the provisions of
Section i3.4 o/the Prenuptlai Agreement mentioned above. The powers enumerated in this
Article are not intended and shall not be construed in any respect as limitation of any powers
conferred upon my Executor or Trustee and the successors in office by law, but are intended and
shall be construed as in addition thereto.
Article IX
I hereby nominate, constitute, and appoint my wife, Margaret, and my son, Barton Porter
KnIght Toms, of Lansdowne, Deiaware County, Pennsyivania, as Co-Executors oltiUs, my Last
Will and Testament, and I appoint my son Barton as Trustee of the Trust herein created. Should
Barton for any reason :fiUi or cease to act as Executor or Trustee hereunder, then and. thereafter I
nominate, constitute, and appoint as successor Executor and/or trustee hereunder, my son,

PRENUPTIAL AGREEMENT
MADE AND CONCLUDED this \d\'\ day of j\1v'\'~ , 1998, by and between MARGARET
P. PORR of811 Carol Circle New Cumberland, PA 17070-1418, (hereinafter referred to as
"Intended Wife"), and, JAMES EDWIN TOMS of 923 WillcliffDrive Mechanicsburg, PA,
(hereinafter referred to as "Intended Husband.")
WITNESSETH THAT
WHEREAS, the: parties hereto desire to enter into the within Agreement in contemplation and
consideration of their forthcoming marriage; and
WHEREAS, each of the parties hereto has substantial property and income and each of them has
a child or children by a previous marriage, as a result of which each desires to be able freely to
dispose of his or her property during their respective lifetimes and by their respective Wills, and
each therefore, desires to give up and surrender all rights which he or she might have in the
property of the other as a result of the planned marriage.
NOW, THEREFORE, KNOW ALL MEN AND WOMEN, that the parties hereto, intending to
be legally bound hereby, do by these presents covenant and agree as follows:
SECTION 1. Intended Wife does hereby covenant and agree that she has been fully
advised and has full knowledge concerning the rights and property to which she would be
entitled in the estate of Intended Husband after their marriage, during his lifetime, and in the
event that she should survive him.
SECTION 2. Intended Husband does hereby covenant and agree that he has been fully
advised and has full knowledge concerning the rights and property to which he would be entitled
in the estate of Intended Wife after their marriage, during her lifetime, and in the event that he
should survive her.
SECTION 3. Intended Husband does hereby acknowledge that Intended Wife has
informed him prior to the execution of this Agreement, that a fair approximation of the value of
the assets presently comprising her ~state is set forth in Exhibit" A" attached hereto and made a
part hereof.
SECTION 4. Intended Wife does hereby acknowledge that Intended Husband has
informed her prior to the execution of this Agreement, that a fair approximation of the value of
the assets presently comprising his estate is set forth in Exhibit "B" attached hereto and made a
part hereof.
SECTION 5. Each of the parties hereto does hereby acknowledge that she or he is fully
aware of the fact that the value of the respective estates of the parties hereto as set forth in the
attached Exhibits "A" and "B," are estimates only and each of the parties does hereby declare
that this Agreement would be executed by him or her regardless of the size of the estate of the
other party hereto.
SECTION 6. Intended Wife does hereby agree that in the event of her marriage to
Intended Husband, she hereby waives and releases all her right and interest, statutory or
otherwise, including but not limited to dower, widow's allowance, family exemption, statutory
allowance, distribution in intestacy, and the right of election to take against the Will of Intended
Husband as the wife, widow, heir, next of kin or distributee of Intended Husband in his property,
owned by him at the time of the execution of this Agreement or acquired by him at any time
hereafter, and in his estate, upon his death, other than the property rights as are created and
agreed upon und~r this Agreement.
SECTION 7. Intended Husband does hereby agree that in the event of his marriage to
Intended Wife, he hereby waives and releases all his right and interest, statutory or otherwise,
including but not limited to curtesy, widower's allowance, family exemption, statutory
allowance, distribution in intestacy, and the right of election to take against the Will. of Intended
Wife as husband, widower, heir, next of kin or distributee of Intended Wife in her property,
owned by her at the time of the execution of this Agreement or acquired by her at any time
hereafter, and in her estate, upon her death, other than the property rights as are created and
agreed upon under this Agreement.
SECTION 8. Each of the parties hereto, in the event of their marriage to each other,
shall have the absolute right to manage, dispose of, or otherwise deal with any property now
separately owned, or hereafter separately acquired, in any manner whatsoever. In order to make
this provision effective, each of the parties hereto does agree that in the event that his or her
signature shall be necessary on any document in order to transfer title to any asset separately held
by either party at any time hereafter, the party whose signature is so required shall sign,
acknowledge, and deliver such document, without the receipt of any consideration therefor, at the
request of the other party.
SECTION 9. Each of the parties hereto does specifically waive all rights to any incidents
or benefits connected with or accumulated through the other's employment. Intended Husband
hereby relinquishes any rights to any pension plan, profit-sharing plan, or other retirement
benefit, whether tax qualified or nonqualified, available to Intended Wife. Intended Wife hereby
relinquishes any rights to any pension plan, profit-sharing plan, or other retirement benefit,
whether tax qualified or nonqualified, available to Intended Husband. Either party shall, upon
request of the other or his or her personal representative(s), consent to any beneficiary
designations or other directives executed by the other party with respect to the payment of
benefits from any retirement, pension, profit-sharing, or other plan governed by the Employee
Retirement Income Security Act of 1974, as amended.
SECTION 10. Neither party to this Agreement shall be responsible for any debts
incurred by the other party prior to the date of the marriage. Any such debt shall remain the sole
and separate obligation of the party who incurred the debt. Liabilities of each party are reflected
in exhibits "A" and "B" respectively. Similarly, all debts and obligations incurred by either party
subsequent to the marriage shall be and remain the sole and separate obligation of the party who
incurred the debt, unless the debt is incurred for an item that is necessary for the ordinary care
and maintenance of both parties and of the marital household, or unless the other party agrees in
writing to assume joint liability for the debt.
SECTION 11. Each of the parties hereto agrees that in the event that he or she should
survive the other, he or she will, upon the request of the personal representative of the estate of
the deceased party, execute and file an election to take under the Will of the deceased party .
SECTION 12. Each of the parties hereto does hereby specifically waive the right to take
out Letters of Administration in the estate of, or otherwise become the personal representative of
the estate of the other.
SECTION 13.
13.1 The parties agree that all property presently owned by either of them or acquired
by either of them hereafter of whatsoever nature and wheresoever located and all income derived
therefrom and all increases in the value thereof, shall be and remain their separate property. The
parties agree that at no time during their relationship shall there be any transmutation of any of
their separate property interests into jointly owned property, except by an express written
agreement of transmutation. The following events shall not be evidence of any intention by
either party or an agreement between the parties to transmute their separate property interests into
jointly owned property or to transmute their separate income into joint income:
13.1.1 the filing of joint tax returns of any kind;
13.1.2 the designation of one party by the other as a beneficiary of his or her
estate;
13.1.3 the co-mingling by one party of his or her separate funds or property with
jointly owned funds or property or with separate funds or property of the other party;
13.1.4 any oral statement or promise by either party;
13.1.5 any written statement by either party other than the express written
agreement of transmutation or a deed expressly referring to an agreement of husband and
wife to transmute property previously owned separately;
13.1.6 the payment from jointly held or separately held funds of any separate
obligation, including but not limited to the payment of mortgage installments, interest Of
real property taxes on a separately owned residence or other separately owned real estate
or personal property;
13.1.7 the joint occupation ofa separately owned or leased residence.
13.2 The foregoing notwithstanding, the parties may establish a joint checking account
for the purpose of facilitating the management of expenditures associated with the maintenance
of the marital household. That account may pass to the survivor of Intended Wife and Intended
Husband if the balance in that account approximates one month's marital household
expenditures.
13.3 The foregoing notwithstanding, the parties may, by schedule, as prepared and
updated from time-to-time and endorsed by the parties, and referred to in the will of Intended
Wife and the will of Intended Husband, treat certain identified household effects as tangible
personal property owned as tenants by the entireties.
13.4 The foregoing notwithstanding, the parties may purchase a principal marital
residence as tenants-in-common. With respect to that principal marital residence, each party
shall grant the other, as survivor of Intended Wife and Intended Husband, preferably through the
establishment of a testamentary or inter vivos trust, the right to occupy the principal marital
residence as a residence for so long as the survivor chooses to occupy the residence.
13.4.1 The survivor, so long as he or she survives and chooses to occupy the
residence, shall be responsible for all expenses related to the maintenance and upkeep of
the residence including, without limitation: utilities; repairs; real estate taxes; and,
insurance premiums.
13.4.2 The trustee, or other owner or remainder interest holder, shall be
responsible for capital repairs and improvements and special assessments and may
fmance such obligations, in trustee's or owner's sole discretion, through: a mortgage;
rental charges to the survivor; an assessment against the survivor; or a combination
thereof.
SECTION 14. Notwithstanding the provisions of the Agreement, either party shall have
the right to convey to the other any property or interest therein which may be lawfully conveyed
or transferred during his or her lifetime or by Will or otherwise upon death, and neither party
intends by this Agreement to lhnit or restrict in any way the right and power to receive any such
transfer or conveyance from the other.
SECTION 15. Each of the parties hereto specifically waives, relinquishes, and releases
any and all rights, claims, or demands against the other and in the estate of the other for spousal
support, alimony pendente lite, permanent alimony and the payment of court costs and counsel
fees in the event of their separation or divorce.
SECTION 16. In addition to the agreement of the parties hereto to execute conveyances
upon the request of the other, as set forth in Section 8 of this Agreement, each party hereto shall,
upon the request of the other, execute, acknowledge, and deliver any additional instruments that
may reasonably be required to carry the intention of this Agreement into effect, including such
instruments as may be required by the laws of any jurisdiction, now in effect or hereafter to be
enacted, which may affect the property rights of the parties as between themselves or with others.
SECTION 17. The consideration for this Agreement is the marriage contemplated by the
parties and the mutual covenants herein contained. It shall take effect upon the solemnization of
the marriage now contemplated by the parties to this Agreement. Each of the parties specifically
agrees that despite the provisions of Section 2507(3) of the Probate, Estates and Fiduciaries code
of Pennsylvania, or a similar provision under the laws of any other state, any Will executed by
either of the parties before the marriage shall be fully effective according to its terms after the
marnage.
SECTION 18. If either party breaches any provision of this Agreement, the other party
shall have the right, at his or her election, to either sue for damages for such breach, and the party
breaching this contract shall be responsible for payment of legal fees and costs incurred by the
other in successfully enforcing rights under this Agreement, or to seek such other remedies or
relief as may be advisable to him or her.
SECTION 19. This Agreement is executed in four originals of which this is original
Number Four. Of the four originals only Number One and Number Two contain Exhibits "A"
and "B." Number Three and Number Four are acknowledged by the parties hereto in order to
permit recording. Of the four originals Intended Wife shall receive those numbered One and
Three and Intended Husband shall receive those numbered Two and Four. It is specifically
agreed by and between the parties hereto that neither original Number One nor original Number
Two of this Agreement shall be recorded or filed in any public office in Pennsylvania or
elsewhere, at any time prior to the death of one of the parties hereto. It is further agreed that
Intended Wife may record or otherwise file original Number Three and that Intended Husband
may record or otherwise file original Number Four, at any time, in any office for the recording of
deeds or other filing office in Pennsylvania or elsewhere, and that all persons dealing with either
of the parties hereto shall be entitled to consider originals Number Three and Four, as so filed or
recorded without Exhibits "A" and "B" attached, as the entire Agreement between the parties
hereto, and fully enforceable according to its terms, despite the absence of Exhibits "A" and "B."
SECTION 20. The provisions of this Agreement and their legal effect are fully
understood by the parties hereto, Intended Wife having had such provisions explained to her by
Lawrence F. Hinnenkamp, Esquire and Intended Husband having had such provisions explained
to him by Gene H. Anderson, Esquire.
SECTION 21. This Agreement contains the entire understanding of the parties and no
representations or promises have been made except as contained herein.
SECTION 22. This Agreement shall be construed and governed in accordance with the
laws of the Commonwealth of Pennsylvania.
SECTION 23. This Agreement shall bind and inure to the benefit of the parties hereto
and their respective heirs, personal representatives, and assigns, and shall be fully enforceable
regardless of the reasonableness or unreasonableness of its provisions agreeably to the law as set
forth in Simeone v. Simeone 525 Pa. 392,581 A.2d 162 (1990) whether or not said case has been
distinguished, overruled or rendered ineffective by legislation.
IN WITNESS WHEREOF, the parties hereto have signed these presents under seal, the day and
year first above written.
