THIS AGREEMENT made the / day of ~'~"~y 2008, between
Timothy S. Hake, hereinafter referred to as Contractor,

Timothy S. Hake and Jean Hake, hereinafter referred to as Owner.
WHEREAS Contractor has undertaken and agreed to erect and construct a
building on that certain lot of ground situate in Silver Spring Township, Cumberland
County, Pennsylvania, more particularly described in Exhibit A, attached herewith.
NOW THEREFORE THIS AGREEMENT WITNESSETH:
That the said Contractor, for and in consideration of the sum of ONE ($1.00)
DOLLAR in hand paid to it by Owner, the receipt whereof is hereby acknowledged, and
the further consideration mentioned in the agreement aforesaid, for itself and its
subcontractors, and all parties acting through or under it or them, covenant and agree that
no mechanic's liens of claims shall be filed or maintained by it or any of them against the
said buildings and the lot of ground thereto for or on account of any work done or
materials furnished by it or any of them under said contract or otherwise, for, towards, in
or about the erection and construction of the said buildings on the lot above described,
and the said Contractor, for itself, its subcontractors and others under it hereby expressly
waives and relinquishes the right to have, file, and maintain any mechanic's liens or
claims against the said buildings or any of the improvements, and agrees that this
instrument, waiving the right of lien, shall by an independent covenant.
IN WITNESS WHEREOF, the parties hereto intending to be legally bound have hereunto
set their hands and seals the day and year first above written.

EXHIBIT A
ALL THAT CERTAIN tract or parcel of land situate in Silver Spring Township,
Cumberland County, Pennsylvania, more particularly bounded and described as follows:
BEGINNING at a point, which point is located on the dedicated right of way line of
Beard Road at the dividing line of Lot No. 2 and Lot No. 3 as depicted on the below
referenced Final Subdivision Plan; thence by said dividing line North 78 degrees 25
minutes 56 seconds East a distance of 465.46 feet to a point at the dividing line of lands
now or formerly of Oliver Rosenberg and Lot No. 3 herein described; thence by said
dividing line South 8 degrees 30 minutes 00 seconds East, a distance of 467.26 feet to a
point on the dividing line of land now or formerly of C.J. Kramer and Lot No. 3 herein
described; thence by said dividing line South 79 degrees 15 minutes 00 seconds West a
distance of 440.50 feet to a point on the dedicated right of way line of Beard Road;
thence by the dedicated right of way line of Beard Road, North 11 degrees 34 minutes 04
seconds West a distance of 460.30 feet to a point on the dedicated right of way line of
Beard Road, the place of Beginning.
CONTAINING 4.82 acres
BEING LOT NO.3 as shown on the Final Subdivision Plan of the Estate of Blanche M.
Beard, recorded in the Office of the Recorder of Deeds in and for Cumberland County,
Pennsylvania on December 21, 2000 in Plan Book 82, Page 73.
BEING THE SAME PREMISES which Jeffrey M. Verrecchio and Candice A.
Verrecchio, husband and wife, by Deed dated March 2, 2007 and recorded March 8, 2007
in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in
Record Book 279, Page 239, granted and conveyed unto Timothy S. Hake and Jean Hake,
husband and wife.
UNDER AND SUBJECT to restrictions and conditions as now appear of record.
