COMES NOW, the Petitioner, Robert A. Martin and Karen D. Winter, Executors of the f')

Estate of Robert L. Martin, deceased by and through their counsel, Sally J. Winder,
Esquire and do Petition the Court for approval of the sale of real estate as follows:
1. The Decedent died seized of property known and numbered as 23 Firehouse
Road, South Newton Township, Walnut Bottom, Cumberland County,
Pennsylvania, title to which is evidenced by deed dated July 25, 1968, recorded in
Cumberland County, Deed Book "W", Volume 22, Page 232, copy of which is
marked Exhibit"A" attached hereto and incorporated herein by reference thereto.
2. Petitioners, Robert A. Martin and Karen D. Winter were appointed as Executors
of the Estate of Robert L. Martin, deceased by Letters Testamentary issued by the
Register of Wills, Cumberland County, Pennsylvania, August 6,2007.
3. Petitioners are the children of Robert L. Martin, deceased, and are the
beneficiaries of the Estate as set forth in Item II of the Last Will and Testament of
Robert L. Martin, a copy of which is marked Exhibit "B" attached hereto.
4. The Petitioner in their capacity as Executors have obtained a real estate appraisal
of the property from Charles L. Wenger, a real estate broker licensed to conduct
such appraisals, presently associated with, and a partner, in the firm of George L.
Ebener & Associates Pealtors, having a business address of 430 East King Street,

Shippensburg, P A 17257, a copy of said appraisal being marked Exhibit "C"
attached hereto and incorporated herein by reference.
5. The appraisal of the property shows a market value of the property at 23
Firehouse Road, Walnut Bottom, PA of$110, 250.00.
6. The Cumberland County Assessment Office records show an assessed value of a
total current value for the property of $92,900.00 which is consistent with the
appraisal of Charles L. Wenger.
7. It is the desire of the Executors and beneficiaries of the Estate of Robert L. Martin
to deed the property to Robert A. Martin, one of the Executors and beneficiaries
ofthe Estate at a value of$110,250.00 which shall be reckoned in the accounting
and distribution of the net assets of the Estate as the sale price and value of the
real estate situate at 23 Firehouse Road, Walnut Bottom, PA, and shall be so
reflected on the Inheritance tax return filed in the Estate.
8. The Executors and beneficiaries of the Estate of Robert L. Martin have joined in
this Petition verifying the Petition to be true and correct and joining in the request
for Order of Court approving the private sale and conveyance of said property in
accordance with the terms set forth above.

WHEREFORE, the Petitioners pray this Honorable Court enter an Order confirming
sale and conveyance of 23 Firehouse Road, Walnut Bottom, PAin accordance with
the terms of this Petition.

In accordance with your request by phone and then by fax. I personally inspected the above
captioned property with their son Robert Martin on October I, 2007, to estimate the Market
Value of the property.
Market Value is defined as "The most probable price which a property should bring in a
competitive and open market under all conditions requisite to a fair sale, the Buyer and Seller
each acting prudently and knowledgeably and assuming the price is not affected by undue
stimulus."
The value shown had been arrived at after careful study of the location, type of improvements,
their physical condition and their present use. Therefore, I believe it to reflect a true measure of
the Market Value as of July 9, 2007.

The subject property is located 4 miles east of Shippensburg off Route 174
approximately 0.3 mile on the eastside of Fire House Road.
The purpose of the appraisal is to estimate Market Value of the property as of
July 9, 2007, the date ofRobertL. Martin's death.
Market Value is defined as "at a given time, the highest price estimated in terms
of money which a Buyer would be warranted in paying and a Seller justified in
