COMPLAINT
AND NOW comes the Plaintiff, by and through her attorney, John R. Beinhaur, Esquire, of
BEINHAUR & CURCILLO, and files the following Complaint aga'mst the Defendant:
1. The Plaintiff, Donna Fleetwood ("Fleetwood") is an adult individual, suijuris, with a
business address at 161 Old Schoolhouse Lane, Mechanicsburg, Pennsylvania, 17055.
2. The Defendant Haubert Land and Improvements Company ("Haubert Company") is a
Pennsylvania corporation with a business address at 2601 North Second Street,
Harrisburg, Pennsylvania, 17110.
3. The Defendant Don Haubert, Jr. ('~Iaubetl") is an adult individual, suijuris, with a business
address at 2601 North Second Street, Harrisburg, Pennsylvania, 17110.
4. On or about May 23, 2002, Haubert executed a "Statenaent of Estimated Sellers' Costs'.
A copy of which is attached hereto as Exhibit "A" and incorporated herein by reference.
5. While the document speaks for itself; the "Statement of Estimated Sellers' Costs" indicates
a Real Estate Commission due and owing fi.om Haubert in the amount of $10,500.00.
6. Haubert's signature indicates his assent to the stated commission.
7. The Real Estate Commission of $10,500.00 is due and owing to Donna Fleetwood, a
licensed real estate agent with ReMax Realty Associates, Inc.
8. Donna Fleetwood completed or substantially completed her duties as alicensed real estate
agent, thus fulfilling her performance and earning the stated commission.
9. The commission was earned when Haubert and Haubert Company furnished a custom
two-story home on property known as Lot 6, Miller Boulevard, Monroe Township,
Cumberland County, Pennsylvania.
10. The said custom home has been completed and the Buyers now occupy the property.
11. Haubert and Haubert Company, despite promises ofpaymant and repeated demand fxom
Fleetwood, failed and refuse to make payment of the earned commission.
WHEREFORE, claim is hereby made by the Plaintiff, Donna Fleetwood, for the amount ofTen
Thousand Five Hundred ($10,500.00) Dollms plus costs and interest on thejudgmant and such otherrelief
as the Court may deem appropriate, which amount is below the mandatory arbitration figure set forth by
locai nde, against Haubert Land Development Company, or, in the alternative, against Don Haubert, Jr.,
or, in the aitemative, jointly and severally against both Haubert Land Development Company and Don
Haubert, Jr.
