Helmuth respectfully represents: That she resides at 150 Fairview Drive, Pennsylvania 17013, in this county. Carlisle, Middlesex Township, That she currently possesses a valid driver's license which has not heretofore been suspended, canceled or revoked. That on October 18, 2001, she was notified by the Department of Transportation that her driver's license had been suspended for the following reason as set forth in the notice: violation of Section 3345A of the Vehicle Code, Passing a School Bus. A copy of said Notice is marked as Exhibit "A" and attached hereto. That said suspension is improper for the following reasons: The underlying conviction of Section 3345A has been appealed from District Justice Susan K. Day to The Court of Common Pleas of Cumberland County on October 31, 2001. A trial de novo will be held at 01-2271 Criminal in the Court of Common Pleas. A copy of said Notice of Appeal is attached hereto and marked as Exhibit "B". The suspension of Petitioner's license is improper until the case at 01-2271 is completed. If the Petitioner is acquitted of said charges, the license suspension would not take place. The Petitioner, Karen E. Helmuth, requ~ts that the Court issue a supersede, as to prohibit the suspension of her license until this case and the Appeal docketed to Cumberland County Criminal number 01-2271 is resolved by the Court. Your petitioner, therefore, prays that this matter be set down for hearing de novo before Your Honorable Court as provided by 75 Pa. C.S.A. Section 1547 and Section 1550 and 42 Pa. C.S.A. Upon receipt, review and acceptance of your Pennsylvania driver's license(s), learner's permit(s), and/or a sworn notarized letter, PennDOT will send you a receipt con- firming the date that credit began. If you do not re- ceive a receipt from us within 3 weeks, please contact our office. Otherwise, you will not be given credit toward serving this suspension. If you do not return all current driver license pro- ducts, we must refer this matter to the Pennsylvania State Police for prosecution under SECTION 1571(a)(q) of the Pennsylvania Vehicle Code. PAYING THE RESTORATION FEF You must pay a restoration fee to PennDOT to be restored from a suspension/revocation of your driving privilege. To pay your restoration fee, complete the following steps: 1. Return the enclosed APplication for Restoration. The amount due is listed on the application. 2. Nrite your driver's license number (listed on the first Page) on the check or money order to ensure proper credit. Follow the Payment and mailing instructions on the back of the application. 0128fi9283387001 PROVIDING PROOF OF INSURANCE Within the last 30 days of your suspension/revocation, we will send you a letter asking that you provide proof of in- surance at that time. This letter will list acceptable documents and what will be needed if you do not own a vehicle registered in Pennsylvania.
