WHEREAS, On the day of /(~_g~ , 2003, an agreement was
entered into between HUTCH HOMES, INC., owner of a certain tract of Land known as 4010
Pamay Drive, Meehanicsburg, Cumberland County, Pennsylvania and HUTCH HOMES INC., a
Pennsylvania corporation of 414 S. York Street, Mechanicsburg, Pennsylvania, wherein and
whereby the said HUTCH HOMES, INC. undertook and agreed to erect and construct a residential
dwelling house upon a lot of land situate at 4010 Pamay Drive, Meehanicsburg, Cumberland County,
Pennsylvania, more particularly described in Exhibit A attached hereto.
N OW, Therefore, This Agreement Witnesseth, that thc said HUTCH HOMES, INC. for
and in consideration of the sum of One Dollar, to it paid by the said HUTCH HOMES, 1NC., the
receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement
aforesaid, for itself and its subcontractors, material men or workmen and all parties acting through or
under it, covenants and agrees that no mechanic's claims or liens shall be filed or maintained by it,
them or any of them against the said buildings and the lot of ground appurtenant thereto, or any of
them, for or on account of any work done or materials furnished by it, them, or any of them, under
said contract or otherwise, for, towards, in or about the erection and construction of the said
buildings, or any oftbem, and the said HUTCH HOMES INC., for itself and it's subcontractors, and
others under it, hereby expressly waives and relinquishes the right to have, file or maintain any
mechanic's lien or claim against the said buildings, and lot of ground appurtenant thereto or any of
them, and agrees that this agreement waiting the right of lien shall be an independent covenant.

PROPERTY DESCRIPTION
The land referred to in this Commitment is described as follows:
ALL THAT CERTAIN tract of land situate in Hampden Township, Cumberland County, Pennsylvania, being Tract
1, Lot 6, as shown on the Plan entitled Phase IV, Final Subdivision Plan of Kingswood, dated June 1988,
recorded in Cumberland County Plan Book 56, at page 89, revised by Plan dated February 1989 and recorded
in Plan Book 57, at page 82, more particularly bounded and described as follows, to wit:
BEGINNING at a point on the Westerly sideline of Pamay Drive, a fifty foot (50') public right-of-way, at the
dividJng line between Lot No. 5 and Lot No. 6 as shown on the aforesaid plan, thence by Lot No. 5, North
seventy-two degrees eleven minutes ten seconds West (N 72 degrees 11 minutes 10 seconds W), a distance of
one hundred forty-eight and forty-one one hundredths feet (148.41) to a point on the Easterly dedicated
right-of-way line of Orr's Bridge Road, a sixty foot (60') public right-of-way; thence by the same South four
degrees seven minutes twenty seconds East (S 04 degrees 07 minutes 20 seconds E), a distance of one
hundred forty-four and eleven one hundredths feet (144.11') to a point: thence by Lot No. 7 as shown on said
plan North eighty-five degrees fifty-~vo minutes forty seconds East (N 85 degrees 52 minutes 40 seconds E), a
distance of one hundred twenty-five feet (125') to a point on the westerly sideline of Pamay Drive; thence by the
same North four degrees seven minutes twenty seconds West (N 04 degrees 07 minutes 20 seconds W), a
distance of twenty-three and twenty-nine one hundredths feet (23.29') to a point; thence by the same by the are
of a curve to the dght having a radius of one hundred seventy-five feet (175'), an arc length of sixty-seven feet
(67') to a point; the place of BEGINNING.
