EST A TE SETTLEMENT AGREEMENT
THIS ESTATE SETTLEMENT AGREEMENT (herein referred to as "Agreement") is
made as ofth~~y of December, 2007, between GLORIA STITES, Executrix ofthe Estate
of Donald J. Blessing (herein referred to as "Executrix" and "Estate"), and GLORIA STITES,
AMY STITES MacADAM, JONATHAN GEORGE PATRICK MacADAM, AND ALISON C.
MacADAM, residuary legatees and beneficiaries of the Estate (herein referred to as
"Beneficiaries").
In accordance with their desire that the administration of the Estate be completed, and in
consideration of the mutual covenants expressed, the stated Executrix and Beneficiaries, intending
to be legally bound, acknowledge and agree, as follows:
1. Donald 1. Blessing died on February 14,2006.
2. Letters Testamentary were granted unto Gloria Stites, as Personal Representative or
Executrix by the Register of Wills of Cumberland County, on March 15,2006. Jeffrey R. Boswell,
Esquire, has served as legal counsel.
3. In March, 2006, counsel prepared and arranged for the publication ofthe required legal
advertisements in The Sentinel and the Cumberland Law Journal, which proofs of publication are
attached as Exhibit "A" and "B."
4. The Executrix established an estate checking account at PNC Bank (Acct. No. XX-
XXXX-3888), transferred the balance to various joint accounts into the estate account, and paid
therefrom all debts, expenses of administration, income tax, and inheritance tax.

5. The decedent and his sister had various joint accounts, with the balances at February 14,
2006, and at closing, as follows:

6. Each Beneficiary of the Estate acknowledges receipt of the Rule 5.6 Notice regarding
notice of his or her respective beneficial interest in the Estate. Counsel prepared a Certification of
Notice Under Rule 5.6 (a) and filed same with the Register of Wills of Cumberland County, on
June 8, 2006.
7. The decedent owned certain tangible personal property that was distributed to his sister,
Gloria Stites. Some personal property items were sold with a value of $600.00.
8. The decedent, in his Last Will and Testament, item SECOND, provided for the
distribution of his residuary estate to the Beneficiaries, as follows:
20% to my niece Amy Stites Mac Adam, and
15% to her son, Jonathan George Patrick Mac Adam, and
15% to her daughter, Alison C. Mac Adam, and
50% to my sister, Gloria Stites
9. The Executrix worked with counsel to complete the estate administration, including the
payment of all debts, expenses of administration, and inheritance tax. Counsel prepared for the
Executrix's review and execution the Pennsylvania Inheritance Tax Return (REV-1500), which
counsel then filed with the Register of Wills of Cumberland County on July 2, 2007, making
payment to the Cumberland County Register of Wills, Agent, in the amount of $7,568.78, on
account ofInheritance Tax. Thereafter, the Pennsylvania Department of Revenue, Inheritance Tax
Division, reviewed the Pennsylvania Inheritance Tax Return and issued a Notice ofInheritance Tax
Appraisement, dated September 17, 2007, accepting the return as filed, assessing $32.13, which

payment was made on September 25, 2007. Thereafter, the Department of Revenue, Inheritance
Tax Division, issued a subsequent Notice ofInheritance Tax Appraisement and final statement
showing zero tax due and owing. On November 16,2007, counsel received from the Department
of Revenue an Inheritance Tax Statement of Account, dated October 29,2007, showing a zero
balance. Thus, all inheritance tax issues are settled with the inheritance tax paid in full.
10. All taxes and administrative expenses were paid, and all necessary administrative
details were properly completed.
11. The Executrix has transferred all funds into the estate checking account, including the
total value of joint accounts, PNC Bank Account No. XX3888, with a balance at period ending
December 14,2007, of$221,187.84.
12. The Executrix has paid or will pay from the estate checking account, PNC Bank
Account No. XX3888, $114,497.45, to Gloria B. Stites, individually, the surviving joint tenant of
the jointly-owned accounts, declared in the P A Inheritance Tax Return (Schedule F), as follows:

13. The Executrix will make final distribution of the net cash assets of the Estate to the
Beneficiaries upon execution by all parties of this Agreement, as follows:
20% Amy Stites Mac Adam $22,927.80
15% Jonathan George Patrick Mac Adam $17,195.86
15% Alison C. Mac Adam $17,195.86
50% Gloria Stites $49,370.87
Gloria Stites' distribution includes $49,370.87 cash and personal property with a value of
$7,946.65, for a total distribution of$57,317.52.
14. Jeffrey R. Boswell, Esquire, as counsel, will file a copy of this Estate Settlement
Agreement, noting that the estate administration is complete, attaching same to the final Rule 6.12
Report.
15. Gloria Stites, Executrix ofthe Estate, acknowledges that if it is determined that ifthere
is any additional tax liability (including interest and penalties) or any other proper debt, Gloria
Stites, Executrix of the Estate, will pay only such amount that is proper.
16. The parties, and each of them, agree to return to the Estate from his or her respective
distribution any proportionate share so the Executrix can pay any expense, debt, and/or tax,
received and determined to be proper for payment after distribution to the Beneficiaries, which
total amount to be returned to the Estate shall not exceed the total distribution paid to the
Beneficiaries.
17. The parties, and each of them, hereby forever fully release, compromise, settle, and
discharge any and all claims, demands, actions, or causes of action, legal or equitable, absolute or
contingent, vested or hereafter to accrue, which any of them may have against each other and any
other party hereto or against the Estate, or the agents of the estate, including the Executrix, her
accountants and attorneys, by reason of any matter, cause or things growing out of or relating to
any property or assets of said estate, or growing out of or relating to any act of the Executrix in her
administration ofthe said estate, even if attributable to negligence, and agree that any period ofthe

limitation as to actions on claims and distributions shall commence only at such time as the
Executrix shall have obtained actual knowledge of said claims or distributions, which period shall
end two (2) years after actual discovery.
18. Each party agrees that this Agreement shall be an Acknowledgment and Release as
to the payment of estate debts, expenses of administration and inheritance tax, and his or her
respective receipt of the proper distributive share of net estate assets.
19. Each party agrees to execute such additional documents and releases as the Executrix
may submit to him, her, or them in order to complete any administrative details and to confirm
discharge of the Executrix, her accountants and attorneys, from any further liability to the parties
in connection with this Estate.
20. This agreement may be executed in multiple counterparts and, when so executed, shall
be binding upon all parties, and their respective heirs, next of kin, personal representatives, and
assIgns.
