Cooper; upon the Notice required pursuant to ~3 7.1-134.12 and ~3 7.1- 134.13 of the Code of Virginia, 1950, as amended; upon the evaluation reports of Dr. David Chernoff and Dr. Joseph Mason; Upon the Notice of Filing ofthe aforesaid evaluation reports; upon the Order of Appointment of Randal T. Perdue, a discreet and competent Attorney practicing in the Commonwealth of Virginia as Guardian ad Litem for the Respondent; upon the Statement of Compliance required pursuant to ~3 7 .1-134.1 O(E) of the Code of Virginia, 1950, as amended; upon personal service upon the Respondent of the Petition, Notice, and Order of Appointment of a Guardian ad Litem; upon the Report of the Guardian ad Litem; upon the Answer of the Respondent filed by the Guardian ad Litem; and upon evidence taken ore tenus. IN CONSIDERATION WHEREOF, by clear and convincing evidence, it appears: 1) That the Respondent is an incapacitated person as defined by ~37.1-134.6 of the Code of Virginia, 1950, as amended. 2) That the nature of the Respondent's incapacity is primarily mental in nature. 3) That the Respondent is not capable of caring for herself, making medical decisions, or managing her affairs and that she is in need of a guardian and conservator. 4) That there is no reasonable probability of improvement of Respondent's condition \' in the foreseeable future. 5),That the Petitioner is the responsible and appropriate person to serve as guardian and conservator for the Respondent. It is accordingly, ORDERED, ADJUDGED and DECREED: 1) That the Petitioner herein is appointed as Guardian for the Respondent and shall exercise all powers and duties available pursuant to ~37.1-137.1 of the Code of Virginia, 1950, as amended. 2) That the Petitioner shall make those reports required by ~37.1-137.2 of the Code of Virginia, 1950, as amended. 3) That the Petitioner is appointed as Conservator of the Respondent's estate, and shall exercise all powers and duties available pursuant to ~37.1-137.3, ~37.1-137.4, and ~37.1- 13 7.5 of the Code of Virginia, 1950, as amended. 4) That the appointment of the Petitioner as Guardian and Conservator is unlimited in duration, provided, that Respondent may, pursuant to ~37.1-134.16 of the Code of Virginia petition this Court to modify or rescind the terms and conditions of the appointment. 5) That the Petitioner is required to enter a bond before the Clerk of this Court in the sum and penalty of ~rtt. ~r.:;:) ~\.\'-~\.'\ \"'-'II~,-d ~ aOkoo dollars ($1:.\,:CC:o:O ), with surety, for his faithful performance of his duties as conservator and guardian. e1:> 6) That the Guardian ad Litem shall be paid the sum of $ ~ ~ =-- for his services to be paid from the Respondent's Estate. 7) The attorney's fees of the Petitioner, plus the costs incurred in pursuing this action and satisfying the obligations of this Order, shall be paid form Respondent's estate. 8) It is further ORDERED that the Clerk of the Court s all rnd a certified copy of this Order to all Counsel of Record.
