TO THE HONORABLE JUDGES OF THE SAID COURT:
The Petition of Merle C. Ruble respectfully represents that:
1. The name of the alleged incapacitated person is Irene Mae Ruble (hereinafter referred to as "Mrs.
Ruble"). Since, on or about April 2, 2001, Mrs. Ruble has been a resident of The Masonic Homes, a private
facility offering specialized assisted living care, located at One Masonic Drive, Elizabethtown, Lancaster
County, Pennsylvania 17022. Prior to that, Mrs. Ruble resided at 1700 Sherwood Road, New Cumberland,
Cumberland County, Pennsylvania 17070 since 1953. Mrs. Ruble is 76 years old, having been born on April 9,
1925.
2. The Petitioner is Merle C. Ruble, an adult individual who resides at 1700 Sherwood Road, New
Cumberland, Cumberland County, P A 17070. Petitioner is the husband of Irene Mae Ruble.
3. The names and addresses of Mrs. Ruble's next of kin and presumptive adult heirs are:
(a) Husband: Merle C. Ruble, 1700 Sherwood Road, New Cumberland, P A 17070; telephone
(717) 774-6876;
(b) Daughter: Deborah Lynn Pomeroy, 444 Brook Circle, Mechanicsburg, P A 17050;
telephone (717) 730-9848;
(c) Daughter: Denise Maria Ruble, 2150 Wexford Road, Palmyra, PA; telephone (717) 533-
7029.
4. Mrs. Ruble has a Last Will and Testament dated April 26, 1977 which names her husband as
primary beneficiary and her daughters, named above, as the class of residuary heirs to take per stirpes.
5. The estate of Mrs. Ruble is comprised of both real and personal property. Petitioners estimate
the real property, which consists ofthe marital residence in the names of Merle C. and Irene M. Ruble as tenants
by the entireties, as having an approximate value of Seventy Thousand and 00/100 Dollars ($70,000.00) .
Personal property known to the Petitioners includes household goods and furnishings, also held as tenants by the
entireties. Petitioners believe that Mrs. Ruble owns bank accounts and investment accounts in the approximate
amount of Two Thousand Four Hundred and 001100 Dollars ($2,400.00). Petitioners believe that Mrs. Ruble
receives a monthly pension and Social Security benefits in the approximate amount of Four Hundred Forty
Seven and 00/100 Dollars ($447.00) per month. The extent of Mrs. Ruble's other personal property is not
known by Petitioners at this time.
6. Mrs. Ruble was never a member of the Armed Services of the United States, nor is she receiving
any benefits from the United States Veterans' Administration.
7. Petitioner avers that Mrs. Ruble is incapacitated as defined in Chapter 55 ofthe Pennsylvania
Probate, Estates and Fiduciaries Code in that her ability to receive and evaluate information effectively and
communicate decisions in any way is impaired to such a significant extent that she is partially or totally unable
to manage her financial resources or to meet essential requirements for her physical health and safety.
8. The proposed permanent guardian is the Petitioner ,Merle C. Ruble. His acceptance is attached
as Exhibit "B".
9. The proposed guardian has no interest adverse to Mrs. Ruble.
10. No other permanent guardian has been appointed for the person and/or estate of Mrs. Ruble.

11. Neither this Court nor any other Court has ever assumed jurisdiction in any proceeding to
determine the competency of Mrs. Ruble.
13. The appointment of a guardian for the person and estate of Mrs. Ruble is necessary because she
suffers from progressive Senile Dementia Alzheimer's Type (SDAT) and, as a consequence, has lost her short-
term memory and partially lost her long-term memory. Mrs. Ruble also suffers from Tourette's Syndrome. The
cumulative result of Alzheimer's disease and these other disabilities has rendered Mrs. Ruble incapable of
managing her finances or ensuring her own physical and financial safety and well-being.
WHEREFORE, Petitioner requests that the Court: (1) issue a Citation to Irene Mae Ruble to show cause
why Petitioner should not be appointed as permanent guardian of her person and estate; and (2) appoint
Petitioner as permanent guardian of the person and estate of the alleged incapacitated person ,Irene Mae. Ruble,
pending a hearing and further proceedings herein.

4. It is my opinion as her attending physician that Mrs. Ruble is incapable of handling her personal
finances, operating a motor vehicle, administering her prescribed medication, attending to her dietary or personal
hygiene needs, or performing many of the basic tasks required for her general health and well being.
5. In my expert medical opinion, Mrs. Ruble is incapacitated as defined in Chapter 55 of the
Pennsylvania Estates and Fiduciaries Code in that her ability to receive and evaluate information effectively and
communicate decisions in any way is impaired to such a significant extent that she is partially or totally unable to
manage her financial resources or to meet essential requirements for her physical health and safety.

To be an Incapacitated Person means that you are not able to receive and effectively evaluate

be spent.
At the hearing, you have the right to appear, to be represented by an attorney and to request a jury trial.
If you do not have an attorney, you have the right to request the Court to appoint an attorney to represent you
and to have the attorney's fees paid for you if you cannot afford to pay them yourself. You also have the right to
request that the Court order that an independent evaluation be conducted as to your alleged incapacity.
If the Court decides that you are an Incapacitated Person, the Court may appoint a Guardian for you,
based on the nature of any condition or disability and your capacity to make and communicate decisions. The
Guardian will be of your person and/or your money and other property and will have either limited or full powers
to act for you.
If the Court finds you are totally incapacitated) your legal rights will be affected and you will not be
able to make a contract or gift of your money or other property. If the Court finds that you are partially
incapacitated) your legal rights will also be limited as directed by the Court.
If you do not appear at the hearing (either in person or by an attorney representing you) on the_

The undersigned represents Merle C. Ruble, Petitioner in the proceeding to have Irene Mae
Ruble declared an incapacitated person. Pursuant to the requirements of Section 5511(a) (2) ofthe
Probate, Estate and Fiduciaries Code, this letter is formal notice that counsel has not been retained
to represent the alleged incapacitated person.
It is not anticipated that this proceeding will be contested. The Petitioner is the husband of
the alleged incapacitated. The alleged incapacitated has two daughters, both of which have attended
almost every meeting I have had with their father regarding this proceeding. They have both
expressed their love for their mother and have always had her best interest at heart. They both
support their father's decision to have himself appointed as guardian of their mother. Given the
situation, I do not feel that counsel is needed to represent the alleged incapacitated person.

The undersigned represents Walter N. and Joan C. IckIer, Petitioners in the proceeding to
have William Herbert Cordes declared an incapacitated person. Pursuant to the requirements of
Section 5511(a) (2) of the Probate, Estate and Fiduciaries Code, this letter is formal notice that
counsel has not been retained to represent the alleged incapacitated person.
It is not anticipated that this proceeding will be contested. The Petitioners are the sister and
brother-in-law ofthe alleged incapacitated. The father ofthe alleged incapacitated is deceased and
his mother has severe Alzheimer's Disease. The alleged incapacitated has one other sister who lives
in Connecticut. Although she has much love for her brother, she is grateful that Mrs. IckIer and her
husband are willing to continue the care thcy have provided for him over the years. Givcn the
situation, I do not feel that counsel is needed to represent the alleged incapacitated person.

1. My llame is Richard C. Yunginger, M.D., physician of Irene Mae Ruble.
2. My assessment of Mrs. Ruble's condition as well as my curriculum vitae were previously
submitted. It is my understanding that this information was attached to the Petition for Adjudication of
Incompetency and the Appom.tment of a Permanent Guardian of the Person and the Estate of an Alleged
Incapacitated Person.
3. It is my expert medical opinion that Irene Mae Ruble cannot be present at the hearing scheduled
for August 28,2001. Her physical condition requires assistance to do such simple acts as using the bathroom.
In addition, her mental condition may be affected if required to attend the hearing. Mrs. Ruble is very easily
agitated and confused. She does not have an understanding of the guardianship proceeding. To require her to
be present at the hearing would only upset her and cause further confusion and agitation.

to represent the alleged incapacitated person.
It is not anticipated that this proceeding will be contested. The Petitioner is the husband of
the alleged incapacita.ted. TI It: ullcged incapacitated has two daughters, both of which have attended
almost every meeting I have had with their father regarding thi~ proceeding. They have both
expressed their love for their mother and have always had her best interest at heart. They both
support their futher'g decision to have himself appointed ~ guardian of their mother. Given the
situation, I do not feel that counsel is needed to represent the alleged incapacitated person.
