For dates of death on or after July 1, 1994 and before January 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving spouse is 3%
[72 P.S. 99116 (a) (1.1) (i)].
For dates of death on or after January 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving spouse is 0% [72 P.S. 99116 (a) (1.1) (ii)).
The statute does not exemot a transfer to a surviving spouse from tax, and the statutory requirements for disclosure of assets and filing a tax return are still applicable even if
the surviving spouse is the only beneficiary.
For dates of death on or after July 1, 2000:
The tax rate imposed on the net value of transfers from a deceased child twenty-one years of age or younger at death to or for the use of a natural parent, an adoptive parent,
or a stepparent of the child is 0% [72 P.S. s9116(a)(1.2)].
The tax rate imposed on the net value of transfers to or for the use of the decedent's lineal beneficiaries is 4.5%, except as noted in 72 P.S. 99116(1.2) [72 P.S. 99116(a)(1)].
The tax rate imposed on the net value of transfers to or for the use of the decedent's siblings is 12% [72 P.S. s9116(a}(1.3)). A sibling is defined, under Section 9102, as an
individual who has at least one parent in common with the decedent, whether by blood or adoption.

inability to act in that capacity, then I appoint LeROY SMIGEL of Harrisburg,
Pennsylvania, as the Executor of this Will in her place and stead.
B. Bond. No bond or other security shall be required of any Executrix or
Executor appointed in this Will.

C. Compensation. The Exeuctrix or Executor shall recei ve reasonable
compensation for her or his services performed as determined by the Court in which this
Will is admitted to probate.
EXECUTRIX PO\VERS
ARTICLE VI
I give my Executrix in addition to and not in lilnitation of the powers given by law or by
other provisions of this Will, the following powers with respect to settlement of my estate, to be
exercised frOtTI time to tilTIe in the discretion of my Executrix without further order or license of
the Register of Wills or of any Court:
A. Investments. To retain any property, pending distribution hereunder, to
invest in or purchase any property without restriction to legal investn1ents for fiduciaries,
to compromise claims, and to sell any property at public or private sale;
B. Securities. To hold shares of stock or other securities in nominee
registration fonn, including that of a clearing corporation or depository, or in book entry
fonn or unregistered or in such other form as will pass by delivery;
C. Liti1!ation. To engage in litigation and compromise, arbitrate or abandon
claims;
D. Distributions. To make distributions in cash or in kind at current values,
or partly in each, allocating specific assets to particular distributees on a non-pro rata
basis, and for such purposes to make reasonable determinations of CUITent values;

L. General. To do all the acts, to take all the proceedings, and to exercise all
the rights, powers and privileges which an absolute owner of the property would have,
subject always to the discharge of her fiduciary obligations. The enuJ11eration of certain
powers in this Will shall not limit the general or in1plied powers of the Executrix. The
Executrix shall have all additional powers that may now or hereafter be conferred on the
Executrix by law or that may be necessary to enable the Executrix to administer the
provisions of this Will, subject to any limitations specified in this Will.

ARTICLE VII
No interest of any beneficiary under this Will or any codicil hereto shall be subject to
anticipation or voluntary or involuntary alienation.
SIMULTANEOUS WILLS

My wife and I are executing Wills at approximately the same time in which each of us is
the prin1ary beneficiary of the Will of the other. These Wills are not executed because of any
agreement between my wife and myself. Either Will may be revoked at any time at the sole
discretion of the maker thereof.

I, EDWIN RICHARD JUNKIN (the "Disclaimcmt"), donuciled at 3 Manor Drive,
Mechanicsburg, Pennsylvania 17055, aver:
1. Wendell S. Junkin (the "Decedent") died on June 30, 2007.
2. The Disclaimant is the son of the Decedent.
3. The Cumberland County Register of Wills appointed Carol Ann Gessner Jlmkin as the Executrix
of the Decedent's Estate.
4. The Decedent, pursuant to Article II of his Will, bequeathed certain personal property to the
Disclaimant, namely (a) all of the Decedent's clothing, jewehy and fishing equipment and
(b) all of Decedent' s books, papers, records and writings to be shared with Decedent's
daughter.
5. In the event the Disclaimant predeceased him, the Decedent provided that these gifts of personal
property would lapse.
6. The Disclaimant wishes Carol Ann Gessner Junkin to receive such bequests of certain tangible
personal property as she is the beneficiary of the remainder of Decedent's household furnishings
and tangible personal property-under Article III ofDececkni.'s \Val.
7. Pursuant to 20 Pa.C.S.A 996201 et seq. and the Comn1on Law of the COlrunonwealth of
Pennsylvania, the Disclaimant does hereby irrevocably disclaiIn the gifts of personal property
made pursuant to Article IT ofthe Decedent's Will ("Disclaimed Share").
8. The Disclaimant warrants he:
(a) has never exercised any power over to the Disclaimed Share nor received any benefit
with regard to such share; and,
(b) has not received, and is not to receive, any consideration in money or money's worth
for such disclaimer from any person or persons whose interest is to be accelerated or
increased, or from any other person or persons.
IN WITNESS VlHEREOF, and intending to be legally bOlmd hereby, and intending that this
Disclaimer shall be filed with the Office of the Clerk ofthe Orphans' Court Division of the Court of
