Kindly enter judgment in the above-captioned proceeding in favor of John P. Leonard,
Plaintiff, and against Defendants, Rickey and Stacey Hevel pursuant to District justice Rule
402(D) in the amount of $1,651.50. A certified copy of the record of the proceedings evidencing
entry of the judgment before Richard S. Dougherty, Magisterial District Number 09-1-03, to
docket number LT-0000277-07, dated November 27, 2007 is attached hereto and made part
hereof by reference. Plaintiff reserves the right to appeal the money judgment in this case.

PLAINTIFF'S MOTION TO COMPEL ANSWERS TO DISCOVERY
Plaintiff, John P. Leonard hereby moves this Court to enter and Order pursuant to
Pa.R.C.P. Nos. 4006 and 4009.12 compelling Defendants, Rickey and Stacey Hevel ("the
Hevels") to respond to certain written discovery requests propounded on the Hevels by Leonard
in this matter. In support of this motion, the Plaintiff avers as follows:
1. The Plaintiff commenced this action by filing a civil complaint against the Hevels
with Magisterial District Justice Richard S. Dougherty.
2. Magisterial District Justice Dougherty issued a judgment in favor of Leonard and
against the Hevels on November 27, 2007.
3. The Plaintiff filed a Praecipe to enter Judgment on January 23, 2008 against
Rickey and Stacy Hevel.
4. On January 28, 2008 the Plaintiff served Discovery in Aid of Execution upon the
Hevels.
5. Pursuant to Pa.R.C.P. No. 4006(a)(2), the Hevel's responses and objections, if
any, to the Interrogatories were due on or before February 29, 2008.
6. Plaintiff received no response from the Hevels after the Discovery was sent or
after a follow-up letter of March 31, 2008.
7. Pursuant to Pa. R.C.P. No. 4019(a)(1)(i), the Court may compel the Hevels to
respond to the Discovery Requests.
8. There have been no rulings by a Cumberland County Judge in the instant matter.
9. Defendants are believed to be pro se and Plaintiff s counsel has been unable to
solicit a response from the Defendants regarding discovery.
Request for Relief
The Plaintiff respectfully requests this Honorable Court enter an Order pursuant to
Pa.R.C.P. 4019(a)(1)(i) granting this Motion and directing Rickey and Stacey Hevel to provide
full and complete answers, without objection, to the Discovery Requests within twenty (20) days
of the entry of such Order or appropriate sanctions shall be imposed upon the Hevels following
application to the Court.

PLAINTIFF'S MOTION TO MAKE RULE ABSOLUTE
Plaintiff, John P. Leonard ("Leonard") by its counsel Sarah E. McCarroll, hereby moves
this Honorable Court to Make Rule Absolute and in support of this motion, Plaintiff avers as
follows:
1. The Plaintiff commenced this action by filing a District Justice Complaint on
September 13, 2007.
2. District Justice Dougherty entered judgment on November 27, 2007 in favor of
John Leonard and against Rickey and Stacy Hevel.
3. The Plaintiff filed a Praecipe to enter Judgment was entered against Rickey and
Stacy Hevel on January 23, 2008.
4. On January 28, 2008 the Plaintiff served Discovery in Aid of Execution upon the
Defendants.
5. The Plaintiff received no response from the Defendants as of the date of this
filing.

6. The Plaintiff then filed a Motion to Compel and the Honorable Judge Kevin A.
Hess issued a Rule to Show Cause on April 18, 2008.
7. By letter dated May 21, 2008, the Plaintiff served the Rule to Show Cause upon
the Defendants by certified mail and first class mail. A true and correct copy is
attached as Exhibit A.
8. The letter sent by way of certified mail was returned unclaimed and the letter sent
first class was not returned.
9. Plaintiff respectfully requests this Honorable Court make the Rule Absolute.
10. Counsel for Plaintiff has been unable to engage the Defendants in any
conversation regarding the judgment and requested discovery.
Request for Relief
Plaintiff, John P. Leonard., requests this Honorable Court enter an Order pursuant to
Pa.R.C.P. 4019(a)(1)(i) granting this Motion and directing Rickey and Stacy Hevel to provide
full and complete answers, without objection, to the Discovery Requests within twenty (20) days
of the entry of such Order or appropriate sanctions shall be imposed upon Siding Window
Warehouse Plus following application to the Court.
