Plaintiff is Beneficial Consumer Discount Company d/b/a Beneficial Mortgage Company of Pennsylvania, a corporation duly organized and doing business at the above captioned address. 2. The Defendant is Barry L. Deitch a/k/a Barry Lee Deitch a/k/a Barry L. Deitch, Sr., who is one of the mortgagors and real owners of the mortgaged property hereinafter described, and his last-known address is 101 East Main Street, Walnut Bottom, PA 17266. 3. The Defendant is Gay L. Deitch a/k/a Gay Lynn Deitch, who is one of the mortgagors and real owners of the mortgaged property hereinafter described, and her last-known address is 101 East Main Street, Walnut Bottom, PA 17266. 4. On 10/4/2000, the Defendant, United States of America, acquired a lien against the premises hereinafter described in the sum of $33,477.33, subordinate to the mortgagee hereinafter referred to, by reason of Federal Tax Lien, Number 230064260, in favor of the United States of America against Bary L Deitch and Gay L. Deitch, and which is recorded in the Office of the Prothonotary of Cumberland County, Pennsylvania. 5. Notice of this lien was filed on 10/4/2000, at the Office of the Prothonotary of Cumberland County, by the , Internal Revenue Service, Philadelphia, Pennsylvania. A true and correct copy of Notice of Federal Tax Lien is attached hereto and marked as Exhibit "A." 6. By the filing of this action, Plaintiff seeks a judicial sale of the premises hereinafter described. 7. On 03/31/1997, mortgagor made, executed and delivered a mortgage upon the premises hereinafter described to Plaintiff which mortgage is recorded in the Office of the Recorder of Cumberland County in Mortgage Book 1372, Page 595. 8. The premises subject to said mortgage is described in the mortgage attached as Exhibit "B" and is known as 101 East Main Street, Walnut Bottom, PA 17266. 9. The mortgage is in default because monthly payments of principal and interest upon said mortgage due 07/01/2007 and each month thereafter are due and unpaid, and by the terms of said mortgage, upon default in such payments for a period of one month, the entire principal balance and all interest due thereon are collectible forthwith. 10. The following amounts are due on the mortgage: Principal Balance $ 61,291.87 Interest through 12/20/2007 $ 22,855.50 (Plus $ 6.39 per diem thereafter) Attorney's Fee $ 1.250.00 GRAND TOTAL $ 85,397.37 11. Notice of Intention to Foreclose as required by Act 6 of 1974 (41 P.S. §403) and notice required by the Emergency Mortgage Assistance Act of 1983 as amended under 12 PA Code Chapter 13, et seq., commonly known as the Combined Notice of Delinquency has been sent to Defendants by regular mail with a certificate of mailing and by certified mail, return receipt requested.
