For dates of death on or after July 1, 1994 and before January 1. 1995, the tax rate imposed on the net value of transfers to or for the use of the
surviving spouse is three (3) percent [72 P .S. ~9116 (a) (1.1) (i)].
For dates of death on or after January 1. 1995. the tax rate imposed on the net value of transfers to or for the use of the surviving spouse is zero
(0) percent [72 P .S. ~9116 (a) (1.1) (ii)]. The statute does not exempt a transfer to a surviving spouse from tax, and the statutory requirements
for disclosure of assets and filing a tax return are still applicable even if the surviving spouse is the only beneficiary.
For dates of death on or after July 1,2000:
The tax rate imposed on the net value of transfers from a deceased child twenty-one years of age or younger at death to or for the use of a
natural parent, an adoptive parent, or a stepparent of the child is zero (0) percent [72 P.S. S9116 (a) (1.2)].
The tax rate imposed on the net value of transfers to or for the use of the decedent's lineal beneficiaries is four and onE~...half (4.5) percent,
except as noted in 72 P.S. ~9116 1.2) [72 P.S. ~9116 (a) (1)).
The tax rate imposed on the net value of transfers to or for the use of the decedent's siblings is twelve (12) percent [72 P.S. 99116 (a) (1.3)]. A
sibling is defined under Section 9102, as an individual who has at least one parent in common with the decedent, whether by blood or adoption.

AND NOW, this 14th day of June, 2007, upon review of the original Will of Gladys V. Smeal,
submitted for probate on June 5, 2007, which original Will contained numerous deletions and
interlineations, as well as upon review of a Copy Fair of the Will of Gladys V. Smeal, filed on June 8,
2007, the Register of Wills finds the following with regard to the Estate of Gladys V. Smeal:
The Register shall admit for Probate Items I, ITI, IV, V, VII, VITI, IX, and X as presented in the
Copy Fair of the Will, which items are identical to those contained within the original Will of Gladys V.
Smeal.
With regard to Item II of the Copy Fair, the same shall be admitted for Probate with discussion:
specifically, as the original Will contains an apparent deletion of this item with subsequent ,
interlineations, some having been proven by signature of the Testator and others nofs9_prove1i,:~nd as
the Copy Fair does not address the interlineations, which proven ones only seem toeiplain th;~eason
for the deletion, the Register shall accept Item II of the Copy Fair for Probate and, accqrdinglYTshall

With regard to Item VI of the Copy Fair, the same shall not be admitted for Pi'QP"at'e in =that the
Register believes such Item VI as presented in the Copy Fair substantially changes the-~intent or-the
Testator. Moreover, Item VI of the original Will was never specifically deleted by the TestatW:and any

ITEM I. I direct that all my just debts and funeral expenses, including my gravemarker
and all expenses of my last illness, and any and all taxes and assessments imposed by any
governmental body as a result of my death, whether on property passing under t~!s.:fill or -,-""
otherwise, shall be paid from my residuary estate as soon as practicable after my decease as a
part of the expense of the administration of my estate.

ITEM III. I give and bequeath all of the rest, residue, and remainder of my household

ornament, together with all insurance thereon and relating thereto, in equal shares to those of my

ITEM VII. I appoint my personal representatives, or the survivor of them, as guardian

property and his or her own affairs, with respect to which I am authorized to appoint a guardian
and have not otherwise appointed a guardian or trustee. Such guardian shall have the power to
use principal as well as income from time to time for the person's education, support, and
welfare without regard to his or her parent's ability to provide for such education, support, or
welfare, and to make such payment for these purposes, without further responsibility, directly to
such person.
ITEM VIII. I direct that my personal representatives shall not be required to give bond
for the faithful performance of their duties in any jurisdiction.
ITEM IX. In addition to the other powers and authorities granted to my personal
representatives by Pennsylvania law and by the other terms and provisions of this will, I hereby
give to my personal representatives the following powers and authorities effective without court
approval and until actual distribution of all property: to compromise any claim or controversy;

ITEM III. I give and bequeath all of the rest, residue, and
remainder of my household goods, automobiles, jewelry, and all
other articles of household and personal use, equipment, and
ornament, together with all insurance thereon and relating
thereto, in equal shares to those of my issue, per stirpes, who
survive my death by thirty days.
ITEM IV. I give, devise, and bequeath all the rest, residue
and remainder of my possessions and estate of every nature and
wherever situate in equal shares to those of my issue, per
stirpes, who survive my death by thirty days.
ITEM V. I direct that in the distribution of my estate, the
share of my daughter, TAMMIE G. FRANGE, or her issue, shall be
charged with an advancement of $11,000.00 for funds which I have
previously paid to the said TAMMIE G. FRANGE.
ITEM VI. I appoint my sons: RONALD K. BARNINGER, of Enola,
Pennsylvania, and DANIEL H. BARNINGER, of Mechanicsburg,
Pennsylvania, Co-Executors of this my last will. In the event of
the death of one of my personal representatives, the survivor
shall serve without replacement or substitution of the deceased
Co-Executor.

ITEM VII. I appoint my personal representatives, or the
survivor of them, as guardian of any property which passes,
either under this will or otherwise, to a minor or to any person
adjudged by any court of competent jurisdiction to be mentally
incompetent to care for such property and his or her own affairs,
with respect to which I am authorized to appoint a guardian and
have not otherwise appointed a guardian or trustee. Such
guardian shall have the power to use principal as well as income
from time to time for the person's education, support, and
welfare without regard to his or her parent's ability to provide
for such education, support, or welfare, and to make such payment
for these purposes, without further responsibility, directly to
such person.
ITEM VIII. I direct that my personal representatives shall
not be required to give bond for the faithful performance of
their duties in any jurisdiction.
ITEM IX. In addition to the other powers and authorities
granted to my personal representatives by Pennsylvania law and by
the other terms and provisions of this will, I hereby give to my
personal representatives the following powers and authorities
effective without court approval and until actual distribution of

all property: to compromise any claim or controversy; to make
distribution in cash or in kind, or partly in cash and partly in
kind, and in such manner as my personal representatives may
determine and at valuations finally to be fixed by them; to
invest in all forms of property, including any stock or other
securities in any corporate fiduciary or its successor without
restriction to investments authorized for Pennsylvania
fiduciaries, as my personal representatives deem proper, without
regard to any principle of risk or diversification; to retain any
or all assets of my estate, real or personal, without regard to
any principle of risk or diversification; to sell at public or
private sale, to exchange, or to lease for any period of time,
any real or personal property and to give options for sales,
exchanges, or leases, for such prices and upon such terms or
conditions as my personal representatives deem proper; and to
allocate receipts and expenses to principal or income or partly
to each as my personal representatives deem proper in their sole
discretion.
