Cocco, for their complaint against Defendants alleges and avers as follows: 1. Plaintiff is a corporation authorized to write homeowners policies of insurance in the State of Pennsylvania. At all times herein, Plaintiff provided such a policy of insurance to Gary Van Pelt (hereinafter "the insured") for his home and property at the above address under the terms of which Plaintiff becomes subrogated to the insured's rights of claim following Plaintiffs payment of an insured loss. 2. Gary Van Pelt is an adult individual who at all times material hereto resided at, and was the owner of the property and personal property contained therein, located at 57 I Street, Carlisle, Pennsylvania [hereinafter "the property"]. 3. Defendant GSC Electronics Corporation [hereinafter "defendant"] is a New York Corporation with a principal place of business at 748 State Route 9, Champlain, NY 12919and is engaged in the business of manufacture of electronic consumer items including a multi-outlet power strip sold under the brand and/or trade name "Powermate" [hereinafter "the product"]. 4. Defendant regularly conduct business in the Commonwealth of Pennsylvania. 5. Defendant expected the product to reach consumers or users such as the Plaintiffs in the condition in which the products were sold. 6. On or about December 31, 2001, Plaintiffs insured was using the product to power 100 watt heater plugged into the product. 7. The daughter of laintiff s insured heard a popping noise and saw smoke being emitted from the vicinity of the power strip. Upon exiting the house, a fire could be viewed in the same area of the property. 8. Before being extinguished, the fire caused damage to the property and personal belongings of plaintiff s insured. 9. Upon expert analysis of the evidence at the: fire scene, it was determined that the product failed due to an improper internal wiring connection that heated the components and led to electrical arcing. 10. Defective design and manufacture of the product proximately caused the fire's ignition in the property and resulting damages described above. 11. At the time of the accident described her1ein, Plaintiff s insured was usmg the aforesaid product for its intended use and was unaware of any danger to themselves or their property from such use. 2 COUNT I. - Strict Liability 12. The Plaintiffs re-allege the allegations in Paragraphs 1 through 11 of this Complaint. 13. Upon information and belief, the product was in the same condition when it was used by Plaintiff s insured on the date of the accident as when it was sold to Plaintiffs. 14. Defendant owed Plaintiff a duty to manufacture the product such that it was free from defects such that its normal intended use would not be unreasonably dangerous to ordinary consumers like Plaintiff s insured. 15. Defendant owe~ Plaintiff s insured a duty to provide instructions and warnings as to the product's use such that the product's normal intended use would not be unreasonably dangerous to ordinary consumers like Plaintiff s insured. 16. When Plaintiff s insured sustained his damages, the product was in a defective condition unreasonably dangerous to a user or consumer in that GSC failed to employ in its manufacture and design available and cost feasible mechanisms to prevent its failure and the life- threatening consequences of such failure. 17. As a direct and proximate result of the Defendant's breach of their aforesaid duties and the defective condition of the product, Plaintiff sustained damages as set forth above, and the Defendant is therefore strictly liable in tort to the Plaintiff. WHEREFORE, Plaintiff requests judgment against Defendant GSC as to Count I in an amount in excess of the limits of arbitration for actual damages, costs of suit and such other relief as the Court deems proper. COUNT II. - Negligence 18. Plaintiffre-alleges the allegations in Paragraphs 1 through 17 of this Complaint. 19.
