CUSTODY COMPLAINT FOR CUSTODY AND NOW, TO WIT, this 31S` of January, 2008, comes the Plaintiff, LEEMARIE DIGGS, by her attorneys, CARRUCOLI AND ASSOCIATES, PC, Esquires, and by KELLY M. DICK, Esquire, and files the following Complaint for Custody, whereof the following is a statement: 1. The Plaintiff is LEEMARIE DIGGS, an adult individual, who currently resides at 119 Herman Avenue, Lemoyne, Pennsylvania, 17043. 2. The Defendant is TERRY L. DIGGS, an adult individual, who is currently incarcerated at the Dauphin County Prison, 501 Mall Road, Harrisburg, Pennsylvania, 17111. 3. The Plaintiff and Defendant are the natural parents of the minor child: SYDNEY MARIE DIGGS, whose date of birth is December 1, 2000. 4. The Plaintiff is LEEMARIE DIGGS, the natural Mother of the child. She resides with her biological mother, the minor child's maternal grandmother. 5. The Defendant is TERRY L. DIGGS, the natural Father of the child. 6. The parties were married on December 1, 1999. A final divorce decree was entered on October 19, 2007. 7. The Mother currently has primary physical and legal custody of the minor child by oral agreement, and the Father has periods of partial physical custody. The Plaintiff Mother seeks an order providing for sole legal and physical custody of the minor child. 8. The Plaintiff believes it is in the child's best interest to have a set custody arrangement. 9. There has been no prior action for custody or visitation by any of these parties in this or any other jurisdiction. 10. The Plaintiff knows of no other person not a party to these proceedings who has physical custody of the child or who claims visitation rights. it. Each parent whose parental rights to the children have not been terminated and the persons who have physical custody of the minor child have been named as parties to this action. All other persons, named below, who are known to have or claim a right to custody or visitation of the children have been given notice of the pendency of this action and the right to intervene: None. Gilroy, Esq. , the conciliator, at 4th Floor, Cumberland County Courthouse, Carlisle on Thursday, March 13, 2008 at 8:30 AM for a Pre-Hearing Custody Conference. At such conference, an effort will be made to resolve the issues in dispute; or if this cannot be accomplished, to define and narrow the issues to be heard by the court, and to enter into a temporary order. Failure to appear at the conference may provide grounds for entry of a temporary or permanent order. The mother, Leemarie Diggs, and the father, Terry L. Diggs, shall share legal custody of Sydney Marie Diggs, born December 1, 2000. 2. The mother shall enjoy primary physical custody of the minor child. 3. The father shall enjoy periods of temporary custody of the minor child at such time and under such circumstances as agreed upon by the parties. 4. Upon the father's release from prison and in the event he is unable to work out a satisfactory temporary custody arrangement with the mother at that time, father may petition the Court to have the case again scheduled with the Custody Conciliator for a conference. He is incarcerated in Dauphin County Prison. He made some contact with the Conciliator stating his position. It is uncertain when he will get out of prison at this point. 3.
