COMPLAINT
The Plaintiff, GLASS DISTRIBUTORS, INC., by its attorneys, KODAK & IMBLUM,
P.C., brings this action of Assumpsit against the Defendants to recover the sum of NINE
THOUSAND ONE HUNDRED EIGHTY-SIX DOLLARS AND TWENTY-FIVE CENTS
($9,186.25), along with interest thereon at the statutory rate from November 11, 2007,
upon a cause of action of which the following is a statement:

The Plaintiff, GLASS DISTRIBUTORS, INC., is a corporation organized and existing
under the laws of the State of Maryland, having a mailing address of PO Box 349,
Bladensburg, MD 20710-0349.
The Defendant, L & K RESTORATIONS, LLC, is a corporation organized and
existing under the laws of the Commonwealth of Pennsylvania, having its principal
office and place of business at 186 Booz Road, Shippensburg, Cumberland
County, PA 17257.
The Defendant, LEROY K. GORDON, is an adult individual residing at 186 Booz

4. The Defendant, LEROY K. GORDON, is an adult individual residing at 186 Booz
Road, Shippensburg, Cumberland County, PA 17257.

5. The averments of paragraphs 1 through 4 are incorporated hereby by reference the
same as if textually set forth at length herein.
6. On the dates, in the amounts, and for the prices set forth in the true and correct
copies of Plaintiffs Invoices hereto attached, collectively marked Exhibit "A" and
made a part hereof, Plaintiff, at the special instance request of the Defendants, sold
and delivered goods, wares and merchandise of the kind and description set forth
on said Exhibit to the total amount of Nine Thousand Four Hundred Thirty-Six
Dollars and Thirty-Five Cents ($9,436.35).
7. The prices charged for said goods, wares and merchandise were just and
reasonable, were the legal and market prices therefor and were the prices which the
Defendants promised and agreed to pay to Plaintiff.
8. Defendants paid to Plaintiff on account of the charges aforementioned certain sums
of money as more particularly shown on Plaintiffs Statement of Account attached
F:\USER\ROBIN\CCP&DJ CMPS\CCP COMPLAINTS\GLASS DISTRIBUTORS 33925.wpd 3
hereto, marked Exhibit "B" and made a part hereof, to the total amount of Two
Hundred Fifty Dollars ($250.00).
9. The balance due and owing by Defendants to Plaintiff is the sum of Nine Thousand
One Hundred Eighty-Six Dollars and Twenty-Five Cents ($9,186.25), as appears by
Exhibit "B" attached hereto.
10. Plaintiffs Invoices are not attached to this pleading due to the voluminous nature
of same and have previously been provided to Defendants.
11. Plaintiff frequently demanded payment from Defendants of said amount due and
owing as aforesaid, but Defendants refused and neglected and still refuse and
neglect to pay said amount or any part thereof.
WHEREFORE, Plaintiff brings this suit to recoverfrom Defendants the sum of NINE
THOUSAND ONE HUNDRED EIGHTY-SIX DOLLARS AND TWENTY-FIVE CENTS
($9,186.25), together with interest as set forth herein and costs of suit.
COUNT II - QUANTUM MERUIT
12. The averments of paragraphs 1 through 11 are incorporated hereby by reference
the same as if textually set forth at length herein.
13. Plaintiff supplied the aforesaid materials with the expectation of remuneration.
14. Defendants are unjustly enriched in that they received the use and value of the
aforesaid materials without payment.
15. Defendants are further unjustly enriched in that they used corporate funds to
purchase their residence, and further sold corporate assets to pay personal bills, not
corporate debts, thereby constituting improper use of corporate assets and funds.
16. Plaintiff has suffered damages as indicated herein.
WHEREFORE, Plaintiff brings this suit to recoverfrom Defendants the sum of NINE
THOUSAND ONE HUNDRED EIGHTY-SIX DOLLARS AND TWENTY-FIVE CENTS
($9,186.25), together with interest as set forth herein and costs of suit.
