AND NOW, this ~-! day of March 2002, following conference with counsel for the
parties the following Order hereby entered:
1. Rebecca A. Shiffler shall be subject to an independent evaluation of her capacity which
shall be provided by the Bradford County Office of Mental Retardation. The person responsible to
arrange the services of the evaluator shall be Terry Butler.
2. The evaluation shall be performed by a licensed psychologist qualified by training and
experience in evaluating individuals with mental retardation and learning disabilities. The evaluation
shall establish the nature and extent of the alleged incapacity and disabilities, Ms. Shiffler's mental
and emotional condition, adaptive behavior, physical condition and social skills. The report of the
evaluator shall include findings as to the needed services to meet the essential requirements, if
any, for Ms. Shiffler's physical health and safety to assist her as needed in management of financial
resources or to develop or regain her abilities as well as any training, education, medical,
psychological services, social and vocational opportunities may be appropriate to assist Ms. Shiffler
in the development of maximum self-reliance and independence. The report shall specifically
include an opinion as to the least restrictive alternatives available to address Ms. Shiffler's needs
and to include a finding as to whether there is any probability that the extent of any incapacity found
could be significantly lessened or changed. The evaluator shall make specific findings with regard
to the nature of any condition or disability which may impair Ms. Shiffler's capacity to make and
communicate decisions and the extent of her capacity to make and communicate decisions.

3. The cost for the evaluation shall be provided by Ms. Shiffler's medical assistance
benefits. Alternatively, payment for these services shall be provided by Bradford County Office of
Mental Retardation.

IMPORTANT NOTICE
CITATION WITH NOTICE
A petition has been filed with the Court to have you declared an Incapacitated Person. If the
Court finds you to be an Incapacitated Person, your rights will be affected, including our right to manage
money and property and to make decisions. A copy of the petition which has been filed by ROBERT
W. SHIFFLER AND RITA A. SHIFFLER is attached.
You are hereby ordered to appear at a hearing to be held in Court Room No. ~, Cumberland
County Courthouse, Carlisle, Pennsylvania, on NOVEMBER 9 ,2001, at 8:45 A.M. to tell the
Court why is should not find you to be an incapacitated Person and appoint a Guardian to act on your
behalf.
To be an incapacitated Person means that you are not able to receive and
effectively evaluate information and communicate decisions and that you are unable to
manage your money and/or other property, or to make necessary decisions about where
you will live, what medical care you will get, or how your money will be spent.
At the hearing, you have the right to appear, to be represented by an attorney, and
to request a jury trial. If you do not have an attorney, you have the right to request the
Court to appoint an attorney to represent you and to have the attorney's fees paid for you
if you cannot afford to pay them yourself. You also have the right to request that the
Court order that an independent evaluation as to your alleged incapacity.

If the Court decides that you are an Incapacitated person, the Court may appoint a
Guardian for you, based on the nature of any condition or disability and your capacity to
make and communicate decisions. The Guardian will be of your person and/or your
money and other property and will have either limited of full powers to act for you.
If the court finds you are totally incapacitated, your legal rights will be affected
and you will not be able to make a contract or gift of your money to other property. If the
court finds that you are partially incapacitated, your legal rights will also be limited as
directed by the Court.
If you do not appear at the hearing (either in person or by an attorney representing you)
the court will still hold the hearing in your absence and may appoint the Guardian requested.

Petitioners Robert W. Shiffler and Rita A. Shiffler, through their
attorney, Stephen J. Hogg, Esquire, files this Petition to be appointed
Guardians Ad Litem of Rebecca A. Shiffler alleging the fo"o~ing:
1. Petitioners are Robert W. Shiffler and Rita A. Shiffler, husband
and wife, adult individuals residing at 4 E. Louther Street,
Apartment 2 Carlisle, Cumberland County, Pennsylvania.
2. Rebecca A. Shiffler is the daughter of Rita A. Shiffler and the
stepdaughter of Robert W. Shiffler.
3. Rebecca A. Shiffler has been incapacitated since birth by
severely diminished mental functioning.
4. Rebecca A. Shiffler is currently twenty years of age having been
born November 13, 1980.
5. Rebecca A. Shiffler was placed in special education' classes in
the Mechanicsburg school district but quit school in 2000 when
she was nineteen years of age and in the tenth grade.

6. Rebecca A. Shiffler has expressed intent to move to
Williamsport, Pennsylvania with David L. Buchholtz with the
expressed intent of marrying him.
. 7. The Petitioners aver that Rebecca A. Shiffler does not have the
mental capacity to consent to marriage and further aver that her
best interests would be served by continuing to reside with the
Petitioners or at least in the Carlisle area.
Wherefore, it is respectfully requested that Petitioners be appointed as
the Guardians Ad Litem for Rebecca A. Shiffler.
