In the Court of Common Pleas, County of CUMBERLAND ~ Pennsylvania Number 0-~"~'/~7 ~/~Term.~'~ 2003 WHEREAS, SOMASUNDARAM BALASUNDARAM and MALATHI BALASUNDARAM of 1827 SIGNAL HILL DRIVE, MECHANICSBURG Pennsylvania. is about to execute contemporaneously herewith, a contract, with HAUBERT HOMES, INC. of 15 CENTRAL BLVD., CAMP HILL Pennsylvania. for the erection of a story building upon a lot of land situate AND COMMONLY KNOWN AS LOT 84 AKA 1513 INVERNESS DRIVE, TOWNSHIP OF HAMPDEN, CUMBERLAND COUNTY, PENNSYLVANIA, AS SET FORTH IN THE DEED DATED AND RECORDED AT DEED BOOK , PAGE , IN THE RECORDERtS OFFICE FOR CUMBERLAND COUNTY, PENNSYLVANIA, AS MORE SPECIFICALLY DESCRIBED IN EXHIBIT "A" WHICH IS INCORPORATED HEREIN AND ATTACHED HERETO. NOW. DECEMBER 19, 2003 X~ . at the time of and immediately before the execution of the prin- cipal contract, and before any authority has been given by the said OWNER to the said CONTRACTOR to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with CONTRACTOR and the further consideration of One Dollar. to CONTRACTOR paid by OWNER , it is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. WITNESS. our hands and seals the day and year aforesaid. b~ND SEALED IN THE PRESENCE OF MALATHI BALAS UNDARAM Exhibit A ALL THAT CERTAIN tract or parcel of land being situate in Hampden Township, Cumberland County, Pennsylvania, more particularly bounded and described as follows, to wit: BEGINNING at a point on the northern right~of-way line of Inverness Drive, a 50 foot wide'-- street, said point being the southwestern comer of Lot No. 85; thence along said right-of-way line along a curve to the left having a radius of 525.00 feet and an arc length of 75.00 feet, said arc being subtended by a chord of South 64 degrees 47 minutes 50 seconds West a distance of 74.94 feet to a point, sa. id point being the eastern most comer of Lot No. 83; thence along the eastern line of said lot North 25 degrees 50 minutes 47 seconds West a distance of 113.89 feet to a point, said point being the southwestern corner of Lot No. 97; thence along the southern line of said lot North 57 degrees 50 minutes 58 seconds East a distance of 84.16 feet to a point, said point being rite northwestern corner of Lot No. 85; thence along the western line of said lot South 21 degrees 06 minutes 37 seconds East a distance of 109.68 feet to a point, the PLACE OF BEGINNING. CONTAINING 8,814.64 square feet or 0.2024 acres. BEING Lot No. 84 as shown on the Final Subdivision Plan of Fab:winds, Phase III, recorded in the Office of the Recorder of Deeds, Cumberland County, in plan Book 78, Page 90.
