Anthony Cardinal is appointed to serve as guardian of the estate of Paul R. Cardinal of 525 Lucinda Lane, Mechanicsburg, Pennsylvania, a minor, in the limited capacity of making decisions relating to such minor's personal property in the approximate value of $39,600 representing the proceeds from the sale of real property partially titled in minor's name now held in escrow in Florida with Alan Underwood, Esquire by Order of Judge Jack Springstead, Circuit Court of the Fifth Judicial Circuit, Hernando County, Florida. It is further Ordered that Guardian will transfer minor's personal property from the State of Florida to the Commonwealth of Pennsylvania and place the said personal property in an appropriate account to be utilized in the best interests of such minor, including but not limited to expenditures for such minor's education, heath or welfare, until such minor reaches the age of majority, which is twenty-one. At such time when such minor attains majority, any and all remaining personal property shall be immediately turned over and distributed to him. 71482.1 The Guardian shall file a report at the termination of his guardianship or at an earlier time as required by 20 Pa.C.S. 5161. G. Anthony Cardinal is appointed Limited Guardian of Paul R. Cardinal's specified property. Bond is waived under 20 Pa.C.S. 95122(d). The Guardian of the Estate shall not be able to enter a safe deposit box in the name of Paul R. Cardinal without prior Court authorization. The Guardian is authorized to spend assets and funds for the aforesaid purposes without the Court's approval. The aforementioned judicial determinations have taken into consideration the matters required by 20 Pa.C.S. 95111 et. seq. Cardinal, the petitioner and a mmor, by and through his attorneys, Latsha Davis & Y ohe, P.C, and hereby petitions for an adjudication for a minor's estate and appointment of a guardian therefore pursuant to 20 P.5. 95111 - 5113, and 5141, and, in support thereof, represents as follows: 1. Paul R. Cardinal ("Petitioner") resides at 525 Lucinda Lane, Mechanicsburg, Cumberland County, Pennsylvania with his natural parents, Peter A. Cardinal and Linda M. Cardinal. 2. Petitioner is 15 years of age, having been born on February 5, 1986, at Fort Gordon, Richmond County, Georgia. 3. Petitioner seeks the appointment of G. Anthony Cardinal as the guardian of the Petitioner's estate as set forth below. 4. G. Anthony Cardinal resides at 554 Mountain Road, Boiling Springs, Cumberland County, Pennsylvania. 5. Peter A. Cardinal, M.D., the father of Petitioner, and Linda M. Cardinal, the mother of Petitioner, are both living and reside at 525 Lucinda Lane, Mechanicsburg, Cumberland County, Pennsylvania. 6. Both Peter A. Cardinal, Petitioner's father, and Linda M. Cardinal, Petitioner's mother, consent to the appointment of G. Anthony Cardinal as guardian of the Petitioner's estate as set forth below. 70565.1 7. Petitioner is the recipient of personal property of the value of approximately $39,600 which represents the proceeds from the sale of real property partially titled in Petitioner's name and is currently being held in escrow in Florida with Alan Underwood, Esquire pursuant to an Order of Judge Jack Springstead, Circuit Court of the Fifth Judicial Circuit, Hernando County, Florida, a copy of which is attached as Exhibit A. 8. Such funds being held in escrow pursuant to the Order cannot be transferred out of the State of Florida without a guardian being appointed for the Petitioner under Pennsylvania law. 9. Petitioner is entitled to such property and to protect and preserve the legal rights of such minor, it is necessary that a proper person be duly appointed the guardian of his estate. 10. Petitioner has no general or testamentary guardian appointed by will, deed, or otherwise, to the knowledge or belief of Petitioner. 11. G. Anthony Cardinal, the proposed guardian, has no knowledge or belief that Petitioner has a general or testamentary guardian currently appointed by will, deed, or otherwise. 12. G. Anthony Cardinal is 69 years of age, born January 17, 1932 in Schenectady, Schenectady County, New York. He is a citizen of the United States of America and is able to read and write the English language. 13. G. Anthony Cardinal does not reside in the same household as the Petitioner. 14. G. Anthony Cardinal is not the fiduciary or an officer or employee of a corporate fiduciary of an estate in which the Petitioner has an interest nor the surety or an officer or an employee of the corporate surety of such a fiduciary. He has no interest adverse to the Petitioner. 15. G. Anthony Cardinal is a fit and proper person to be appointed guardian of the estate of Petitioner. 70565.1 WHEREFORE, Petitioner requests that a decree issue appointing G. Anthony Cardinal the guardian of the estate of Petitioner and authorizing said guardian to receive the Petitioner's funds held in escrow in Florida and hold such funds in an account established in Pennsylvania and utilize such funds for the Petitioner's education, health and welfare until he turns twenty-one, and for such other and further relief as the court may deem proper.
