HomeMy WebLinkAbout08-0888 ~o. d ~ 8` ~~ l"1 ~ ,D IN THE COURT OF COMMON PLEAS CUMBERLAND COUNTY, PENNSYLVANIA Clements-Hann Real Estate v. 5 Sample Bridge Road Pyramid Construction Services, Inc., Mechanicsburg, Cumberland County STIPULATION AGAINST LIENS WHEREAS, Clements-Hann Real Estate, the OWNERS of the real estate described below, has or is about to execute contract with Pyramid Construction Services, Inc., whose principal place of business is located at 4425 Valley Road, Enola, PA, to install as indicated in a Construction Contract at the project site known and numbered as 5 Sample Bridge Road, Mechanicsburg, Cumberland County Pennsylvania, as more pazticulazly bounded and described on Exhibit "A", attached hereto and made a part hereof; and ~_ NOW, THEREFORE, this 2JD day of , 2008, before any authority had been given by Clements-Hann Real Estate to Pyramid Construction Services, Inc. to commence work on said site, or purchase materials for same, in consideration of making of the above described Contract with Clements-Hann Real Estate, and in further consideration of One Dollaz and Zero Cents ($1.00) paid to the Contractor by Clements- Hann Real Estate, the receipt whereof is hereby acknowledged, it is agreed that no mechanics liens or claims shall be filed or maintained against the Owners facilities and the land above described, or upon Clements-Hann Real Estate, the Owners, by the Contractor or by any of the materialmen or workmen, or any other person acting through or under them, for or on account of any labor, or materials purchased, or extra labor or materials purchased for, towazds, in or about the erection, construction, design and improvement of said facilities, under said contract or otherwise, the right to have, file and maintain such liens or claims against the facility, the land above described, and Clements-Hann Real Estate, the Owners being hereby expressly waived by the Contractor for itself, its Contractors, all materialmen, or workmen and others acting through or under them. ti IN WITNESS WHEREOF, each of the parties by their duly a~u~th~rized representatives have hereunto executed this Stipulation Against Liens this 3 day of.Jq~1 ~~ 2 '~, 2008.
