MEREDITH III and CIVIL ACTION - LAW KIMBERLY WILLIAMS Plaintiffs NO.: Of - 9'6 G Lz&d vs. DAVID LEE RICHARDS Defendant COMPLAINT AND NOW, come the Plaintiffs by their Attorney, Robert P. Reed, Esquire, and make claim against the Defendant as follows: 1. Plaintiffs, Berk B. Meredith III and Kimberly Williams are adult individuals residing at 11967 Forges Hill Road, Orrstown, Franklin County, Pennsylvania 17244. 2. Defendant, David Lee Richards, is an adult individual residing at 21497 Shawville, Frenchville Highway, Clearfield, Clearfield County, Pennsylvania 16830. 3. The events and occurrences hereinafter related took place between 2:00 a.m and 4:00 a.m. on April 30, 2006 at 125 North Washington Street in the borough of Shippensburg, Cumberland County, Pennsylvania 17257. 4. At the time and place aforesaid, the Plaintiffs were owners of a building situate on the side of the aforesaid North Washington Street and known as 125 North Washington Street. 5. At the time and place aforesaid, the Defendant was the operator of a 2000 Mazda, property of one, Kevin Dykes, and was operating said vehicle on the aforesaid North Washington Street and in an alley alongside the aforesaid 125 North Washington Street. 6. At the time and place aforesaid, the Defendant operated the vehicle of Kevin Dykes in such fashion as to cause it to impact and rake the side of the Plaintiffs' building abutting the alley, resulting in damages to the brickwork and siding thereof and the chainlink fence to the rear of the property. 7. The aforesaid damages were caused solely by the negligence, carelessness and recklessness of the Defendant in that he: a. Operated the vehicle at a speed excessive for the conditions then and there prevailing upon the roadway; b. Failed to keep his vehicle under control; c. Failed to keep a careful and prudent lookout for the property of the Plaintiffs; d. Operated his vehicle while in such a state of intoxication that he could not perform said functions in safety; and e. Failed to brake his vehicle in sufficient time to avoid impact with the Plaintiffs' building. 8. Solely as a result of the Defendant's negligence, carelessness and recklessness as aforesaid, the Plaintiffs' property required repair in an actual cash value of $3,691.20 as reflected in the estimate attached hereto as Exhibit A. 9. As of the date of this complaint Defendant has refused to pay the aforesaid sum which is still due and owing. WHEREFORE, Plaintiffs demand judgment against the Defendant in the sum of $3,691.20 together with interest from April 30, 2006 and the costs of this action, which sum is within the jurisdictional limits for compulsory arbitration in Cumberland County.
