Dear Judge Shughart:
On or about September 24, 1979, John Alosi filed an Objection
to the First and Final Account filed in the above-captioned matter.
That Objection together with the First and Final Account of Patsy
A. Naugle, Executrix, was submitted to you on October 9, 1979.
Thereafter by Order of Court, dated October 9, 1979, Murrell R.
Walters, III, Esquire was appointed Auditor. The Order did not
provide that the Exceptant should be required to post costs in
advance of the audit proceedings.
I would respectfully request, on behalf of the Clerk of the
Orphans' Court, that an amended Order be issued requiring Mr.
Alosi, not an heir in the estate, to post the sum of $250.00 in
the event that the costs of the proceedings are ultimately assess-
ed against him.
By copy of this letter, I am notifying Mr. Walters, Hamilton
C. Davis, Esquire, the attorney for the accountant, and Mr. Alosi
of the foregoing.
