THIS AGREEMENT made the,~4~day of~--~ , 2003, by and between
Artistech, Inc., hereinafter referred to as Contractor, and John Augustine and Deanna K. Augustine,
hereinafter referred to as Owner, whereby the former undertook and agreed to erect and construct
a custom built home on that certain lot of ground situate at Lot 6 Misty Meadows, Boiling Springs,
Cumberland County, Pennsylvania, more fully described in Exhibit "A" attached hereto and made
a part hereof.
NOW THEREFORE, WITNESSETH: That the said Contractor, for and in consideration of
the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves
and their subcontractors, and all parties acting through or under them, covenant and agree that no
mechanic's liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby expressly waive and relinquish
the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any
of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant.

ALL that certain tract of land situate in South Middleton Township, Cumberland County, Pennsylvania,
bounded and described in accordance with a Final Subdivision Plan, Phase Il, Misty Meadows, dated January
24, 2003 last Revised April 16, 2003, prepared by Advantage Engineer Services, Inc., and recorded July 8,
2003, in the Office of the Recorder of Deeds in and for Cumberland County, in Plan Book 87, Page 65, as
follows, to wit:
BEGINNING at a point along the northern right-of-way of 50 foot right of way of 50 foot wide East
Creamery Road at the dividing line between a 50 foot wide unnamed street and Lot #6 on the hereinabove
referenced Plan; thence along said dividing line North 02 degrees 41 minutes 11 seconds East 130.00 feet
to a point along line of lands now or formerly of William F. Mentzer et al; thence along said line of lands
now or formerly of Mentzer et al, South 87 degrees 18 minutes, 49 seconds East 143.67 feet to a point;
thence along the divding line between Lot #6 and Lot #8 on the hereinabove referenced Plan, South 02
degrees 41 minutes 11 seconds West 130.00 feet to a point along land of said East Creamery Road; thence
along said right-of-way line of East Creamery Road, North 87 degrees 18 minutes 49 seconds West 143.67
feet to a point, the Place of BEGINNING.
BEING Lot No. 6 of the Plan of Lots known as Misty Meadows - Phase Il, and containing 18,667.10 square
feet.
BEING part of the same premises which Blanch E. Demmy also known as Blanche E. Demmy by her
attorney in fact Financial Trust Services Company formerly known as Farmers Trust Company, granted and
conveyed unto Misty Meadows Parmership, a Pennsylvania General Partnership, a Pennsylvania General
Partnership, Grantor herein, by Deed dated October 8, 1998, and recorded in Cumberland County Deed Book
186, Page 1044.
