REAL PROPERTY, it is hereby ORDERED that:
A hearing on the within Petition for private sale be held on the

PETITION FOR COURT ORDER AUTHORIZING THE PRIVATE
SALE OF REAL PROPERTY
AND NOW this

day of June, 1978, comes Petitioner, Mabel K. Ward,
and petitions your Honorable Court to authorize the private sale of real
property pursuant to Chapter 83 of the Probate, Estates and Fiduciaries Code
of Pennsylvania, Act of 1974, December 10, P.L.
No. 293, ~ 17 e t seq,
20 Pa. C.S.A. ~8301 et seq, and in support thereof avers as follows:
1. She is the Petitioner in the above matter and is an adult individual
residing at l515A East Caracas Avenue, Hershey, Dauphin County, Pennsylvania.
2. She is the owner of an undivided two-thirds (2/3) interest in fee
simple in the subject real property, 402 Chestnut Street, West Fairview Borough,
Cumberland County, Pennsylvania, sought to be sold; she having acquired such
title as follows:
A. Mabel K. Ward (then Mabel Kemberling) acquired title to the
property in question by deed dated October 17, 1945, and recorded in the office
for recording of deeds in and for the County of Cumberland in Deed Book "B",
Volume 13, Page 220, which parcel of land is bounded and described as follows,
to wit:
ALL THAT CERTAIN piece or parcel of land situated
in the Borough of West Fairview, Cumberland County, and
State of Pennsylvania, bounded and described as follows,
to wi t :
BEGINNING at a point in the Northeast comer of the
intersection of Fourth Street with a twenty (20) feet wide

alley; thence Northwardly along the Eastern line of
Fourth Street, forty (40) feet to a point; thence
Eastwardly along lands of Frank R. Bretz and Ester V.
Bretz, one htmdred twenty-nine and two-tenths (129.2)
feet, to the Western line of a twenty-five (25) feet
wide alley; thence Southwardly along the Western line
of said twenty-five (25) feet wide alley, forty (40)
feet to the northern line of the twenty (20) feet wide
alley aforesaid; thence Westwardly along the northern
line of said twenty (20) feet wide alley, one htmdred
thirty (130) feet to a point, the place of BEGINNING.
B. Habel Kemberling subsequently granted and conveyed said parcel
tmto Mabel Kemberling and Howard V. Ward by deed dated March II, 1949, said
deed being recorded in the office for recording of deeds in and for the COtmty
of Cumberland in Deed Book II e", Volume 14, Page 71.
C. Mabel Kemberling and Howard V. Ward subsequently granted and
conveyed said parcel tm to Mabel A. Kemberling, Howard V. Ward and Vance Leroy
Kemberling by deed dated November 15, 1950, said deed being recorded on
March 17, 1965, in the office for recording of deeds in and for the COtmty of
Cumberland in Deed Book "P", Volume 14, Page 277.
D. Mabel Kemberling and Howard V. Ward were married on Jtme 10,
1952, and on April 26, 1955, Howard V. Ward died testate, leaving his entire
estate, real and personal, to Mabel Kemberling by his Will which is recorded
in the office of the Register of Wills in and for the County of Cumberland
in Will Book 49, Pages 257-258; said bequest leaving Mabel K. Ward as owner of
an undivided two-thirds (2/3) interest in the parcel together with Vance L.
Kemberling, an adult, owner of an tmdivided one-third (1/3) interest in the
parcel, as tenants in connnon.
3. The above Vance L. Kemberling, who would now be fifty-three (53) years
of age, owner of an tmdivided one-third (1/3) interest in the parcel as tenant
in connnon, is a party in interest and his present address is tmknown to your
Petitioner.

4. Petitioner has attempted to contact Vance L. Kemberling, her son,
who on or about August 8, 1957, left his then place of residence, 320 Third
Street, Borough of West Fairview, Cumberland County, Pennsylvania, and has
been absent and unheard of since that date, through known relatives,
i.e. his wife, Mabel Shaull Kemberling (now deceased) and by forwarding a
letter by certified mail, return receipt requested, together with a self-
addressed envelope to the Social Security Administration, Baltimore, Maryland,
all of which effort proved to be of no avail.
5. On or about June 5, 1967, a Petition For Declaration of Death of
a Presumed Decedent Residing in Pennsylvania was filed by Petitioner, seeking
a Court Order decreeing the presumption of death of said Vance Leroy Kemberling,
which Petition is filed in Will Book 96, Pages 95-97.
6. On or about August 1, 1967, a Motion to Withdraw Proceedings was filed
by Keith B. Quigley, Esquire, Attorney for Mabel K. Ward, averring that
investigation had disclosed the probable existence of said Vance Leroy Kemberling.
7. t.fuile inves tigation reveals that said Vance Leroy Kemberling is
probably alive, in that the Social Security Administration reports tax withholdings
by an employer under the social security number of said Vance Leroy Kemberling,
the Social Security Administration will not reveal his whereabouts, such that
said Vance Leroy Kemberling is not available to consent to or othenvise join
in the sale of the subject property, nor will he otherwise voluntarily appear
in the above proceeding.
8. The property in question is described as follows:
A. That piece or parcel of land located at 402 Chestnut Street,
Borough of Fairview, Cumberland County, Pennsylvania, the description of which

appears more fully in Paragraph 2 A above and is incorporated herein
by reference.
B. Improvements on the land consist of a single family frame
house and a garage.
C. The land and improvements thereon are presently subject to a
leasehold interest, said interest to expire July 1, 1978.
D. The current rental value of the property is One Hundred Twenty-
Five ($125.00) Dollars per month, all utilities excluded.
E. The total tax assessmen t of the land and improvements for the
year 1978, is Two Thousand Three Hundred Eighty ($2,380.00) Dollars
($2, 190-building; $190-land).
F. The property is subject to no outstanding liens or charges.
9. It is in the best interest of Petitioner, Mabel K. Ward, and
her son, Vance Leroy Kemberling, that the property identified in Paragraph 8
above should be sold at private sale, with one-third (1/3) of the proceeds
representing the interest of Vance Leroy Kemberling being placed in trust for
him or otherwise disposed of as this Court shall direct for the following reasons:
A. Petitioner is of advanced age, being eighty-three (83) years of age,
and is needful of income with which to meet her daily needs and requirements.
B. Petitioner is no longer physically capable of caring for,
maintaining or otherwise preserving the value of said property.
C. Said property is in a state of physical deterioration.

D. Petitioner does not possess the financial means to care for,
maintain, or otherwise make productive said property.
10. The property is not subject to any trust, charity or any other
purpose which would be prejudiced by private sale.
11. The limitation on alienability from which the title is to be
freed is the absence and unavailability of Vance Leroy Kemberling, owner of an
tmdivided one-third (1/3) interest in said land and tenant in common with
Petitioner, for the purpose of consenting to or otllerwise joining in the sale
of the subject property.
12. Samuel J. Lockey of 314 Fourth Street, West Fairview, Cumberland
County has agreed to purchase the subject premises for the sum of Ten Thousand
($10,000.00) Dollars.
13. The sale of the subject premises is to be effected pursuant to an
Agreement of Sale which requires payment of Two Thousand Five Hundred ($2,500.00)
Dollars by the date of settlement, with the balance to be paid over a term of
fifteen (15) years with interest at nine (9%) per cent per annum, provided that
the buyer shall within two years from the date of settlement pay the outstanding
balance or convert it to a permanent mortgage with a bank or savings and loan
association or other appropriate financing institution. (A copy of the Agreement
of Sale dated Harch 17, 1978 t is attached hereto and marked Exhibit "A").
14. The purchase price of Ten Thousand ($10,000.00) Dollars agreed upon
by your Petitioner and Samuel J. Lockey is better than can be obtained at a
public sale, as said property has a current appraised value of Ten Thousand Five
Hundred ($10,500.00) Dollars and is rapidly deteriorating. (A copy of the

appraisal of the subject property is attached hereto and marked Exhibit liB").
15. The purpose of this proceeding is to obtain a Decree pursuant
to Chapter 83 of the Probate, Estates and Fiduciaries Code of Pennsylvania,
Act of 1974, December 10, P.L.
No. 293, U7 et seq, 20 Pa. C.S.A.
~830l et seq, stating that the title transferred to the purchaser at private
sale shall be indefeasible by Petitioner, Mabel K. Ward, and Vance Leroy
Kemberling.
WHEREFORE, Petitioner, Mabel K. Ward, respectfully requests this Honorable
Court, pursuant to Chapter 83 of the Probate, Estates and Fiduciaries Code,
Act of 1974, December 10, P.L.
No. 293, ~17 et seq, 20 Pa. C.S.A. ~830l et
seq, to:
A. Schedule a hearing on the within Petition;
B. Direct that notice of the hearing be given to Vance Leroy
Kemberling and all other interested parties by advertisement once a week for
three (3) successive weeks in the Cumberland County Law Journal and the Evening
Sentinel in accordance with Rule 51.2 of the local rules of the Orphans' Court
of Cumberland County;
C. Authorize the private sale of the real property identified as
402 Chestnut Street, West Fairview, Cumberland County, to Samuel J. Lockey for
the sum of Ten Thousand ($10,000.00) Dollars and order that the title to said
property be free and clear of any and all interests, liens, and encumbrances
of whatsoever kind;
D. Appoint a trustee to hold in trust that portion of the proceeds
of the sale, less Attorney's fees and costs, as represents the undivided one-

and remaining heating and cooking fuels stored on premises, if any, unless specifically excepted in this agreement, are included in the
sale and purchase price. None of the above mentioned items shall be removed by Seller from premises after date of this agreement. Seil-
er hereby warrants that he will deliver 'good title to all the articles d.:scribed in this paragraph, and any other fixtures or items of per-
sonalty specifically scheduled and to be included in this sale, which are listed as follows:

7. ADJUSTMENTS AT SETTLEMENT: Taxes, rent. water, sewer rents, trash disposal charges and other assessments shall be ap-

9. TITLE: Title is to be good and marketable, free of all liens and encumbrances (excepting zoning regulations, reservations, ease-
ments, and restrictions of record).
10. REJECTION OF TITLE: In case material defects are found in the title, and so reported, then, if such defects are not cured by
the Seller within sixty (60) days of the notice, or on or before the settlement date, whichever later shall occur, the contract shall become
null and void and moneys paid by the Buyer shall be returned, at the option of the Buyer. Seller agrees to the application of so much of
the purchase money as required to the payment of liens and encumbrances at settlement.
11. AGENT: It is expressly understood and agreed between the parties hereto that C. M. Detweiler, Inc., his salesmen and employ-
ees or any officer or partner of C. M. Detweiler, Inc., and any cooperating broker and his salesmen and employees and any officer or
partner of the cooperating broker are acting as agent only and will in no case whatsoever be held liable either jointly or severally to ei-
ther party for the performance of any term or covenant of this agreement or for damages for the nonperformance thereof.
12. REPRESENTATIONS: It is understood that Buyer has inspected the property or hereby waives the right to do so and he has
agreed to purchase it as a result of such inspection and not because of or in reliance upon any representation made by the Seller or any
officer, partner or employee of Sellfr, or by the agent of the Seller or any of the latter's salesmen and employees, or by a cooperating
broker, if any, or any of his salesmen and employees and that he has agreed to purchase it in its present condition unless otherwise
specified herein. It is further understood that this agreement contains the whole agreement between the Seller and the Buyer and there
are no other terms, obligations, covenants, representations, statements or conditions, oral or otherwise of any kind whatsoever con-
cerning this sale. Furthermore, this agreement shall not be altered, amended, changed or modified except in writing executed by the
parties hereto.
13. DEPOSITS: Deposits or hand monies shall be paid to agent for Seller, who shall retain the same until consummation or termi-
nation of this agreement in conformity with the Real Estate Brokers License Act of 1929, as amended. and Regulations thereto now ex-
isting or hereafter published by the State Real Estate Commission.
14. APPROVAL, AND RECEIPT: This Agreement is subject to the approval of the Seller. All parties hereto hereby acknowledge
receipt of a fully-executed copy of this Agreement.
IS. BINDING EFFECT: This Agreement to be binding on the heirs, executors, administrators. and assigns of the parties hereto as
well as the parties themselves.
16. DESCRIPTIVE HEADINGS: The descriptive headings used herein are for convenience only and they are not intended to in-
dicate all of the matter in the sections which follow them. Accordingly, they shall have no effect whatsoever in determining the rights or
