Cumberland County, Rose F. Albarino, Appellant, is hereby ordered and
directed to post a surety bond in the amount of Five Hundred ($500.00)
Dollars to quarantee payment of any costs or charges which may be
ultimately decreed against her in the pending appeal. Said bond shall
be posted within ten (10) days from the date hereof.

CUMBERLAND COUNTY, PENNSYLVANIA
ORPHANS' COURT DIVISION

PETITION TO FIX BOND
AND NO~T, comes Richard E. Anderson, Register of Wills of Cumber-
land County, and makes the following averments:
1. That on May 5, 1978, upon application of John W. Purcell,
Esquire, the named Executor under the Last Will and Testament of Vincent
Maragliotti, dated March 18, 1976, Petition for Probate of that writing
and pursuant to the Executor's Petition, a Decree of Probate was issued
on May 5, 1978, probating and recording the Last Will and Testament of
Vincent Mara'gliotti, Late of East Pennsboro Township, Cumberland County,
Pennsylvania and issuing Letters Testamentary to John W. Purcell,
Esquire, the named Executor.
2. That on May 4, 1979, Rose F. Albarino, a daughter of the
decedent, filed an Appeal pursuant to Section 908 of the Probate, Estate
and Fiduciary Code, from the decision of the Register of Wills on May
5, 1978, admitting to probate the Last Will and Testament of Vincent
Maragliotti dated March 18, 1976.
3. That upon reviewing the writing purporting to be the Last Will
and Testament of Vincent Maragliotti, it appears that the Appellant, a
resident of Scarsdale, New York, is not an heir under the said writing

and specifically Item 7 of said writing provides that Rose Albarino and
other children of the decedent were expressly excluded from any benefits
of the Will.
4. That it is likely that costs may be incurred by the Orphans'
Court in disposition of this Appeal. Petitioner believes that a surety
bond should be posted in the amount of Five Hundred ($500.00) Dollars
to guarantee payment of any costs or charges that may be decreed
against the Appellant because Appellant is a nonresident and not a
beneficiary of any asset of the Estate.
WHEREFORE, Petitioner prays your Honorable Court to issue an
Order direc.ting Rose F. Albarino, the Appellant, to file a surety
($500.00) Dollars. \
