PETITION TO STRIKE APPEAL OR REQUIRE THAT A PETITION BE FILED
PURSUANT TO PROBATE ESTATES AND FIDUCIARIES CODE SECTION 761
NOW COMES your Petitioner, John W. Purcell, Executor for
the Estate of Vincent Maragliotti and petitions for a Rule to
Show Cause why the Appeal filed on May 4, 1979 should not be
stricken on the following grounds:
1. On May 4, 1979, Rose F. Albarino filed a Notice of Appeal,
a copy of 'vhich is attached hereto and made a part hereof as
Exhibit "A"'.
2. Subsequently, the Register of Wills certified the records
to the Orphans Court Division and requested that a bond be filed
in the amount of Five Hundred ($500.00) Dollars and by Order of
Court this was in fact done.
3. Section 761 of the Probate Estates and Fiduciaries Code
states as follows:
"All applications to the Orphans Court Division shall be
by Pe.ti tion in the form prescribed by Rules of the Supreme
Court."

4. In point of fact, no appeal has ever been filed because
no Petition stating any facts has been filed before this Honorable
Court.
5. Appellee was never served with a citation by the Sheriff
of Cumberland County or any other Sheriff.
6. It: cannot be determined at this time exactly what facts
the Appellant is relying upon, and a Petition as described in the
Pennsylvania Rules of the Orphans Court has not been filed.
7. Consequently, no valid appeal exists and the present Notice
of Appeal should be dismissed or a Petition be required.
WHEREFORE, Petitioner requests that this Honorable Court
issue a Rule upon the Appellant to show cause why the Notice of
Appeal should not be strickened and/or dismissed as a melody and
the RegistE~r of Wills be permitted to accept the Last Will and
Testament of vincent Maragliotti and permit the distribution
filed by your Petitioner.
