Ziteh, the OWNERS of the real estate described below, has or is about to execute contract with Jeff Urey's Renovations and Remodeling of Shermans Dale, PA, whose principal place of business is located at 260 Turtle Ridge Road, Shermans Dale, PA 17090, to install as indicated in a Construction Contract at the project site known and numbered as 100 Brindle Road, Mechanicsburg, Cumberland County, Pennsylvania, as more particularly bounded and described on Exhibit "A", attached hereto and made a part hereof; and NOW, THEREFORE, this 31St day of January, 2008, before any authority had been given by James D. Ziteh and Joellen J. Zitch to Haubert Homes, Inc. to commence work on said site, or purchase materials for same, inconsideration of making of the above described Contract with James D. Ziteh and Joellen J. Zitch, and in further consideration of $ paid to the Contractor by James D. Ziteh and Joellen J. Ziteh, the receipt whereof is hereby acknowledged, it is agreed that no mechanics liens or claims shall be filed or maintained against the Owners facilities and the land above described, or upon James D. Ziteh and Joellen J. Ziteh, the Owners, by the Contractor or by any of the materialmen or workmen, or any other person acting through or under them, for or on account of any labor, or materials purchased, or extra labor or materials purchased for, towards, in or about the erection, construction, design and improvement of said facilities, under said contract or otherwise, the right to have, file and maintain such liens or claims against the facility, the land above described, and James D. Ziteh and Joellen J. Ziteh, the Owners being hereby expressly waived by the Contractor for itself, its Contractors, all materialmen, or workmen and others acting through or under them. ,~ IN WITNESS WHEREOF, each of the parties by their duly authorized representatives have hereunto executed this Stipulation Against Liens this 3l'" day of January, 2008.
