(hereinafter referred to as Mr. Girton), of 19 Texaco Road, Mechanicsburg, PA 17055. 2. Defendant in this civil action is Mr. Patrick W. Allard (hereinafter referred to as Mr. Allard) of2232 Orchard Road, Camp Hill, PA. 3. On or about May 17,2002, Mr. Allard contracted with Mr. Girton for the removal of a tree and its stump from 2232 Orchard Road for the pric1e of $300.00 before starting and a balance of either $1,200.00 due on completion or $200.00 due on the thirtieth of every month starting in June, 2002 and ending in December, 2002 for a total of $1,400.00. (Susquehanna Valley Tree Invoice #284, May 20,2002.) 4. Mr. Allard never made the $1,200.00 payment due on completion or any of the $200.00 installment payments. (CV-0000586-03, Cumbe:rland County Magisterial District 09-1-01, D. J. Charles A. Clement, Jr.) Procedural History 5. On November 7,2003, Mr. Girton filed suit against Pat Allard for recovery of the overdue amount on invoice # 284. (CV-0000586-03, Cumberland County Magisterial District 09-1-01, D. J. Charles A. Clement, Jr.) 6. On December 8, 2003, a default judgment was entered against Mr. Allard and for Mr. Girton for the balance ofthe tree and stump removal service, $1,200.00, the filing costs, $86.50, and the judgment costs, $86.50. (Notice ofJudgment, CV-0000586-03, D.J. Charles A. Clement, Jr.) 7. On January 7, 2004, Mr. Allard filed a notice of Appeal :5-om the District Justice Judgment, CV-0000586-03. The appeal was docketed as 04-065 Civil Term and Appellee Girton had until January 27, 2004 to file a complaint. (Notice of Appeal, 04- 065 Civil Term, Deputy Irene E. Morrow.) Request for enforcement ofthe Magistrate Court Judgm,ent 8. Mr. Girton completed performance on the May 17, 2002 contract for the removal of a tree and its stump from 2232 Orchard Road. 9. Mr. Allard was obligated to pay in accordance with the contract terms on Mr. Girton's tender of performance. 13 Pa.C.S. ~9 2301, 2307, 2607(a). 10. Mr. Allard has not made any payments to date. II. Mr. Allard never seasonably objected to the quality oftht: service or demanded further performance so he effectively accepted Mr. Girton's performance and waived any right to demand any cure. Gutter was broken when logs were removed, then repaired at a later date. Gutter still leaks (pictures available). Job was not satisfactorily completed. -1- 9. Mr. Allard does object to performance and quality of service of Mr. Girton and did not wave any right to demand any cure. Mr. Allard requested Mr. Girton to repeatedly come to the site to inspect holes and damage to the yard. Susquehanna Valley Tree workers did come some months later with a bucket of clay and shabbily spot filled with hard clay dirt and left. Left messages again for Mr. Girton to come inspect damage to get matter resolved. 12. Deny. Mr. Allard repeatedly left messages with disapproval and stating he wanted Mr. Girton to come visit the site. t1r. Girton stated he was leaving on a hunting trip and said he would COlue to the house when he returned. 13. Agree. Mr. Allard is willing to concede that Mr. Girton is owed some portion of the balance due. Mr. Allard would like Mr. Girton to amend the contract less an amount agreed upon for unsatisfactory completion of the job.
