E. D. S. T., it appearing that the First and Final Account and Schedule of
Proposed Distribution of Farmers Trust Company, Executor of the Last
Will and Testament of Sharpe P. Mellott, late of the Borough of Carlisle,
Cumberland County, Pennsylvania, deceased, have been filed and advertised
in accordance with law and Rules of Court and the same having been confirme
absolutely by the Orphans' Court Division of the Cumberland County Court
of Common Pleas on May 1, 1979; and it appearing that said Executor in its
Proposed Schedule of Distribution claims distribution of the hereinafter real
estate to Martha 1. Sweeney, Executrix of the estate of Charles H. Wieland,
who died unmarried and testate on December 13, 1978, it"is ordered,
adjudged and decreed that:
ALL that certain tract of land situate in the Fifth Ward of the Borough
of Carlisle, Cumberland County, Pennsylvania, bounded and described as
follows:
ON the North "G" Street; on the East by Lot No. 37, Block 34 of the
hereinafter mentioned Plan of Lots; on the South by a 16 foot alley, and on
the West by Lot No. 34; Block 34 of said Plan of Lots; having a frontage of
50 feet on "G" Street and extending 150 feet in depth. Being Lots Nos. 35
and 36, Block 34 of the Plan of Lots of the Carlisle Land and Improvement
Company as recorded in the office of the Recorder of Deeds for Cumberland
County in Miscellaneous Book No. 11, page 572, on which there is erected
a dwelling house known as and numbered 340 "G" Street.
SUBJECT, however, to the following building and use conditions and
restrictions with which the grantees, for themselves, their heirs and assigns
agree to comply by the acceptance of this deed:

1. No structure shall be erected on the property herein conveyed except
a dwelling house and private garage, attached or detached.
2. Any dwelling house erected on the property herein conveyed shall
cost at least $6500.00.
3. No structure or part thereof shall be constructed within 55 feet of
the center line of "G" Street.
4. Any dwelling house constructed of concrete blocks, erected on the
property herein conveyed, shall be stuccoed on the exterior.
BEING the same premises which Charles E. Parkison and Blanche E.
Parkison, his wife, by deed dated October 13, 1950 and recorded October 13,
1950, in the Office of the Recorder of Deed in and for Cumberland County at
Carlisle, Pennsylvania in Deed Book "N", Volume 14, Page 286, granted and
conveyed to Sharpe P. Mellott and Verna W. Mellott, his wife. The said
Verna W. Mellott, having died on December 22, 1953, title to the same re-
mained vested by operation of law solely in her surviving spouse, Sharpe P.
Mellott. The said Sharpe P. Mellott died unmarried and testate on June 10,
1978, leaving a Last Will and Testament duly probated in the Office of the
Register of Wills for Cumberland County, Pennsylvania, in Will Book 78,
Page 884, wherein he appointed Farmers Trust Company as Executor and
devised the above described real estate to Charles H. Wieland, who subsequen ly
died testate December 13, 1978 and whose Executrix is the within Distributee.
BE AND HEREBY is awarded to Martha 1. Sweeney, Executrix of the
estate of Charles H. Wieland, who died December 13, 1978, leaving a Last
Will and Testament duly probated in the Office of the Register of Wills for
Cumberland County, Pennsylvania in Will Book 80, page 159, wherein he
appointed Martha I. Sweeney, Executrix, and letters Testamentary were issue

in accordance with the Last Will and Testament of Sharpe P. Mellott.
THE Hecorder.of Deeds in and for said Cumberland County is directed to
record this Order 9-ffiong the deed records in her office and to index the same
in the Grantor index in the name of Estate of Sharpe P. Mellott, Deceased, an
in the Grantee index in the name of Estate of Charles H. Wieland, Martha I.
Sweeney, Executrix, in accordance with the Probate, Estates and Fiduciaries
Code, as amended, (20 P. S. 3536).
