HomeMy WebLinkAbout04-0035STIPULATION AGAINST LIENS THIS A~REEMENT made the ~J~ of ~F~;;]~F'~ between Yingst Homes, Inc., 2003, by and Velitchko D. Tassev and Elena G. Tassev, hereinafter referred to as Owner, whereby the former undertook and agreed to erect and construct a single family dwelling on that certain lot of ground situate in 1005 Jenkins Grove, East Pennsboro Township, Enola, Pennsylvania, as per attached legal. NOW THEREFORE, THIS AGREEMENT WITNESSETH~ That the said Contractor, for and in consideration of the sum of ($1.00) Dollar to Yingst Homes, Inc. in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. (Seal) Vel ' t Tas~ev r (Seal) Ele~at G~.~~s~ ~-~ (Seal) ALL THAT CERTAIN lot or tract of land situate in East Pennsboro Township, Cumberland County, Commonwealth of Pennsylvania more particularly bounded and described as follows, to wit: BEGINNING at a point at the dividing line of Lot 12 (Whelan Crossing Phase 2) and subject premises, said point being located 19.57 feet north of a concrete monument; THENCE by line of the eastern dedicated right-of-way line of Jenkins Grove North 24 degrees 47 minutes seconds East 98.99 feet to a point; Thence by line of Lot 15 South 65 degrees 12 minutes 19 seconds East 100.00 feet to a point; Thence by line of Lot 10 (Whelan Crossing, Phase II, Resubdivision of Lots 8, 9, and 10, P.B. 78, Pg. 129) South 24 degrees 47 minutes 41 seconds West 48.02 feet to a point; Thence by line of Lot 11 (Whelan Crossing, Phase II, P.B. 74, Pg. 6) South 66 degrees 09 minutes 51 seconds West 67.91 feet to a point; Thence by line of Lot 12 (Whelan Crossing, Phase II) North 65 degrees 12 minutes 19 seconds West 55.12 feet to a point; the place of beginning; CONTAINING 8,755 square feet. BEING Lot 14 as shown on the Final Subdivision Plan of Whelan Crossing, Phase XI. BEING SUBJECT TO the western half of a 25 foot storm sewer easement as shown on the above mentioned Subdivision Plan. BEING PART OF THE SAME PREMISES which Yingst Homes, Inc., by their deed to be recorded simultaneously herewith in the Office of the Recorder of Deeds of Cumberland County, granted and conveyed unto Velitchko D. Tassev and Elena G. Tassev.
